The Weld County Department of Planning Services has determined through an administrative review that
the standards of Section 24-8-40 of the Weld County Code have been met. This Recorded Exemption is
approved with the following conditions in accordance with information submitted in the application and the
policies of Weld County.
1. All septic systems must be located on their respective lots and meet all lot line set back
requirements.

2. The West Greeley Soil Conservation District has provided information regarding the soils on the
site. The applicant shall review the information and use it to positively manage on site soils.
3. Prior to recording the plat:
® The plat shall be titled: Amended Recorded Exemption No. 1055-08-3 AmRE-331.
0 The Weld County Department of Public Health and Environment was unable to determine
which septic permit should be associated with which house located on Lot B of RE-331.
The applicant is requested to provide the Weld County Department of Public Health and
Environment with further clarification on the issue. The applicant shall provide written
evidence to the Department of Planning Services that each house has an engineered septic
system which has been approved by the Weld County Department of Public Health and
Environment.
XLot B of AmRE-331 and SE-1116 lot shall share an access, no circle drives or additional
accesses shall be granted. The access road shall be graded and drained to provide all
weather access. Accesses shall be placed in such a location as to have adequate sight
distance in both directions, shall not be placed below the crest of a hill or where physical
obstructions are present and shall be a minimum distance of 75 feet from any intersecting
County or State roadway. A 30 foot wide joint access and utility easement, for the benefit of
Lots B of AmRE-331 and SE-1116, shall be shown clearly on the plat. The joint easement
shall be dedicated for the use as shown using the language set forth in the Weld County
Code, Appendix 24-F.E.
All approved accesses shall be clearly shown on the plat.

County.

i The applicant shall submit a Recorded Exemption Application, and subsequently be
approved to split one of the existing improvements from Lot B of AmRE-331 to be recorded
with SE-1116 and before AmRE-331
or
submit a Non-Conforming Use application and subsequently be approved to document the
two existing homes located on Lot B of AmRE-331.
The applicant shall delineate all existing oil and gas facilities and their associated setbacks
per Weld County Code Section 23-3-50.E.
'5 The applicant shall provide the Weld County Department of Planning Services with a
Statement of Taxes from the Weld County Treasurer showing no delinquent taxes exist for
the original parcel.
7 The following notes shall be placed on the plat:
1) All proposed or existing structures will or do meet the minimum setback and offset
requirements for the zone district in which the property is located. Pursuant to the
definition of setback in the Weld County Code, the required setback is measured
from the future right-of-way line.
* No building or structure as defined and limited to those occupancies listed as Groups
A, B, E, F,H, I, M and R in Section 302.1 of the 2003 International Building Code,
shall be constructed within a 200-foot radius of any tank battery or within a 150-foot
radius of any wellhead. Any construction within a 200-foot radius of any tank battery
or 150-foot radius of any wellhead shall require a variance from the terms of the
Section 23-3-10 of the Weld County Code.
2) Any future structures or uses on site must obtain the appropriate zoning and building
perm its.
3) Prior to the release of building permit, the applicant shall submit evidence of approval
from the LaSalle Fire Protection District to the Weld County Building Department.
4) Should noxious weeds exist on the property or become established as a result of the
proposed development the applicant/landowner shall be responsible for controlling
the noxious weeds, pursuant to Chapter 15, Articles I and II of the Weld County
Code.
5) Building permits shall be obtained prior to the construction of any building. Buildings
that meet the definition of an Ag Exempt Building per the requirements of Section 29-
1-20 and Section 29-3-20.8.13 of the Weld County Code do not need building
permits, however, a Certificate of Compliance must be filed with the Planning
Department and an electrical and/or plumbing permit is required for any electrical
service to the building or water for watering or washing of livestock or poultry.
6) Effective January 1, 2003, Building Permits issued on the proposed lots will be
required to adhere to the fee structure of the County Road Impact Program.

7) Effective August 1, 2005, Building permits issued on the subject site will be required
to adhere to the fee structure of the Capital Expansion Impact Fee and the
Stormwater/Drainage Impact Fee. (Ordinance 2005-8 Section 5-8-40)
8) The property owner acknowledges that mineral owners and lessees have real
property interests that entitle them to surface use in accordance with Colorado State
Statutes and applicable Colorado Oil and Gas Conservation Commission regulations.

