HomeMy WebLinkAbout20072857 RESOLUTION RE: AUTHORIZATION FOR THE WELD COUNTY ATTORNEY TO PROCEED WITH LEGAL ACTION AGAINST WARREN WOODWARD FOR VIOLATION OF THE WELD COUNTY CODE WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to Colorado statute and the Weld County Home Rule Charter, is vested with the authority of administering the affairs of Weld County, Colorado, and WHEREAS, Warren Woodward, VI #0600358, is allegedly in violation of the Weld County Code, and WHEREAS, despite efforts by the Planning staff to resolve said matter, the violation has not been corrected, and WHEREAS, on the 11th day of September, 2007, a public hearing was held before the Board of County Commissioners for the purpose of hearing testimony relating to said violation,and WHEREAS, Warren Woodward, property owner, was present at said hearing, and WHEREAS, the Board of County Commissioners deems it advisable to refer said violation to the Weld County Attorney's Office for legal action, with an instruction for delay of action upon such referral until March 11,2007,to allow adequate time for the property owner to restore, remove or screen the noncommercial junkyard from all adjacent properties and public rights-of-way to bring the subject property into compliance and for an inspection of the property by the Department of Planning Services staff. He apologized. He said he had been out of town or he would have called me sooner. He said he realizes that he has some clean-up that needs to occur over there on that property. He said he would need about 90 days to install a fence. He said it would be chain link and then he would use some of that fabric (green)to screen the items. He explained that he didn't want to sink a lot of money in that because he was planning on developing that piece of property. He said at the most that chain link fence would be there is 6-9 months. I explained that if he would submit a letter stating that it would not stay there longer than 1 year maximum than I would go ahead and approve the temporary fencing. I told him that I would get a 90 day letter out to allow him adequate time to install the fencing and have his letter submitted to me. He said that would work and he again apologized for his delay in responding to me. 03/12/2007 Property Inspected Upon a visual inspection of the property, the following items were noted: tires, concrete, semi trailer, 2 camper/trailers, 1 truck topper, wood, metal and miscellaneous debris. No pictures were taken during this inspection. 04/05/2007 Phone Call Warren Woodward called. He said the he fell on the ice this past winter injured his shoulder. He has been trying to schedule surgery for his shoulder(ripped tendons). He said he was going to reduce the amount of stuff he keeps and then put a fence around the remainder. He asked about what kind of a fence (due to the wind), I explained maybe one of those wooden fences that rotate the slats on each side, but don't let you see thourgh the fence. He said he is familar with what I mean. He said that sounds like a good idea. We then discussed the semi trailers (2). He asked if he had to get current license plates. I explained that I did not have the authority to waive that type of requirement He said he didn't want to haul them in just to get plates. I explained that as long has he had titles, I thought he could just take the titles to the Motor Vehicles and get license plates. I told him to just fax or mail me copies of the current registrations. He said he would. He said he thought he could make progress by the first week of May. He planned on hiring someone to help him out with cleaning this site. I told him to call me back by the end of April and I could conduct another inspection. If he had made substantial progress, I would go ahead and continue his case to the June 19th Violation Hearings. NONCOMMERCIAL JUNKYARD: An area where any waste, junk or used or secondhand materials are stored or handled, including but not limited to scrap iron and other metals, paper, rags, rubber tires, building materials and bottles. A NONCOMMERCIAL JUNKYARD may also include the storage or keeping of DERELICT VEHICLES registered last or currently registered under the property owner and/or tenant's name. This definition does not include COMMERCIAL VEHICLES. If the Zone district allows, the NONCOMMERCIAL JUNKYARD shall be totally ENCLOSED within a BUILDING or STRUCTURE or visually SCREENED from all ADJACENT properties and public rights- of-way. SCREENED: Construction and maintenance of fences, earth berms or the USE of LANDSCAPING materials or other materials USED with the approval of the Department of Planning Services to lessen the noise, light, heat or visual impacts of a USE on surrounding uses. A SCREENING PLAN shall be submitted and approved by the Department of Planning Services.
