This project falls primarily under the purview of the Use by Special Review Standards, Weld County Code, Chapter 23, Article II, Division 4, Section 23. Our comments and requirements are as follows: COMMENTS: This USR application is simply to gain approval to use the current Meyer residence (or portion thereof) as a boarding facility for cats. The current classification of 67th Ave. is a local roadway. North 67'" Ave. is a cul-de- sac and will likely remain so into the foreseeable future. It is likely that the City of Greeley will annex this area soon. The applicant states that the new business will generate an additional 2 to 3 cars per day. It is unclear if this is ,dotal trips or just destination trips. The applicant is asked to provide the number of"total trips" estimated to and Jm the business on a regular business day. REQUIREMENTS: Access: The proposed access is the existing access to the single family residence. The access drive should be improved to meet access standards (23-2-240, Section 9). Off-Street Parking: The applicant shows a parking area identified on the plot plan. It is approximately 20'x30' which would accommodate 3-4 cars. Considering its current layout, the "turnaround" will not work properly unless the "tree island" is removed allowing for vehicles to back into the driveway and exit to the southwest. The applicant should address this issue. If the proposed use includes office space for customer payment, etc., the applicant will be required to provided parking lot spaces that are hard surfaced (paved) to meet ADA requirements. The Department of Planning Services will determine the appropriate number of parking spaces as dictated by the proposed use. All parking spaces will be required to use wheel stops to delineate parking from walk or pedestrian travel areas. Identification Sign: The applicant has not indicated on the plot map the desire to install an identification sign for the new business. This should be identified on the plat, if appropriate, and be located outside any future right-of-way or easements. Soils: The applicant has shown on the plot map general soils classifications based on what is assumed to be, „US Soil Conservation Service classes. This information is of little value to determine the suitability of soils for tposed construction, infiltration or stability. The applicant should consider a geotechnical investigation for their proposed building site. This will assist with the design and construction of its foundation. Storm Water Drainage: The applicant states that the proposed construction will not affect the overall storm drainage from the site. This statement is not true as the new building will increase the impervious area of the ite. However, the addition is less than 500 SF thereby causing very little additional runoff. USR-1587 1. A building permit shall be obtained prior to the construction of the addition or remodel to the existing structure. 2. A plan review is required for each building for which a building permit is required. Plans may be required to bear the wet stamp of a Colorado registered architect or engineer. Two complete sets of plans are required when applying for each permit. 3. Buildings shall conform to the requirements of the various codes adopted at the time of permit application.Currently the following has been adopted by Weld County:2003 International Building Code;2003 International Mechanical Code; 2003 International Plumbing Code; 2003 International Fuel Gas Code; and the 2005 National Electrical Code and Chapter 29 of the Weld County Code. 4. All structures will require an engineered foundation based on a site-specific geotechnical report or an open hole inspection performed by a Colorado registered engineer. Engineered foundations shall be designed by a Colorado registered engineer. Check with the Building Department if the foundation for the addition meets the exemptions of the Weld County Code. A minimum of a two hour occupancy separation wall must be built between the kennel and the dwelling. The exact requirement will be determined at the plan review. 5.The buildings will be classified as a mixed occupancy. B/R-3 (kennel and single family dwelling). Fire resistance of walls and openings, construction requirements, maximum building height and allowable areas will be reviewed at the plan review. Setback and offset distances shall be determined by the Zoning Ordinance. 6. Building height shall be measured in accordance with the 2003 International Building Code for the purpose of determining the maximum building size and height for various uses and types of construction and to determine compliance with the Bulk Requirements from Chapter 23 of the Weld County Code. Building height shall be measured in accordance with Chapter 23 of the Weld County Code in order to determine compliance with offset and setback requirements. When measuring buildings to determine offset and setback requirements,buildings are measured to the farthest projection from the building. Property lines shall be clearly identified and all property pins shall be staked prior to the first site inspection. 7. Additional information shall be provided stating their typical daily requirements, including approximate square footage of cat care facility, housing (bedding), levels of acceptable noise and dietary requirements. The applicant's USR Map delineates limited fencing on site predominately at the perimeter with the hobby room and new addition attached to the existing single family residence. Given that this is a private facility with little public contact, 2-3 persons dailiy, staff will waive the parking requirement. Staff will not require the site to meet ADA standards. The application does not provide information conceming the date of construction for all on-site structures. As there is a change in use, the Department of Building Inspection shall be contacted to verify how the structure was permitted and if there are any building related issues that should be addressed. The application states that domestic water is obtained from