9) WELD COUNTY'S RIGHT TO FARM: Weld County is one of the most productive
agricultural counties in the United States, ranking fifth in total market value of
agricultural products sold. The rural areas of Weld County may be open and
spacious, but they are intensively used for agriculture. Persons moving into a rural
area must recognize and accept there are drawbacks, including conflicts with
longstanding agricultural practices and a lower level of services than in town. Along
with the drawbacks come the incentives which attract urban dwellers to relocate to
rural area: open views, spaciousness, wildlife, lack of city noise and congestion, and
the rural atmosphere and way of life. Without neighboring farms, those features
which attract urban dwellers to rural Weld County would quickly be gone forever.
Agricultural users of the land should not be expected to change their long-established
agricultural practices to accommodate the intrusions of urban users into a rural area.
Well run agricultural activities will generate off-site impacts, including noise from
tractors and equipment; slow-moving farm vehicles on rural roads; dust from animal
pens, field work, harvest, and gravel roads; odor from animal confinement, silage,
and manure; smoke from ditch burning; flies and mosquitoes; and the use of
pesticides and fertilizers in the fields, including the use of aerial spraying. Ditches
and reservoirs cannot simply be moved out of the way of residential development
without threatening the efficient delivery of irrigation to fields which is essential to
farm production.
Section 35-3.5-102, C. R. S., provides that an agricultural operation shall not be
found to be a public or private nuisance if the agricultural operation alleged to be a
nuisance employs methods or practices that are commonly or reasonably associated
with agricultural production.
Weld County covers a land area of over 4,000 square miles in size (twice the State of
Delaware) with more than 3,700 miles of state and County roads outside of
municipalities. The sheer magnitude of the area to be served stretches available
resources. Law enforcement is based on responses to complaints more than on
patrols of the county and the distances which must be traveled may delay all
emergency responses, including law enforcement, ambulance, and fire. Fire
protection is usually provided by volunteers who must leave their jobs and families to
respond to emergencies. County gravel roads, no matter how often they are bladed,
will not provide the same kind of surface expected from a paved road. Snow removal
priorities mean that roads from subdivisions to arterials may not be cleared for
several days after a major snowstorm. Snow removal for roads within subdivisions
are of the lowest priority for public works or may be the private responsibility of the
homeowners. Services in rural areas, in many cases, will not be equivalent to
municipal services. Rural dwellers must, by necessity, be more self-sufficient than
urban dwellers.
Children are exposed to different hazards in the county than in an urban or suburban
setting. Farm equipment and oil field equipment, ponds and irrigation ditches,
electrical power for pumps and center pivot operations, high speed traffic, sand burs,
puncture vines, territorial farm dogs, and livestock present real threats to children.
Controlling children's activities is important, not only for their safety, but also for the
protection of the farmer's livelihood. Parents are responsible for their children.
4. The applicant shall submit two (2) paper copies of the plat for preliminary approval to the Weld
County Department of Planning Services. Upon approval of the paper copies the applicant shall
submit a Mylar plat along with all other documentation required as conditions of approval. The
Mylar plat shall be recorded in the office of the Weld County Clerk and Recorder by Department of
Planning Services' Staff. The plat shall be prepared in accordance with the requirements of
Section 24-8-60 of the Weld County Code. The Mylar plat and additional requirements shall be
submitted within sixty(60) days from the date the Administrative Review was signed. The applicant
shall be responsible for paying the recording fee.

5. In accordance with Weld County Code Ordinance 2005-7 approved June 1, 2005, should the plat
not be recorded within the required sixty (60) days from the date the Administrative Review was
signed a $50.00 recording continuance charge may be added for each additional 3 month period.
6. The Department of Planning Services respectfully requests the surveyor provide a digital copy of
this Recorded Exemption. Acceptable CAD formats are .dwg, .dxf, and .dgn (Microstation);
acceptable GIS formats are ArcView shapefiles, Arclnfo Coverages and Arclnfo Export files format
type is .e00. The preferred format for Images is .tif (Group 4). (Group 6 is not acceptable). This
digital file may be sent to mapsco.weld.co.us.
7. The Weld County Department of Planning Staff's approval of this Recorded Exemption Application
is based on satisfying the Conditions of Approval. Should an applicant be unwilling or unable to
meet any one of these conditions within 60 days of approval, then this case will be forwarded to
the Weld County Board of County Commissioners with a staff recommendation for denial.

