Zg3f c ' �a 3�� iS aY tE g S. 6: 1i' :A I3 F9.' .E: 88 8A05°5 r- 12ru A RESOLUTION RE: APPROVAL OF SPECIAL USE PERMIT, WITH AMENDED DEVELOPMENT STANDARDS , FOR A DOG KENNEL FOR JANET HAAGENSTAD, 23981 WELD COUNTY ROAD 35, LA SALLE, COLORADO 80645 WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to Colorado statute and the Weld County Home Rule Charter, is vested with the authority of administering the affairs of Weld County, Colorado, and WHEREAS, the Board of County Commissioners of Weld County, Colorado held a public hearing on the 7th day of January, 1981 at the hour of 2: 00 o'clock p.m. in the Chambers of the Board of County Commissioners for the purpose of hearing the appli- cation of Janet Haagenstad, 23981 Weld County Road 35, La Salle, Colorado 80645, for a Special Use Permit for a dog kennel on the following described real estate, to-wit: All that part of the Northeast Quarter of Section Two, Township Four North, Range Sixty-six West of the 6th P.M. , Weld County, Colorado, more particularly described as follows : Beginning at the point where the East line of said Section Two intersects the center of the County Road (which said County Road extends in a Southwesterly direction from the Northeast corner of said Section Two) ; thence in a Southwesterly direction along the center line of said County Road to a point which is 208. 75 feet distant at right angles from the East line of said Section Two; thence South parallel with the East line of said Section, 417. 5 feet; thence in a Northeasterly direction, parallel to the center line of said County Road, to the East line of said Section Two; thence North along the East line of said Section Two, 417. 5 feet to the point of beginning. WHEREAS, the petitioner was present, and WHEREAS, evidence was presented in support, and also against, the granting of the Special Use Permit for a dog kennel on the above described real estate, and WHEREAS, Section 3. 3 (E) (2) of the Weld County Zoning Reso- lution authorizes such a use in an A-Agricultural District upon approval by the Board of County Commissioners, and 1 1 3 ; PL3 r) I WHEREAS, the Board of County Commissioners of Weld County, Colorado heard all of the testimony and statements of those present, has studied the request of the petitioner and the recom- mendations of the Weld County Planning Commission and all of the exhibits and evidence presented in this matter, and having been fully informed, is satisfied that the request for a Special Use Permit for a dog kennel on the hereinabove described real estate conforms to the purposes of Section 3 . 3 (E) (2) of the Weld County Zoning Resolution, and WHEREAS, the Board of County Commissioners has studied the development standards contained in the Special Use Permit and desires to amend said development standards to include the de- fining of a greyhound breeding kennel, removing all references to boarding kennel, and to delete development standard #5. NOW, THEREFORE, BE IT RESOLVED by the Board of County Com- missioners of Weld County, Colorado that the application of Judy Haagenstad for a Special Use Permit for a dog kennel on the hereinabove described tract of land be, and hereby is, granted subject to the following: 1 The Development Standards, as amended, which are contained in the Special Use Permit. 2. No building or electrical permits shall be issued on the Special Use Permit area until the Develop- ment Standards for the Special Use Permit have been placed on the Special Use Permit plat and said plat has been delivered to the office of the Department of Planning Services. 3. All new construction or building on the property shall be in conformance with the Weld County Flood Hazard regulations. The permitted uses on the hereon described parcel shall be limited to a breeding and boarding kennel and all other uses permitted by right under Section 3. 3.B of the Weld County Zoning Resolution. The location and size of the permitted structures shall be as shown hereon. The maximum numbers of animals permitted shall be twenty (20) dogs (including adults and puppies) . 2. The Special Use Permit area shall be maintained in such a manner so as to prevent soil erosion, fugitive dust, and the growth of noxious weeds. 3. All phases of the operation shall comply with all County and State Health Standards and Regulations pertaining to air quality, water quality, noise emission, and sanitary disposal systems. 4. The Special Use Permit shall be limited to the plans shown hereon and governed by the Development Standards stated above and all applicable Weld County Regulations. Mr. Honn reviewed the Planning Commission' s favorable recommendation, development standards and conditions. Jeanette Shostrom, adjacent landowner, was present and stated her objections to the proposed facility. John Hall, director of Weld County Environment Health, stated that a breeding facility is specificaly excluded from their jurisdiction. However, they do have general health regulations to inforce. Following discussion Commissioner Steinmark made a motion to amend the development standards to include the defining of a greyhound breeding kennel, removing all referance to a boarding kennel and removing development standard #5. Commissioner Martin seconded the motion and it carried unanimously. Commissioner Kriby made a motion to to approve the SUP for a greyhound breeding kennel with the development standards as amended. Rd. 35 La Salle, Colo. 80645 July 9, 1980 Weld County Board of Adjustment Department of Planning Services 915 10th Street Greeley, Colo. 8o631 To Whom It May Concern: We have lived here and raised dogs for almost five years and were unaware that a permit was needed to keep more than three dogs. We are breeding registered, well-bred Greyhounds with the inten- tion of establishing a sucessful business. At the current time we have seven dogs on our property and one Greyhound pup in Kansas being trained. Of the seven dogs, five are Greyhounds and two are registered German. Shepherds that are spayed. The kennels are fenced with five and six foot