WHEREAS , the Board of County Commissioners of Weld County, Colorado, pursuant to Colorado statute and the Weld County Home Rule Charter, is vested with the authority of administering the affairs of Weld County, Colorado, and WHEREAS, it has been determined by the Board of County Com- missioners at a public meeting held in the Chambers of the Board, that the division into two parcels of land, as shown on the plat known as Recorded Exemption No. 614, being the property of Davis Farms, Inc. , described as part of the West Southeast a, Section 28, Township 6 North, Range 65 West of the 6th P.M. , Weld County, Colorado, being more particularly described in the plat which shall be provided by the applicant and known as Exhibit "A" , said plat to be recorded, does not come within the purview of the defi- nition of the terms, "subdivision" and "subdivided land", pursuant to its authority under Section 30-28-101 (10) (d) , CRS 1973 , as amended. NOW, THEREFORE, BE IT RESOLVED by the Board of County Com- missioners that the hereinabove described parcel of land owned by Davis Farms, Inc. be, and hereby is , exempt from the defini- tion of the terms, "subdivision" and "subdivided land" . BE IT FURTHER RESOLVED by the Board that this approval is conditional upon the following: 1) the applicant shall reserve a fifty (50) foot right-of-way width from the centerline of Weld County Road 64 for future arterial right-of-way needs as expressed in a May 12 , 1983 letter from the City of Greeley; and 2) the applicant shall submit a revised mylar plat, indicating the fifty (50) foot right-of-way reservation, to the Department of Planning Services ' Office to be recorded in the office of the Clerk and Recorder. The plat shall be drawn in accordance with the re- quirements of Section 9-2 C. (4) of the Weld County Subdivision Regulations. COLORADO May 25, 1983 Board of County Commissioners Weld County Centennial Center 915 10th Street Greeley, Colorado 80631 Re: Recorded Exemption 614 Dear Commissioners: The attached application, plat and related items are in reference to a request from Davis Farm, Inc. for a recorded exemption. The parcel of land on which this request is being made is described as part of the West 1/2, Southeast 1/4, Section 28, Township 6 North, Range 65 West of the 6th P.M. , Weld County, Colorado. The property is located 1.5 miles Northeast of Greeley on Weld County Road 64 and 43. The property contains approximately 80 acres of Class I, IIs and Ile irrigated soils. The request is to divide the property into parcels of 77 acres and 2.468 acres, more or less. It is the intent of the applicant to create a separate parcel for a natural gas processing plant. Based upon the submitted information and policies of the County, the Department of Planning Services staff recommends the request be approved for the following reasons: 1. The request complies with Section 9-2 C. of the Weld County Subdivision Regulations submission requirements. 2. The request complies with Section 9-2 E. of the Sub- division Regulations as follows: The 80 acres, more or less, under consideration will allow uses which are consistent with the intent clause of the Agricultural Zone District. The uses will be compatible with existing surrounding uses. P";n8 / 4t Board of County Commissioners Page 2 May 25, 1983 The proposal was reviewed by the City of Greeley and was found to comply with their long-range Comprehensive Plan. - The proposal is in compliance with Section 1-3 of the Weld County Subdivision Regulations and the proposed land division complies with the Weld County Comprehensive Plan; therefore, the proposed use is consistent with efficient and orderly development. - The proposal does not exist in an overlay district area. The proposed lots meet minimum lot size requirements for land division. - North Weld County Water District has indicated adequate water service is available for this proposal. - The proposed lots are not part of a recorded exemption within the last five (5) years. - The two lots proposed will have adequate access from Weld County Road 64 and 43. - The Weld County Health Department has indicated, in a letter dated April 27, 1983 that both lots will have adequate sewer capacity. The Department of Planning Services staff recommendation for approval is conditional upon the following: 1. It will basically be operated 24 hours per day with one to two people at the plant during normal work hours . It will be main- tained by a crew working out of the office at the plant site to operate and maintain the gas collection and transmission system which sends raw natural gas to the plant. The proposed structures will be constructed of steel frame with siding. All tanks will be constructed of steel, and liquid tanks will be bermed around the exterior high enough to contain the total volume of liquid that might be spilled should the tank rupture. All roads within the plant site will be graveled and natural drainage will be controlled so that it does not exceed the normal runoff from the site prior to construction of the facilities . The domestic sewage system at the site will be a septic system sized to accommodate the equivalent of a single-family residence. A permit for this installation will be obtained from the Weld County Health Department in accordance with the standard requirements . A letter is provided showing that the North Weld County Water District will provide domestic water service to the plant. The vehicular traffic to the site will consist of pipeline service vehicles which will be one or two pickups in and out of the site three to four times per day. At the beginning of processing there will be one to threesemi trucks per day hauling product from the site and in two to three years when the plant is operating at maximum capacity, there will be one to five semi trucks hauling product from the site. It is not the intent of Colorado Gathering and Processing Company to store or stockpile any quantity of materials or waste at the site. There is no waste associated with the processing plant and the only materials that would be stored would be a few valves ; a small amount of pipe materials for maintenance and repair of the pipeline system. The operator intends to construct the plant in sixty (60) days and have it in operation in late June of 1983. No specific land- scaping plan is proposed with this site. The reclamation procedure that would be completed when the plant is no longer needed for use would be to sell all major equipment and move it from the site. Only a minor amount of piping and unsalvagable material would remain. All facilities will be constructed in accordance with the oil insurance association guidelines . The fire protection measures necessary for a processing plant of this type consist primarily of continual attention to safety pro- cedures by the employees . Fire extinguishers will be available at the facilities and in all vehicles , however, if a major fire occurred even the local fire departments would not be able to control such a fire. It would be necessary to shut down the gas pipeline system and let the fire burn itself out . All facilities subject to burning are set back one-quarter mile from the County Road to provide extra protection to the roadway. We have included a copy of the Soils and Geological Study for the plant , for your information. We have also included a cony of the Purchase Agreement and Title Insurance. B '0874 Colorado Gathering and Processing Company is requesting approval to construct a natural gas processing plant on the subject property which is presently zoned Agricultural, under the County regulations for Use by Special Review. This use is consistent with the Weld County Comprehensive Plan and similar plants have been constructed in Agricultural zones throughout the County. The use requested is compatible with surrounding land in that it is adjacent to an abandoned railroad right-of-way and about one-half mile from any residence. It is also compatible in that numerous wells have been drilled throughout the area and production cannot commence on these wells without the processing plant . Future development in the area is anticipated to be additional Agricultural uses with continued development of the oil and gas available in rural Weld County. This future development is compatible with the use intended and in fact is necessary in the case of oil and gas development. This application complies with the Weld County Zoning Ordinance, Section 50, Overlay District Regulations , in that no overlay districts exist at the proposed gas processing plant site. The applicant has negotiated with numerous property owners in the area to establish the best possible location for minimum interfer- ence with the agricultural land and has located the site in accord- ance with these property owners desires . The applicant is designing and constructing the plant following all codes and oil insurance guidelines to ensure the protection of the health and safety of the inhabitants of the neighborhood and of Weld County. ?' 0874 RECORDED EXEMPTION NO.
