District Wildlife Manager Troy Florian made a site visit to the parcel. In this letter you will find our comments concerning the proposal. The site is located north of and adjacent to WCR 86 and'A mile west of WCR 19. The parcel appears to be a mixture of short to mid grass pasture ground. If the parcel is divided for residential purposes, the CDOW recommends that: • Ground-breaking construction occur between August 15 and April 1 to prevent the destruction of nesting wildlife. • Noxious weed and re-vegetation management plans are developed and implemented in areas where there will be ground disturbance due to construction activities. • Any fences built are recommended to be three or four strand fencing with a bottom strand height of 17 inches and a maximum top strand height of 42 inches, along with installation of double stays between posts. • Leash covenants are used in the development. • Future homeowners are made aware of traditional land uses that may impact them. • Future homeowners are made aware of nuisance wildlife in the area. Ground-breaking Construction. The short/mid grass prairie is a desirable nesting habitat and contains a large number of different species of small birds. Most species of small birds are primarily ground nesting birds, although some species nest in trees or bushes. Some of these species are permanent residents while others are migrants or summer(breeding)residents. Many of these small birds are categorized as neo-tropical. Neo-tropical species are experiencing drastic population declines and the CDOW is concerned about any activities that could negatively impact them. All of the ground-nesting birds in this area could be subject to habitat loss, displacement and disturbance from future construction or development. It is possible that human activities around nest sites during critical nesting periods can have significant negative impacts. In regards to ground-nesting birds in the area, it is recommended that any ground breaking construction that takes place on the proposed area occurs before April 1 and after August 15 to minimize any impacts that human activity may have on these ground nesting birds. USFWS staff recommends this as well as a way of avoiding violation of the Migratory Bird Treaty Act. Noxious weeds reduce property value and wildlife habitat. With new construction taking place and machinery being transported from one site to another, it is important to help prevent the spread of noxious weeds. Equipment should be cleaned periodically to remove weed seeds even if no weeds are recognized. It is recommended that noxious weeds are actively eradicated. A working weed management and disturbed area reclamation plan should be developed and implemented throughout construction and until all disturbed areas are properly re-vegetated to prevent erosion and invasions by weeds. The applicant may want to contact the Weld County Weed Inspector to facilitate development of reclamation and weed management plans for the development. Fencing. CDOW is concerned for the safety of the wildlife in the area if fences are erected,as some types of fencing can be dangerous and even fatal to wildlife. Therefore, we recommend that if any fencing is to be used within or around development sites, either during or after the project, it should be the type that would allow the free passage of wildlife.Fencing plans should avoid the use of woven wire type fences that will trap or prevent movement of wildlife. We prefers the use of three or four strand fencing with a bottom strand height of 17 inches and a maximum top strand height of 42 inches, along with installation of double stays between posts. Leash Covenants. The future residential development should include covenants that prevent domestic dogs and cats from running at large. Domestic dogs and cats roaming the open space in this area and adjacent property would have a definite adverse impact on wildlife in the area. CDOW feels strongly that this wildlife corridor encompassing the adjacent upland should be protected from domestic pets of local residents inclined to walk dogs in this natural area. Traditional Land Uses. As this area develops, it is important to maintain the legacy of traditional agricultural land uses. Hunting is one such activity that provides recreation and income to landowners and businesses along the 1-25 corridor. Geese, ducks, pheasants and doves are a few of the wildlife species that are hunted in this area. In fact surveys indicate that Weld and Larimer Counties are among the most important in Colorado in the popularity of small game and waterfowl hunting activities. People travel from all over the United States to hunt waterfowl along the I-25 corridor. Hunting is not only a recreational activity and economic asset,but also an important management tool used by the Colorado Division of Wildlife to manage wildlife populations. Hunting is used as the primary tool to balance wildlife populations with available habitat. With increasing rural development, it is advisable that new residents be informed of traditional land uses,such as hunting, occurring on adjacent land that may impact them. Living with Wildlife. It is recommended that future homeowners aware made aware of nuisance animals that are found in rural