North Weld County Water District. As this is technically a commercial endeavor, verification of a commercial tap should be obtained from the water district. The application states that there is a leach field on site. Wastes are disposed of through a refuse hauler. Section 23-3-250.A.6 states "Areas used for trash collection shall be screened from public rights-of-way and all adjacent properties. These areas shall be designed and used in a manner that will prevent wind- or animal-scattered trash." It is unclear from the applicant's drawing whether the trash collection area is screened from the public rights-of-way and adjacent properties. Written and /or graphic evidence shall be submitted to the Department of Planning Services for review and approval. Section 23-3-250.B addresses Operation Standards. Section 23-3-250.B.6 addresses the issues of Light. "Any lighting, including light from high temperature processes such as welding or combustion, shall be designed, located and operated in such as manner as to meet the following standards: sources of light shall be shielded so that beams or rays of light will not shine directly onto adjacent properties; neither the direct nor reflected light from any light source may create a traffic hazard to operators of motor vehicles on public or private streets; and no colored lights may be used which may be confused with or construed as traffic control devices." It is unclear from the applicant's drawing whether there is any exterior lighting. The applicant shall provide written and /or graphic evidence to the Department of Planning Services for review and approval. A Lighting Plan maybe required, if applicable. Section 23-3-250.6.7 states "Property shall be maintained in such a mannerthat grasses and weeds are not permitted to grow taller than twelve (12) inches. In no event shall the property owners allow the growth of noxious weeds. (Weld County Codification Ordinance 2000-1) The existing on-site landscape treatment is adequate for this facility. DATE: 11/21/2006 COLORADO CC: Environmental Health Services has reviewed this proposal for a kennel for cats only. We have no objections to the proposal, however, we do recommend that the following conditions be part of any approval: We recommend that the following requirements be met prior to allowing the plat to be recorded: 1. The septic system serving the residence shall be reviewed by a Colorado Registered Professional Engineer. The review shall consist of observation of the system and a technical review describing the systems ability to handle the proposed hydraulic load. The review shall be submitted to the Environmental Health Services Division of the Weld County Department of Public Health and Environment. In the event the system is found to be inadequately sized or constructed the system shall be brought into compliance with current Regulations. 2. The applicant shall provide written evidence to the Weld County Department of Public Health and Environment that the applicant has contacted the Colorado Department of Agriculture (CDA), Division of Animal Industry. This contact shall determine if a license under the Pet Animal Care Facilities Act (PACFA), as defined under C.R.S. 35-80-101 through 117. C.R.S. is required, or provide evidence that the applicant is not subject to the PACFA requirements. 3. The applicant shall submit a waste handling plan, for approval, to the Environmental Health Services Division of the Weld County Department of Public Health & Environment. The plan shall include at a minimum, the following: 1) A list of wastes which are expected to be generated on site (this should include expected volumes and types of waste generated). 2) A list of the type and volume of chemicals expected to be stored on site. 3) The waste handler and facility where the waste will be disposed (including the facility name, address, and phone number). We recommend that the following requirements be incorporated into the permit as development standards: 1. Animal and feed wastes, bedding, debris and other organic wastes shall be disposed of so that vermin infestation, odors, disease hazards, and nuisances are minimized. Such wastes shall be removed at least weekly from the facility and disposed by a commercial hauler. 2. All liquid and solid wastes (as defined in the Solid Wastes Disposal Sites and Facilities Act, 30-20-100.5, C.R.S., as amended) shall be stored and removed for final disposal in a manner that protects against surface and groundwater contamination. 3. No permanent disposal of wastes shall be permitted at this site. This is not meant to include those wastes specifically excluded from the definition of a solid waste in the Solid Wastes Disposal Sites and Facilities Act, 30-20-100.5, C.R.S., as amended. 4. Waste materials shall be handled, stored, and disposed in a manner that controls fugitive dust, fugitive particulate emissions, blowing debris, and other potential nuisance conditions. 5. The applicant shall operate in accordance with the approved "waste handling plan". 6. Fugitive dust and fugitive particulate emissions shall be controlled on this site. 7. This facility shall adhere to the maximum permissible noise levels allowed in the Residential Zone as delineated in 25-12-103 C.R.S., as amended. 8. Adequate handwashing and toilet facilities shall be provided for employees and patrons of the facility. Employees and patrons to the site shall be allowed to use the restroom facilities in the residence. 9. Sewage disposal for the facility shall be by septic system. Any septic system located on the property must comply with all provisions of the Weld County Code, pertaining to Individual Sewage Disposal Systems. 2 10.The facility shall utilize the existing public water supply. (North Weld County Water District) 11.The applicant shall comply with the requirements of the Colorado Department of Agriculture (CDA), Division of Animal Industry. 12.The operation shall comply with all applicable rules and regulations of the State and Federal agencies and the Weld County Code. 3 Hello
