RE: ACTION OF BOARD AT SHOW CAUSE HEARING CONCERNING USE BY SPECIAL
REVIEW PERMIT #1193 FOR A JUNKYARD AND SALVAGE YARD IN THE
A (AGRICULTURAL) ZONE DISTRICT - GARY NOVOTNY
WHEREAS,the Board of County Commissioners of Weld County, Colorado, pursuant to
Colorado statute and the Weld County Home Rule Charter, is vested with the authority of
administering the affairs of Weld County, Colorado, and
WHEREAS,on July 11,2007,a Show Cause Hearing was conducted to consider revocation
of Use by Special Review Perm it#1193 for a Junkyard and Salvage Yard in the A(Agricultural)Zone
District, issued to Gary and Mary Novotny,39592 County Road 18, Roggen,Colorado 80652-9312,
and
WHEREAS,Gary Novotny is the current owner of the facility located on property being further
described as follows:
Part of the NW1/4 NE1/4 of Section 27, Township 2
North, Range 62 West of the 6th P.M.,Weld County,
Colorado
WHEREAS,at said hearing of July 11,2007, Planning staff recommended the Board revoke
said Permit due to the findings that the current owner has not been in compliance with Development
Standards #22, #23, and #24, and
WHEREAS,after hearing all testimony presented,the Board deemed it advisable to revoke
said Permit,with the instruction to delay action for60 days to allow for the submittal of an application
for an amendment to the Permit, so long as Mr. Novotny provides subsequent diligence to follow
through with the application process.
NOW,THEREFORE,BE IT RESOLVED by the Board of County Commissioners of Weld
County, Colorado, that Site Specific Development Plan and Use Special Review Permit#1193,
issued to Gary Novotny, be, and hereby is, revoked,with the instruction to delay action for 60 days
to allow for the submittal of an application for an amendment to the Permit.
BE IT FURTHER RESOLVED by the Board that Mr. Novotny be, and hereby is, required
to provide subsequent diligence to follow through the required application process.

Dear Mr. Novotny:
Notice is hereby given that the property listed above, is not in compliance with USR-1193 (Special Use
Permit for a junkyard and salvage yard). All conditions of the original permit must be in compliance by
February 5, 2007 or a Probable Cause public hearing, pursuant Chapter 23, Article II (2), Division 4,
Section 23-2-270 of the Weld County Code, will be scheduled.
If the Probable Cause Hearing is scheduled, the purpose of this public hearing will be to review case
number USR-1193, for compliance with the Development Standards and Conditions of Approval, as
approved by the Board of County Commissioners on September 23, 1998, to determine if probable cause
exists to hold a hearing on revocation of the permits.
Inspections by representatives of this office have determined that you are not in compliance with the
following Development Standards:
#22 The USE area shall be limited to 5 acres.
#23 The maximum number of trailers allowed on the special use site shall be twenty. No
trailers will be stored outside the special use area.
#24 No storage shall be allowed in the waste retention area.
If it is determined at the public hearing that there is probable cause that you are not in compliance with
USR-1193, the Board of County Commissioners will schedule a Show Cause public hearing to consider
revocation of the Use by Special Review permit. I have enclosed a copy of the Plat Map and the Board of
County Commissioners resolution for your convenience.

Pursuant to the zoning laws of the State of Colorado and the Weld County Code, a public
hearing will be held in the Chambers of the Board of County Commissioners of Weld County,
Colorado,Weld County Centennial Center,915 10th Street, First Floor,Greeley,Colorado 80631,
at the time specified.
If a court reporter is desired, please advise the Clerk to the Board, in writing, at least five
days prior of the hearing. The cost of engaging a court reporter shall be borne by the requesting
party. In accordance with the Americans with Disabilities Act, if special accommodations are
