A public hearing was conducted on April 4, 2007, at 10:00 a.m., with the following present:

The following business was transacted:
I hereby certifythat pursuant to a notice dated March 16,2007,and duly published March 21,2007,
in the Fort Lupton Press, a public hearing was conducted to consider the request of Front Range
Village, LLC,fora Change of Zone,CZ#1132,from the R-5(Mobile Home Residential)Zone District
to the C-3 (Business Commercial) Zone District. Bruce Barker, County Attorney, made this a
matter of record. Jacqueline Hatch,Department of Planning Services,presented a brief summary
of the proposal and entered the favorable recommendation of the Planning Commission into the
record as written. She gave a brief description of the location of the 5.3-acre site, which is also
within the Intergovernmental Agreement Area for the Town of Platteville,and the three-mile referral
areas for the Towns of Gilcrest and Milliken. Ms. Hatch stated the Town of Platteville modified its
original request and is now recommending the property be developed through the County since
there are no conflicts with its interests. She stated the Towns of Gilcrest and Milliken indicated the
property is not within their planing areas or Urban Growth Boundaries,and there is no conflict with
their interests. Ms. Hatch stated the site currently contains four mobile homes,three recreational
vehicles(RV),one stick-built structure,derelict vehicles,etcetera;however,there is a Condition of
Approval requiring that all the items be removed prior to recording the plat,with the exception of one
mobile home,which will remain in accordance with Section 23-3-230.C.3 of the Weld County Code.
She stated any future commercial use on the site will require a Site Plan Review,which will ensure
compatibility with surrounding land uses. She further stated the property is currently served by the
Central Weld County Water District and a septic system. Ms. Hatch stated the site is currently
accessed from the U.S. Highway 85 Frontage Road; however, the Colorado Department of
Transportation (CDOT)has indicated a desire to close the Frontage Road and require the site to
access from Weld County Road 34. She stated the applicant will be required to submit evidence
that the concerns expressed by CDOT have been addressed. She further stated 14 referral
agencies reviewed the proposal,six indicated"No Comment",five provided comments that have
been addressed in the Conditions of Approval and Development Standards,and staff received no

response from the Sheriffs Office, Platte Valley Soil Conservation District, and the Central Weld
County Water District.
Pam Smith,Department of Public Health and Environment,stated the site is served by the Central
Weld County Water District and septic systems. She explained the property was previously zoned
and used as a mobile home park, and Weld County has no record of how many, or how large, the
systems are. She stated there is a Condition of Approval which require abandonment of all existing
systems, and the new system for the remaining mobile home and future uses will be designed by
a Colorado registered engineer and comply with all Individual Sewage Disposal System(I.S.D.S.)
Regulations.
Jesse Hein, Department of Public Works, stated the Change of Zone will not alter the necessary
infrastructure or drainage, and staffs only concern deals with the various access points currently
on the site. He stated the Department of Public Works and the applicant will coordinate with CDOT
and the Town of Platteville, since Weld County Road 34 is under Platteville's jurisdiction. In
response to Chair Long, Mr. Hein stated the Department of Public Works agrees that the frontage
road could be closed,since it serves no sites to the north,and that Weld County Road 34 would be
adequate.
Larry Carroll,The Carroll Group,Ltd.,represented the applicant and stated the applicant initially tried
to bring the mobile home park up to current standards; however, it was built in the late 1950's and
early 1960's,and they found the conditions were more extreme than expected. He stated they have
discussed various options with the Town of Platteville, and the local Fire Protection District has
requested the frontage road remain to provide an emergency access. He further stated there is a
property to the north also uses the Frontage Road as a commercial access,therefore,the decision
regarding closure of the Frontage Road is still pending. Mr. Carroll stated three families currently
live on the site,the stick-built structure was originally a laundry mat for the mobile home park,and
the applicant would like to keep that structure and convert it for use as an office. He requested the
Board allow 180 days to complete the Conditions prior to recording,which includes relocating the
existing families, and addressing the issues regarding the Frontage Road. He stated the facility
used one large system that was modified over the years,and that system has been reviewed. He
further stated the applicant has applied for a new septic permit,which is currently under review at
the State Engineer's Office. In response to Commissioner Jerke, Mr. Carroll stated the applicant
will follow the landscaping and access guidelines,and they are considering using the site for RV and
private storage units in the future. He stated they will finalize their future plans and design pending
completion of the Change of Zone. Responding further to Comm issionerJerke, Ms. Hatch stated
the Site Plan Review is done administratively and does not require further review by the Board.
No public testimony was offered concerning this matter. Ms. Hatch stated the Conditions of
Approval do not require removal of the cinder block structure,or the mobile home which is intended
as a caretaker's residence. Mr.Carroll reiterated 180 days would be adequate time to relocate the
remaining families and resolve the access issues. Ms. Hatch stated Condition of Approval#1.A
deals with the removal of items,and she proposed Condition of Approval#4 be modified to extend
the plat deadline to 180 days. Ms.Smith stated there is a septic permit application from 2005,which
was designed for living quarters, which may be excessive for the anticipated use. In response to
Esther Gesick,Deputy Clerk to the Board,Ms.Hatch concurred that Conditions of Approval#3 and
#5 also need to be amended to reflect 180 days.

Commissioner Masden moved to approve the request of Front Range Village, LLC,for a Change
of Zone, CZ#1132, from the R-5 (Mobile Home Residential) Zone District to the C-3 (Business
Commercial)Zone District, based on the recommendations of the Planning staff and the Planning
Commission, with the Conditions of Approval as entered into the record. His motion included
amending Conditions of Approval#3,#4,and#5 to extend the plat submittal deadline to 180 days.
The motion was seconded by Commissioner Garcia, and it carried unanimously. There being no
further discussion, the hearing was completed at 10:30 a.m.
This Certification was approved on the 9th day of April 2007.
