NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Weld County, Colorado, that the hereinabove described parcel of land be, and hereby is, exempt from the definition of the terms, "subdivision" and "subdivided land." BE IT FURTHER RESOLVED by the Board that the application of George Lamb for Recorded Exemption #4507 be, and hereby is, approved subject to the following conditions: 1. A Weld County septic permit is required for any proposed home. The septic system shall be installed according to the Weld County Individual Sewage Disposal System (I.S.D.S.) Regulations. 2. The West Greeley Soil Conservation District has provided information regarding the soils on the site. The applicant shall review the information and use it to positively manage soils on the site. 3. Lots A and B,and Subdivision Exemption#920 shall share an access,as no circle drives or additional accesses shall be granted. The access road shall be graded and drained to provide all-weather access. Accesses shall be placed in such a location as to have adequate sight distance in both directions, shall not be placed below the crest of a hill or where physical obstructions are present, and shall be a minimum distance of 75 feet from any intersecting county or state roadway. A 40-foot wide joint access and utility easement, for the benefit of Lots A and B, and Subdivision Exemption#920sha11 be shown clearly on the plat. The joint easement shall be dedicated for the use as shown using the language set forth in the Weld County Code, Appendix 24-F.2. C. All approved accesses shall be clearly shown on the plat. D. County Road 74 is designated on the Weld County Road Classification Plan as a Strategic Roadway, which requires 140 feet of right-of-way at full buildout. There is presently 60 feet of right-of-way available. An additional 40 feet shall be delineated on the plat as future County Road 74 right-of-way. All setbacks shall be measured from the edge of future right-of-way. The applicant shall verify the existing right-of-way and the documents creating the right-of-way. If the right-of-way cannot be verified, it shall be dedicated. This road is maintained by Weld County. E. The applicant shall address the requirements of Weld County School District RE-2, as stated in the referral response dated August 30, 2006. Evidence of such shall be submitted, in writing, to the Weld County Department of Planning Services. F. Lot B shall have a minimum 30-foot wide flagpole extension to County Road 74. G. Lot A shall comply with the one (1) acre net minimum lot size required by Section 24-8-40.L of the Weld County Code. Net acreage calculations should not include reserved road right-of-way. H. The applicant shall provide the Weld County Department of Planning Services with a Statement of Taxes from the Weld County Treasurer showing no delinquent taxes exist for the original parcel. The following notes shall be placed on the plat: 1) All proposed or existing structures will meet the minimum setback and offset requirements for the Zone District in which the property is located. Pursuant to the definition of setback in the Weld County Code,the required setback is measured from the future right-of-way line. No building or structure, as defined and limited to those occupancies listed as Groups A, B, E, F, H, I, M, and R in 2007-1722 RE4507 RE #4507 - GEORGE LAMB PAGE 3 Section 302.1 of the 2003 International Building Code, shall be constructed within a 200-foot radius of any tank battery or within a 150-foot radius of any wellhead. Any construction within a 200-foot radius of any tank battery, or 150-foot radius of any wellhead, shall require a variance from the terms of Section 23-3-10 of the Weld County Code. 2) Any future structures or uses on site must obtain the appropriate zoning and building permits. 3) Lot A is not eligible for a future land exemption, in accordance with Section 24-8-20.C.1 of the Weld County Code. 4) Prior to the release of building permits, the applicant shall submit a recorded deed describing the lot upon which the building permit is requested with the building permit applications. The legal description on such deed shall include the lot designation and Recorded Exemption number. 5) Prior to the release of building permits, the applicant shall submit evidence to the Department of Planning Services that Lot A has an adequate water supply of sufficient quality, quantity, and dependability. 6) Prior to the release of building permit, the applicant shall submit evidence of approval from the Eaton Fire Protection District to the Weld County Department of Building Inspection. 7) Should noxious weeds exist on the property, or become established as a result of the proposed development, the applicant/landowner shall be responsible for controlling the noxious weeds, pursuant to Chapter 15, Articles I and II, of the Weld County Code. 8) The approved configuration of Lot B may not constitute justification for further land splits. 9) Building permits shall be obtained prior to the construction of any building. Buildings that meet the definition of an Agricultural Exempt Building,per the requirements of Sections 29-1-20 and 29-3-20.6.13 of the Weld County Code, do not need building permits; however, a Certificate of Compliance must be filed with the Department of Planning Services, and an electrical and/or plumbing permit is required for any electrical service to the building or water for watering or washing of livestock or poultry. 10) Effective January 1, 2003, building permits issued on the proposed lots will be required to adhere to the fee structure of the County- 2007-1722 RE4507 RE #4507 - GEORGE LAMB PAGE 4 Wide Road Impact Fee Program. 