The applicant for USR-1575, Marilyn Taylor has submitted the attached documentation.
1. Prior to scheduling a Board of County Commissioners hearing:
A. If applicable, the applicant shall submit a detailed signage plan to the Department of
Planning Services. (Department of Planning Services)
The applicant has submitted the attached letter dated December 1, 2006 with two pages
of graphics delineating the proposed sign to be on site.
B. The applicant shall submit to the Department of Planning Services with a copy of the well
and maintenance agreement for the well located on the property. (Department of
Planning Services)
The applicant has provided a copy of a recorded well sharing and maintenance
agreement recording date November 27, 2006 Rec#3437385.
C. The applicant shall submit a Landscape and Screening Plan to the Department of
Planning Services. (Department of Planning Services)
The applicant has submitted the attached letter dated December 1, 2006 stating that no
formal Landscaping and Screening Plan is proposed other than for aesthetic value as
shown on the plat. Staff is in support of the Landscaping and Screening Plan.
D. The applicant shall submit a drainage report in compliance with Section 23-2-240.A.5 of
the Weld County Code to the Department of Public Works. Written evidence of approval
shall be submitted to the Department of Planning Services. (Departments of Public
Works and Planning Services)
The Department of Public Works have submitted the attached Memorandum dated
January 3, 2007 stating that 'assuming the recommended changes to the report and
plans have been made, the revised drainage report can be approved".
E. The applicant shall provide additional information in regards to the number of persons
utilizing the site to the Department of Planning Services to determine the appropriate
number of parking spaces required. (Department of Planning Services)
The applicant has submitted the attached letter dated December 1, 2006 stating that they
would like to increase the number of employees from three (3) to four (4). Staff is in
support of the number of employee change.

Per the Land Use Application Summary Sheet (Preliminary) dated October 17, 2006, I
am submitting the following information and documentation required to schedule a Board
Of County Commissioners Hearing:
A. Signage: There will be one outdoor sign identifying the Eagles Nest Assisted
Living facility. As noted on the attached site plan, the location will be in the
northeast corner of Lot B with appropriate set back from the property line. The
sign will be 16 square feet (4X4) and will include the Eagles Nest name and logo
on weather treated board with custom brick border matching house exterior. (See
attached EAGLES NEST sign and logo layout.)
B. Shared Well Agreement: Copies of the Well Sharing Agreement and Joint
Ownership and Maintenance Agreement are attached.
C. Landscaping and Screening: Kim Ogle has stated in his memorandum dated
August 21, 2006, that no formal landscaping plan will be required due to the fact
that the Eagles Nest site is only able to support grasses and native plant materials.
As designated on the attached site plan, minimal lawn areas with shrubbery will
be in place for aesthetic value and resident enjoyment. Remaining vacant land
will be maintained in natural vegetation controlled with a weed management plan.
Also designated on the site plan is a totally wooden screened area located east end
of the parking lot. This area will be totally contained with a gate opening to the
north and will house a trash receptacle and propane tank.
D. Drainage: Copies of the Project Information and Drainage Report, Drainage
Outlet Detail and Erosion Control Plan designed by High Plains Engineering
are attached. Duplicate copies have been submitted to Weld County Public
Works for review and approval.
E. Staffing: After further review, the number of daily staff should be increased to
four daily employees. This number includes two full time caregivers, one full
time cook and one night shift staff person from 10:00PM to 6:00AM daily.
Adequate parking to accommodate 8 spaces is designated on the site plan per the
attached Appendix 23-B from the Weld County Code. The parking area also
conforms to the ADA standards as outlined in the attached U.S. Department of
Justice ADA Technical Assistance Manual.

3� WELL SHARING AGREEMENT
This agreement is entered into this 20'"day of November,2006. Grantor,Marilyn M. Taylor is the
owner of certain property located in Weld County,Colorado, described in Exhibit A.which is
attached hereto and incorporated herein by reference.
I. Grantor hereby Grants,bargains,sells,transfers and conveys to Grantee one-half(1/2)
interest in the commercial well and water thereon as described in the attached Joint
Ownership and Maintenance Agreement, Exhibit A,for the purpose of providing to
Grantee the use of water from said well in the manner and for the purposes which have
been historically established for Lot B of Recorded Exemption (RE-4053)and USR-1575.
2. Grantor further Grants,bargains,sells,transfers and conveys to Grantee the right of access
from Lot A of Recorded Exemption No.(RE-4053)to said well for the purpose of
inspection, maintenance, repair and replacement of said well, pump,water lines and any
other associated accessories as may be required from time to time. Grantor further Grants,
bargains, sells,transfers and conveys to Grantee a right of access over Grantor's access
over the driveway of Grantor's parcel for the purpose of providing access to equipment
reasonably necessary for the performance of any such inspection, maintenance,repair
and/or replacement.
3. As additional consideration for the Grant of said water and well rights and said easement
and access rights,Grantee hereby acknowledges and agrees that said well has served and
shall continue to serve the business entity currently located on Lot B of RE-4053/USR-
1575,consistent with historic use,and accordingly,Grantee agrees that in the event said
well or pump require maintenance,repair or replacement,Grantee shall be responsible for
one-half(1/2)of such cost. Grantee agrees to be responsible for the entire cost of
replacement of the water pipeline(s)connecting said well and pump to Lot A of RE-4053.
4. As further consideration for this Agreement,Grantor and Grantee are equally responsible
to periodically inspect,maintain, repair and where necessary, replace the well pump and
associated accessories. Repair and where necessary, replacement of defective well, pump,
associated accessory, or part there of is the equal responsibility of Grantor and Grantee and
all costs shared Fifty-Fifty(50-50).
5. Nothing herein shall be construed as warranty by Grantor,his heirs,representatives,
successors or assigns of the quality of water.
6. Grantor and Grantee shall comply with applicable federal, state and local law subject to
such vested property rights as they may have from time to time.
7. This Agreement shall be perpetual and shall run with the land. This Agreement shall be
recorded for the benefit of both Grantor and Grantee.
8. This Agreement is binding upon the Grantor and Grantee,their heirs, representatives,
successors and assigns.