Iris I. Hughes owns the property which has a legal description of that certain tract of land
lying in the South 1/2 of the Southwest 1/4, Section 8, Township 4 North, Range 65 West of the
6th Principal Meridian, more particularly described as follows: commencing at the Southwest
Corner of said Section 8, thence North on the West Section Line thereof, a distance of 85' more
or less to a point due West of a steel pipe located on the North line of the drainage canal, thence
East 30' more or less to said steel pipe which constitutes the true point of beginning, thence
North parallel to and 30' distant from the West line of said section along the East line of the
county road a distance of 208' more or less to a steel pipe placed on the East line of said county

1. Water supply statement
a. Domestic use. Water is provided by a well. No permit found. Owner will provide a
permit prior to RE is recorded.
b. Irrigation water. One (1) share of Platte Valley Irrigation Company will remain with
the site.
2. A cope of the existing Septic Permit and appropriate copies (#SP-0500405) are included with
this application.
3. The 80± acres property is presently and will remain, being used for both residential and
agricultural purposes. The whole property, as it is now, has four (4) existing point of
accesses, two (2) located along the east of and adjacent to Weld County Road 39 and two (2)
located along the north of and adjacent to Weld County Road 46. The property currently has
two (2) farmhouse, two (2) animal barns (one for cows and one for horses), one (1) chicken
coop, one (1) machine shed and three (3) small cow shelters. There is one (1) pivot sprinkler
approximately located near the middle of the north property line. The easterly half is corn
field. The westerly half is pasture and alfalfa fields with approximately 27 head of cattle.
The site has two (2) Oil/Gas well production facility, the oil and gas well heads are located
near the Platte Valley Irrigation Ditch along the west side.
4. No new lot will be created with this RE. The purpose of this RE is to reflect the correct lot
lines, which will be corrected with a Subdivision Exemption.
5. The Platte Valley Irrigation Ditch runs across the west half and along the southwest property
line.
6. No building envelopes are requested.
7. There is no business or Use By Special Review permit on the property.
Conclusion:
This application is intended solely for the purpose of adjusting the lot lines located in the
southwest corner of the property, in conjunction with a Subdivision Exemption.

The Weld County Public Works Department has reviewed this proposal. Our comments and requirements are
as follows:
COMMENTS:
Weld County Road Classification Plan (FHU): (June 2002)
WCR 46 is a local gravel road and require a 60-foot right-of-way at full build out. There is presently a 60-foot
right-of-way. The road is maintained by Weld County. Pursuant to the definition of SETBACK in the Weld
County Zoning Ordinance (Ordinance 89, as amended), the required setback is measured from the future right-
of-way line.
WCR 39 is a collector road and requires and 80-foot right-of-way at full build out. There is presently a 60 —foot
right-of-way. This road is maintained by Weld County. Pursuant to the definition of setback in the Weld
County Zoning (23-1-90), the required setback is measured from the future right-of-way line.
REQUIREMENTS:
The Weld County Public Works Department recommends approval of this application.
The applicant shall indicate specifically on the plat the type of right-of-way/easement that exists.
Road Access Policy: (Policy Established Sec. 8-2-10)
The applicant shall utilize the existing accesses to this parcel. (Lot B)
Utilize the existing agricultural, oil and gas, and ditch roads that are necessary for the agricultural operation.
Pursuant to Chapter 15, Articles I and II of the Weld County Code, if noxious weeds exist on the property or
become established as a result of the proposed development, the applicant/landowner shall be responsible for
controlling the noxious weeds.
This area is not in FEMA Flood Zones.

Environmental Health Services has reviewed this proposal and reviewed files relating to the septic
systems; the following conditions are recommended to be part of any approval:
1. All septic systems located on the property shall have appropriate permits from the Weld
County Department of Public Health & Environment. Any existing septic system(s) which is
not currently permitted through the Weld County Department of Public Health & Environment
will require an I.S.D.S. Evaluation prior to the issuance of the required septic permit(s). In the
event the system(s) is found to be inadequate, the system(s) must be brought into compliance
with current I.S.D.S. regulations.
There are two homes on the property; one at the corner of CR 46 and CR 39 and the second one
approximately 1/2 mile north of the above intersection. Both houses appear to share the same
address (22240 CR 39) according to the assessor records. The Department has found a Statement
of Existing (SE-0500104) and septic permit SP-0500405 for repair of the same septic system,
address listed as 22240 CR 39. The Department is unable to determine which house these repairs
were made at from the available records.
The Department has also found two historic septic permits, one or both that may be associated with
the property under review.

The Environmental Health Division of the Weld County Department of Public Health & Environment
was unable to determine which of these septic permits, if any, should be associated with which house

permits, that system will require an I.S.D.S. Evaluation as described above.
2. All septic systems must be located on their respective lots and meet all lot line set back
requirements.