11) Effective August 1,2005, building permits issued on the subject site will be required to adhere to the fee structure of the Capital Expansion Impact Fee and the Stormwater/Drainage Impact Fee Programs. 12) Potential purchasers are hereby notified that a Confined Animal Feeding Operation is located east of the intersection of County Roads 43 and 76. Off-site impacts that may be encountered include noise from trucks, tractors, and equipment, dust from animal pens, and odors from animal confinement, silage, and manure. 13) Weld County's Right To Farm Statement, as it appears in the Weld County Code, Appendix 22-E, shall be placed on the plat. 4. Any proposed subdivision adjacentto,orcontainedwithin,this Recorded Exemption may be considered to be urban scale development. Urban scale infrastructure may be required. 5. The applicant shall submit two(2)paper copies of the plat,for preliminary approval, to the Weld County Department of Planning Services. Upon approval of the paper copies, the applicant shall submit a Mylar plat, along with all other documentation required as Conditions of Approval. The Mylar plat shall be recorded in the office of the Weld County Clerk and Recorder by the Department of Planning Services. The plat shall be prepared in accordance with the requirements of Section 24-8-60 of the Weld County Code. The Mylar plat and additional requirements shall be submitted within sixty (60) days from the date of the Board of County Commissioners Resolution. The applicant shall be responsible for paying the recording fee. 6. In accordance with Weld County Code Ordinance#2005-7,approved June 1, 2005, should the plat not be recorded within the required sixty (60) days from the date of the Board of County Commissioners Resolution, a $50.00 recording continuance charge may be added for each additional three (3) month period. 7. The applicant, George Lamb, has indicated that he cannot fulfill the requirements of Condition 3.B of the RE-4507 staff recommendation. Application RE-4507 was conditionally approved by Planning Staff on October 18, 2006. The access is within the boundaries of Subdivision Exemption 920 (SE-920); a subdivision exemption for financing purposes) and would be required to be shared between Lots A and B of Recorded Exemption 4507 and SE-920. The applicant, George Lamb, is concerned that the access is tied up through financing through SE-920 and will not be able to be shared with Lots A and B of proposed RE- 4507. The applicant's concern is that in the event that SE-920 is foreclosed upon, SE-920 could become a separate legal lot and the bank who owns it would not allow the access to be shared with adjacent Lot A and Lot B. Mr. Lamb currently owns a +/- 67 acre lot known as Lot B of RE-3054. This lot is located north of and adjacent to County Road 74. Later, George Lamb did a subdivision exemption for financing purposes (SE-920) that was recorded in March of 2002. The purpose of a subdivision exemption is to encumber only a portion of the property for financing purposes. The subdivision exemption in and of itself does not create a separate legal parcel (it is still considered to be a portion of Lot B of RE-3054). SE-920 would only become a separate legal lot in the event the property is foreclosed upon. The existing access to County Road 74 is indicated within the boundaries of SE-920. Now, the property owner has applied to subdivide Lot B of RE-3054 (in order to create another buildable lot that is adjacent to County Road 74 (this has been applied for under a new recorded exemption #- RE-4507). This proposed lot is to the west of the existing access onto County Road 74. Originally the property owner had proposed to be granted a separate residential access onto County Road 74 on the west side of the proposed lot. The Department of Public Works reviewed the proposed access and determined that no new residential accesses shall be allowed onto County Road 74 and that the property owner needs to share the existing access point already in existence (the access point currently located within the boundaries of SE-920). In order to do this, the RE-4507 plat would need to indicate a minimum 30-foot wide shared access and utility easement for Lots A and B of RE-4507 and SE- 920. This would ensure that all lots would have guaranteed access to County Road 74 even in the event that SE-920 becomes a separate lot through foreclosure. The Weld County Code provides language for the designation of access and utility easements on the plat. Mr. Lamb indicated that the bank would not sign off on the proposed shared access for the SE- 920 parcel. In that event, the Department of Public Works had requested a letter from the bank explaining why a shared access easement would not be allowed be provided to them by Mr. Lamb. Upon receipt of the letter, the Weld County Attorney would review it to determine if the bank's letter had merit and if so Public Works would grant an additional access. Short of this, the owner would have to appeal to the Weld County Commissioners and receive their approval to allow a separate access onto County Road 74. The applicant has tentatively scheduled a meeting before the Board of County Commissioner for Monday, June 19th at 9:00 AM. If possible, our Department would request a response from Washington Mutual in regards to this issue (is utilizing the existing access acceptable?) prior to this meeting so that Planning staff can present your position on this issue. I have attached the proposed subdivision map along with the existing recorded