areas. Coyotes,raccoons, skunks, foxes and prairie dogs can all potentially present problems for landowners. Homeowners should be made aware of the potential problems that coyotes and skunks can cause with domestic dogs and cats. The new homeowners should be made aware that it is their responsibility to prevent and handle any problems that may arise. The CDOW has brochures available for homeowners that talk about living with wildlife and will also be happy to give suggestions on how to prevent any potential problems. "Ground breaking construction occur between August 15 and April 1 to prevent the destruction of nesting wildlife." Jason S. Slater had a telephone conversation with David Clarkson, Area Wildlife Manager for the CDOW regarding this item. Mr. Slater indicated to Mr. Clarkson that due to numerous factors including weather issues, financial considerations, etc., that the single family residence ground breaking would occur prior to August 15, 2007. Mr. Clarkson in turn suggested a comprehensive inspection of the homesite be performed to locate any possible nesting areas that could be affected. The location of the house is on a ridge which lacks any trees, bushes, etc.. A visual inspection performed by Mr. Slater of the future homesite and surrounding area did not indicate any nesting areas of birds or other wildlife. Although student and land impacts associated with this project appear minimal, already approved residential development within the area of the project contributes to a substantial cumulative impact upon Weld County School District Re-4. In addition, the effect upon school site planning is significant because of the difficulty in acquiring school sites in the appropriate locations and sizes to serve such dispersed development. Given the rapid gowth of other areas within the School District, Weld Re-4 remains concerned with its financial ability to provide for continuing growth within. the area of the project. This and related concerns are discussed in detail below. Site Issues Windsor School District understands that the project proposes to rezone the property from Agricultural to Estate use, creating two single-family residential units. At this time, land dedication is not feasible to offset the impact of growth upon the School.District. Therefore, District Re-4 requests cash-in-lieu of land for both lots at the current market value of land within the area (see recommendations). Should the land use of either lot change, the District requests the opportunity to respond to any proposed land use changes. Given the substantial amount of residential development opportunity within District, it is strongly recommended that the County, Towns and the School District master plan the cumulative effects of growth upon existing and future school sites. • WELD COUNTY SCHOOL DISTRICT RE-4 Business Services 1020 Main Street • P.O. Accelerated residential growth and strong growth potential heighten the School District's concern regarding its ability to provide adequate educational opportunities. Approved development far exceeds the District's current capacity to fund educational facilities. Consequently, approval of this project would exacerbate the expected seat (capacity) shortages. As of July 1, 2006, the District's total bonding capacity approximated $56.2 million at 20 percent of assessed valuation per state statute. Debt outstanding from the previous bond election is $34.2 million leaving $22 million available for future facility needs throughout the District. Given residential development and student potential from already approved but not completed projects, this amount is sorely deficient to provide the necessary school facilities. If recent rates of growth are maintained, several schools at all levels will be required to serve the student population. For example, the District expects that within the next five to ten years, a new high school will likely be required. The costs associated with building a new high school will, by itself, more than consume the remaining debt capacity, compromising the District's ability to provide for other areas of need, especially at the middle school level. Inadequate bonding capacity is the direct result of residential growth occurring at a pace that well exceeds the District's statutorily limited ability to fund school construction. Recommendations The School District remains very concerned about the recent trend toward accelerated residential activity and the ensuing enrollment that will follow as well as the District's physical and financial abilities to serve that growth. Because land dedication is not feasible from a development of this size, the District requests that the developer agree to pay cash in lieu of land. Recent reviews of data regarding land sales suggest that the cash-in-lieu amount should increase from $1,200 to $2,240 per single-family detached unit(see attached calculations). Therefore, it is requested that the County apply this valuation for all property within the School District. Assuming payment of cash-in-lieu of land at the updated value of$2,240 per unit, the School District does not object to approval of this Recorded Exemption. In addition, the School District requests to be notified of any proposed land use changes associated with either lot. Building permits shall be obtained prior to the construction of any building. Buildings that meet the definition of an Ag Exempt Building per the requirements the Weld County Code do not need building permits, however a Certificate of Compliance must be filed with the Planning Department and an electrical and/or plumbing permit is required for any electrical or water for watering or washing of livestock or poultry. 