1. Building permits shall be obtained prior to the construction of any building. Buildings that meet the
definition of an Ag Exempt Building per the requirements the Weld County Code do not need building
permits, however a Certificate of Compliance must be filed with the Planning Department and an
electrical and/or plumbing permit is required for any electrical or water for watering or washing of
livestock or poultry.
2. A plan review is required for each building except for buildings that meet the definition of Ag Exempt
buildings. Plans require the wet stamp of a Colorado registered architect or engineer.
3. Buildings shall conform to the requirements of the codes adopted by Weld County at the time of permit
application. Current adopted codes include the 2006 International Residential Code; 2006 International
Building Code; 2006 International Mechanical Code; 2006 International Plumbing Code; 2006
International Fuel Gas Code; 2005 National Electrical Code and Chapter 29 of the Weld County Code.
4. Each building will require an engineered foundation based on a site-specific geotechnical report or an
open hole inspection performed by a Colorado registered engineer. Engineered foundations shall be
designed by a Colorado registered engineer.
5. Fire resistance of walls and openings, construction requirements, maximum building height and
allowable areas will be reviewed at the plan review. Setback and offset distances shall be determined by
the Zoning Ordinance.
6. Building height shall be measured in accordance with the 2006 International Building Code for the
purpose of determining the maximum building size and height for various uses and types of construction
and to determine compliance with the Bulk Requirements from Chapter 23 of the Weld County Code.
Building height shall be measured in accordance with Chapter 23 of the Weld County Code in order to
determine compliance with offset and setback requirements. Offset and setback requirements are
measured to the farthest projection from the building.
7. Provide letter of approval from LaSalle View Fire Protection District prior to construction of any
structure.

Attached please find a .pdf file containing three pages.
Page #1 is a Release of Inheritance Lien that contains the description for the approximate
1 acre parcel that is owned by Iris Hughes.
Page #2 is a copy of a 1950 Soil Conservation Service aerial showing this area. Please
note that there are several buildings located in the same position as they are currently
located.
Page #3 is the 2005 aerial from the GIS Department which shows the existing buildings as
well as the position of the approximate 1 acre parcel owned by Iris Hughes.
I do not believe that there is an error in the position of the approximate 1 acre parcel
relative to the position of the existing buildings (second dwelling) within the South Half
of the Southwest Quarter (S1/2 SW1/4) of this Section 8.
I don't know if I can answer your question about why the approximate 1 acre parcel that is
owned by Iris Hughes contains some of the buildings (second dwelling) . My initial guess
would be that whomever wrote that description didn't understand the relationship of the
buildings relative to the position of the approximate 1 acre parcel as written.
I am unaware of anything that would indicate that the intent of the parties at the time of
the creation of the property description for the approximate 1 acre of land was to include
the existing buildings in this area. It can be clearly seen in the 1950 aerial that the
buildings were sufficiently positioned so that someone preparing a description for a
parcel of land with the intent of including all of these buildings would/should have
created a parcel of land very different in size, dimensions, and position from the current
description of the approximate 1 acre parcel.

Environmental Health Services has reviewed this proposal and reviewed files relating to the septic
systems; the following conditions are recommended to be part of any approval:
1. All septic systems located on the property shall have appropriate permits from the Weld
County Department of Public Health & Environment. Any existing septic system(s)which is
not currently permitted through the Weld County Department of Public Health & Environment
will require an I.S.D.S. Evaluation prior to the issuance of the required septic permit(s). In the
event the system(s) is found to be inadequate, the system(s) must be brought into compliance
with current I.S.D.S. regulations.
There are two homes on the property; one at the corner of CR 46 and CR 39 and the second one
approximately 1/2 mile north of the above intersection. Both houses appear to share the same
address (22240 CR 39) according to the assessor records. The Department has found a Statement
of Existing (SE-0500104) and septic permit SP-0500405 for repair of the same septic system,
address listed as 22240 CR 39. The Department is unable to determine which house these repairs
were made at from the available records.
The Department has also found two historic septic permits, one or both that may be associated with
the property under review.

The Environmental Health Division of the Weld County Department of Public Health & Environment
was unable to determine which of these septic permits, if any, should be associated with which house
on the property. The applicant is requested to provide this Department further clarification on this
issue. Should it be found that one of the houses cannot be related to one of the above listed septic
permits, that system will require an I.S.D.S. Evaluation as described above.
2. All septic systems must be located on their respective lots and meet all lot line set back
requirements.