exemption and subdivision exemption map to clarify what I have indicated previously in this letter. He indicated that the issues with the mortgage company had been resolved in regards to the access. He just wanted clarification that the access would not preclude future oil and gas drilling operations on the property(Lot A). I indicated that the direction of the County Attorney was to show a joint access and utility easement for Lot A, Lot B and the SE lot(which would cover the existing access point—no new access). This would allow access to all three lots (including oil and gas). The Attorney (Mr. Hoffman)was acceptable with this recommendation and was going to inform Mr. Lamb. I have made changes to Gary Hammer's draft RE-4507 plat and will have him pick it up and add this information. We had continued the Board meeting on the access issue from June 4th until June 18th to give Mr. Lamb more time to resolve this issue. I request a letter from the bank explaining that request. I have checked our database to see if the applicant has applied for a subdivision exemption exempting the home and the access. I am not finding that case. Once I have received a letter from the bank with that request and the County Attorney has evaluated that document, one of two things will occur. Parcel 070933000056 1 . Water Service is presently being provided to the above mentioned property through meter #3162, located at 20309 WCR 74, Proposed Lot B. 2. North Weld County Water District is able and intends to provide water service to the above-mentioned property, provided all requirements of the District are satisfied. If contracts have not been completed with North Weld County Water District within one year from the date of this letter, the District may refuse to supply water to the above-mentioned property. The District reserves this right to refuse service, in the event that raw water is unavailable, and /or pipeline or Filter Plant capacity is not capable to provide additional service. Before a water tap may be purchased, the applicant must provide a copy of a Warranty Deed, a Physical Address, and this letter. 3 . The District requests that for any County Process, including but not limited to a Recorded Exemption (RE), Subdivision Exemption (SE), Use by Special Review (USR), Planned Unit Development (PUD), Minor Subdivision or Off-Site Construction Plans within Weld or Larimer County that the respective County place North Weld County Water District on the referral list. Furthermore, the District requests that the applicant submit the plat to North Weld County Water District for review prior to submitting the plat to the County for filing. The District may need additional waterline easement(s) or waterline improvements to provide service to the parcels being created or modified. If the plat is recorded without District approval, additional easements may have to be recorded and/or additional waterline improvements will need to be constructed in order to maintain or establish new water service(s). 4. The District recommends that anticipated raw water be purchased through the District. The District guarantees treatment and delivery of raw water purchased. All water that is delivered over the allocation (with surcharge) is subject to water availability. Water purchased through the District shall be 70% delivery of an Acre-Foot of water, if the allotment for Colorado-Big Thompson (CBT) project water, which is determined by the Northern Colorado Water Conservancy District, is 50% or greater. North Weld County Water District will restrict the delivery as necessary when the CBT allotment is less than 50%. A portion of the Raw Water Fee is utilized by the District to construct storage reservoirs. 5. Tap Options and Requirements A. The District offers a Full Standard Tap option for those landowners with lot sizes greater than 0.33 Acres (14,500 sq ft). This option allows the tap to utilize 228,000 gallons of water and plant investment capacity during a water year for delivery without surcharge. B. For landowners with lot sizes greater than 0.20 acres (8,800 sq ft) but less than 0.33 Acres (14,500 sq ft) OR those landowners with verifiable irrigation rights or well permits for outside water use, the District offers a 75% Tap option. This tap provides the landowner with 171,000 gallons of Water and Plant Investment capacity during a water year for delivery without surcharge. The fees are 75% of the Full Standard Tap Fees. C. The District offers a third option for those landowners with lots less than .2 acres (8,800 sq ft) or with a Board Approved Irrigation System or Board Approved Commercial Enterprise. This tap allows the landowner to utilize 50% of the Full Standard Tap or 114,000 gallons per water year for delivery without surcharge. The fees for this option are 50% of the Full Standard Tap Fees. As indicated in our previous memo, WCR 74 is classified as a strategic roadway (arterial) limiting new residential accesses and utilizing existing reasonable access to the parcels. Subdivision Exemption SE-920 was recorded 3/26/2002, Recording No. 2936549, is identifying the legal description for the SE parcel of land containing 3.089 acrest including the access. By granting the RE-4507, Lot A will be land-locked to the Lot B parcel. The only access would be through the SE lot. In consulting with staff and our resident land survey/right-of-way agent, Leon Sievers L.S we determined that a common easement for Lot A, Lot B, and the SE lot share a common access easement. This easement should be identified on the proposed RE-4507 document for the benefit of Lots A and B.