chain link. The posts are secured in the ground with cement. The dogs are exercized in our south pasture which is wood rail covered with wire mesh to prevent their escape. Because of the extreme value of these dogs, they are never loose to roam the neighborhood. The feces is collected in fifty pound dog food sacks, stored in a dog and cat proof room ajoining the garage and is hauled to the dump • once a month. I contacted a Mr. Ron Stow of the Weld Co. Health Depart- ment, who said we are using an acceptable proceedure. We use i•ialathion for flys and other inserts and De-Con and a cat for rodent control. The dogs are healthy and are always in excellent condition. They are on a special, well balanced diet, have fresh water daily, and are not abused. Not one of the dogs has ever had worms or any other disease. They receive proper medical treatment and are vaccinated. I am a member in good standing of the National Greyhuond Asso. and the Colorado Greyhound Breeders Asso. We will lease out this litter of pups when they are of racing age, which is fifteen to eighteen months of age. Currently, we have one brood bitch and if the pups do well and the economic conditions make it feasible, we may consider one more brood bitch, keeping this a small, well maintained kennel. It is a family operation with no need of hiring outside employees. There are no causes for air or water pollution:. The manure is disposed of properly. As for noise, these are not yappy dogs. They are kept in special kennels inside the barn every night. There is also a special area in the barn for puppies at night. ;As of this date (Oct. 6) there are four dogs on this prop- erty. They are never allowed to roam the countryside .and are con- fined by good chained link fencing. There is no reason for traffic congestion in this operation. The barn is built of cinder block and a fire extinguisher is kept in the kennel area. The manure is picked up daily, put in fifty pound dog food sacks and kept in a garbage storage room next to the garage. It is taken to the County land fill monthly. FLOOD HAZARD REVIEW FOR THE HAAGENSTAD DOG KENNEL (SUP-446 :80 :36) WELD COUNTY October 1980 Potential Sources of Flooding South Platte River and adjacent tributary area Information Available for Review 1 . "Special Flood Hazard Information Report, South Platte River, Volume I, Weld County, Colorado, " prepared by the U. S. Army Corps of Engineers, Omaha District, in April 1977 . This report was designated by the Colorado Water Conservation Board on November 15, 1977, and thus is available to local govern- ments for regulation purposes. 2. "Flood Insurance Study, Weld County, Colorado, Unincorporated Areas and Town of Eaton, Colorado, " prepared by Gingery Associates, Inc. , for the FEMA-Federal Insurance Administration in December 1979. This report was designated by the Colorado Water Conservation Board on March 17, 1980, and thus is avail- able to local governments for regulation purposes. Findings 1. The Flood Insurance Study (ref. 2) is not applicable on this particular reach of the South Platte River. Thus, the Corps report contains the designated information on this reach of the South Platte River. 2. The Corps report shows the flood outline for the May 1973 flood, which was approximately a 100-year event. During the May 1973 flood, the property in question was not flooded. See plate 12N of the Corps report. 3. No profiles or detailed information are available in either report for this reach of the river. 4. Highwater marks in the area from the May 1973 flood are as follows : a. Approximately 3/4 mile upstream at HWM 69, the elevation was 4675. 3. b. Approximately 1/2 mile downstream at HWM 70, the eleva- tion was 4660. 6. c. Based on a crude profile developed from these two high- water marks, the May 1973 flood elevation would be some- where around 4667 feet above mean sea level. This happens to be the same elevation sited on the USGS 7 .5 minute quadrangle map at the intersection of Weld County Roads 394 and 35 . Thus, a potential flood hazard does exist from an actual 100-year event. 5 . The Flood Insurance Study identifies the property clearly as "Zone A" . "Zone A" is an area 'subject to 100-year flooding but for which no base flood elevations or flood hazard factors have been determined. 6. No topographic information is provided on the permit applica- tion for comparison purposes; this would be helpful. Recommendations A. Based on the above findings, the proposed new structures should be raised to an elevation of 4668 feet above mean sea level. This should be approximately 1 foot higher than the intersection of 394 and 35 . B. Any operations of the Kennel should not obstruct the passage of the 100-year flood or create any adverse effects on others. Presently, this would not appear to be a problem; however, a detailed analysis would be needed to be absolutely sure. C. Applicable floodplain regulations should probably be applied. LaSalle, CO. 80645 The following is in answer to your request for soil information, for a dog kennel using existing buildings located in the Na, of Section 2, Twp. 4N, Range 66W, Weld County, Colorado. As indicated on the soil map, the entire site is made up of the soil type Aquolls and Aquents, gravelly substratum (34). This soil type is a deep, poorly drained soil that can be subject to flooding. There usually is a watertable at or near the soil surface in the early spring and during the irrigation season that may receed to as deep as 48 inches by late fall in some years. The flooding potential and high watertable presence in this soil generally limits the use to grazing land or wildlife habitat. Other land uses should be carefully considered and evaluated. An on-site investigation should be made by a qualified soils engineer prior to any building construction, and construction designs must consider site conditions. If outside dog runs are being planned, soil wetness may have a detrimental effect and special design should be considered. High grading or diking may be considered for flood prevention.