2. A plan review is required for each building except for buildings that meet the definition of Ag Exempt buildings. Plans may require the wet stamp of a Colorado registered architect or engineer. 3. Buildings shall conform to the requirements of the codes adopted by Weld County at the time of permit application. Current adopted codes include the 2003 International Residential Code; 2003 International Building Code; 2003 International Mechanical Code; 2003 International Plumbing Code; 2003 International Fuel Gas Code; 2005 National Electrical Code and Chapter 29 of the Weld County Code. 4. Each building will require an engineered foundation based on a site-specific geotechnical report or an open hole inspection performed by a Colorado registered engineer. Engineered foundations shall be designed by a Colorado registered engineer. 5. Fire resistance of walls and openings,construction requirements, maximum building height and allowable areas will be reviewed at the plan review. Setback and offset distances shall be determined by the Zoning Ordinance. 6. Building height shall be measured in accordance with the 2003 International Building Code for the purpose of determining the maximum building size and height for various uses and types of construction and to determine compliance with the Bulk Requirements from Chapter 23 of the Weld County Code. Building height shall be measured in accordance with Chapter 23 of the Weld County Code in order to determine compliance with offset and setback requirements. Offset and setback requirements are measured to the farthest projection from the building. 7. Provide letter of approval from Windsor/Severence Protection District prior to new residential construction. 8. There is one historical building permits on record with final status on this parcel. Weld County Planning Department RECEIVED Stare Engines 918 10th Street 0• Greeley, Co 80631 Re: Slater Re-subdivision Case No. RS-1136 Sec. 33, T8N, R67W, 6th P.M Water Division 1, Water District 1 Dear Ms. Hippely: We have reviewed the above referenced proposal to re-subdivide a 29.41-acre parcel described as Lot 12, Black Hollow Acres subdivision, into two single family residential lots of ten and 19.41 acres. Water for the existing residence, which will be located on proposed lot 1, is to be provided from an existing well constructed under permit no. 194176. The North Weld County Water District is proposed to provide water to proposed lot 2. A Water Supply Information Summary Form was not included in the referral material. According to our records well permit no. 194176 was issued April 15, 1996 to construct the only well on a residential site of 29.14 acres described as Lot 12, Black Hollow Acres Subdivision, Weld County. The well was constructed on July 17, 1996 to a depth of 380 feet. The use of ground water from this well is limited to ordinary household purposes inside one single family dwelling and the ground water shall not be used for irrigation or other purpose. The applicant's proposal to use this well for the residential lot appears to be within the provisions of the well permit. In addition, according the Well Completion Report submitted in 1996, after completion, the yield of this well after a one hour test was reported as 11 gpm. If this well continues to have a similar production rate the water supply should be physically adequate. The proposed water source for lot 2 is identified as the North Weld County Water District ("District") and a letter of commitment for service from the District was provided. Based on current information on file in this office, the District will typically furnish 70% of an acre-foot (228,000 gallons) of water per tap per annual water year if the allotment for the Colorado-Big Thompson (CBT) project water, as determined by the Northern Colorado Water Conservancy District, is 50% or greater. The District will restrict the delivery as necessary when the CBT allotment is less than 50%. Based upon information provided to this office by the District, the District currently has an adequate uncommitted water supply to provide the water associated with this project. r Weld County Planning Dep_ ..ment Page 2 of 2 Slater Re-subdivision December 27, 2006 Therefore, pursuant to Sections 30-28-136(1)(h)(I) and (II), C.R.S., the State Engineer's office offers the opinion that, with the District as the water supplier of lot 2, the proposed water supply will not cause material injury to existing water rights, and the supply is expected to be adequate. We recommend that the County obtain a signed copy of the water service agreement from the District prior to the final approval of the subdivision. In addition, in regards to the lot served by the well, please note that the long term adequacy of any ground water source may be subject to fluctuation due to hydrological and climatic trends.