Joint Ownership and Operation Maintenance Agreement
Owner(s) of Lots A&B shall have access to and water provided by water well
(Permit#64660) located on Lot B. Lot A and Lot B are owned by Marilyn M. Taylor.
Currently,only Lot B is scheduled for development. The proposed commercial well will
be installed,operated and maintained for the benefit of both Lot A and Lot B should the
current development expand to Lot A. In the event that Lot A is sold or transferred, the
new owner of Lot A will be responsible for one-half of all operating and maintenance
costs to owner of Lot B as long as they draw water from the well on Lot B. The recorded
plat for USR-1575 shows shared access for Lot A and Lot B to include an easement on
Lot B for the owner of Lot A for access to water as long as Lot A draws water from the

SITE DESCRIPTION:
This study was prepared for an assisted living facility to be constructed on
Lot B of RE-4053 or 6994 WCR 39, Weld County, CO. The site is in the
Southeast corner of the "temporary" cul-de-sac of Weld County Road 39,
one mile south of WCR 18, adjacent to WCR 16 right-of-way (not
constructed).
PURPOSE OF STUDY:
The drainage study was prepared for this site to drain the storm water from
the entire site to a storm water detention pond along the shared access and
easement between Lots A & B of RE-4053. This pond will discharge
through a rock lined channel along the southeast side of Lot A.
This drainage study was performed in accordance with the "Weld County
Code, Weld County, Colorado.
PROJECT DESCRIPTION:
The project site encompasses Lot B of RE-4053 and contains 3.154 acres.
The soils encountered on the site from the Soil Survey of Weld County, CO
by the USDA Soil Conservation Service are classified as Valent. The Valent
soil has a hydraulic classification of"A", where low runoff volumes in its
historic state can be expected.
The project will consist of one large building, a gravel parking lot and
landscaped areas. The impervious area is 0.58 acres and the landscaped area
is 2.574 acres. The composite imperviousness for the site is 19.1%.
All runoff from the site shall be directed to the detention pond located along
the easement between Lots A & B of RE-4053, (see attached site map). The
detention pond will release storm water at the 5-year and 100-year historic
rates into the rock lined channel which will disperse the stormwater along
the southeast side of Lot A of RE-4053.

DRAINAGE BASIN:
The proposed development of the area has one basin area. There are no
offsite watersheds that would contribute runoff to this project.
HYDRAULICS:
The outlet structure will have a 4" orifice to control the 5-year storm, and the
100-year storm will flow over a weir to a rock lined channel, which will
disperse the stormwater along the southeast side of Lot A of RE-4053.
HYDROLOGY:
The contoured areas will carry the flow from Lot B to the detention basin.
The storm runoff will drain into the detention pond at the northeast side of
the site.
CONCLUSION:
This drainage plan attempts to minimize the impact of the development of
this project on the surrounding properties. There may be a slight increase in
storm flows from this site, however the drainage plan proposed herein
should effectively contain and control these flows at or below historic rates.

information and downstream conditions. Although the County has helped to
fund the UDPOND model for the design of detention and subscribes to its use,
it recognizes that many different computer models are available for this type
of design. It will be the responsibility of the engineer to document and justify
their use and the input and output parameters. These parameters and a detailed
discussion on the method used for this design will be submitted as part of the
Storm Drainage Study for county review and approval.
9-01-11-02 MAXIMUM ALLOWABLE RELEASE RATE
The maximum allowable release rates for the corresponding storm events (5 and
100-year)are as presented in Table 9.16.

When using the empirical formula or a composite CUIIP method, the predominate
soil group for the total basin area contributing runoff to the detention facility will
be used in determining the allowable release rate. However, when designing a
facility using another type of computer aided model, the engineer shall select the
soil group that best represents the surface characteristics of each sub-basin. The
selected soil group(s) will be submitted as part of the Storm Drainage Study for
county review and approval.
9-01-11-03 DETENTION BASIN OUTLET/OUTFALL
Selecting the most appropriate outlet configuration requires a detailed design that
insures the maximum release rate meets the requirements of the project and
includes proper provisions for maintenance and reliability. In addition, care shall
be taken as to insure the designed outlet will not cause downstream erosion or
damage during the largest storm event. The following lists five typical outlet
structures for use in the design of a detention facility depending on the conditions,
storage structure design and discharge rates:

Design Details
When Van Accessible Spaces are Required
When you provide parking at a newly constricted place of public accom-
modation or at a commercial facility you must provide accessible parking
spaces including van accessible parking spaces.
•
When you alter or renovate a parking lot or facility the following may
apply.
• If you repave or otherwise alter the parking lot, you must add as many
accessible parking spaces, including van spaces, as needed to comply.
• If you restripe the parking area, you must restripe so that you provide
the correct number of accessible parking spaces, including van acces-
sible parking.
• Existing physical site constraints may make it "technically infeasible"
to comply fully with the Standards. However, in most cases a"techni-
cally infeasible"condition exists only in a portion of a lot, and other
suitable locations for accessible parking spaces are often available.
