Long, Chair Commissioner William H. Jerke, Pro-Tem Commissioner William F. Garcia Commissioner Robert D. Masden Commissioner Douglas Rademacher Also present: Acting Clerk to the Board, Esther E. Gesick County Attorney, Bruce Barker Planning Department representative, Michelle Martin Health Department representative, Pam Smith Public Works representative, Jesse Hein The following business was transacted: I hereby certify that pursuant to a notice dated February 9, 2007, and duly published February 14, 2007, in the Fort Lupton Press, a public hearing was conducted on February 28, 2007, to consider the request of JZM, LLC, c/o John Zadel, for a Site Specific Development Plan and Planned Unit Development Final Plan, PF #600, for nine (9) lots with E (Estate) Zone uses, one (1) common open space outlot, and continuing oil and gas production- Distant Thunder PUD. At said hearing, the Board deemed it advisable to continue the matter to March 7, 2007, to allow adequate time for Department of Public Health and Environment staff to review the revised plat and Covenants. On March 7, 2007, Bruce Barker, County Attorney, made this a matter of record. Michelle Martin, Department of Planning Services, gave a brief summary of the proposal and entered the favorable recommendation of the Planning Commission into the record as written, as presented on February 28, 2007. She stated since the last hearing, staff and the applicant met several times and confirmed that all of the items that need to be completed have been addressed or clarified. Pam Smith, Department of Public Health and Environment, stated she discussed her comments with the applicant and they have come to an agreement as to what has been completed and what is still required. John Zadel, applicant, stated he has no additional comments. In response to Chair Long, Mr.Zadel stated he understands, and is in agreement with, the remaining Conditions of Approval to be completed. HEARING CERTIFICATION - JZM, LLC/JOHN ZADEL (PF#600) PAGE 2 Commissioner Rademacher moved to approve the request of JZM, LLC,Go John Zadel,fora Site Specific Development Plan and Planned Unit Development Final Plan, PF#600,for nine(9)lots with E(Estate)Zone uses,one(1)common open space outlot,and continuing oil and gas production- Distant Thunder PUD, based on the recommendation of the Planning staff,with the Conditions of Approval as entered into the record. In response to Ms. Martin, the Board concurred with the applicant's request to amend the amount of open space from 48.63 acres to 47.5 acres, which is a total reduction of 1.13 acres. The motion was seconded by Commissioner Garcia,and it carried unanimously. There being no further discussion, the hearing was completed at 10:10 a.m. This Certification was approved on the 12th day of March 2007.
