RESOLUTION RE: AUTHORIZATION FOR THE WELD COUNTY ATTORNEY TO PROCEED WITH LEGAL ACTION AGAINST LOWELL PAUL DAIRY, INC. FOR VIOLATION OF THE WELD COUNTY CODE WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to Colorado statute and the Weld County Home Rule Charter, is vested with the authority of administering the affairs of Weld County, Colorado, and WHEREAS, Lowell Paul Dairy, Inc., VI #0600345, is allegedly in violation of the Weld County Code, and WHEREAS, despite efforts by the Planning staff to resolve said matter, the violation has not been corrected, and WHEREAS, on the 13th day of February, 2007, a public hearing was held before the Board of County Commissioners for the purpose of hearing testimony relating to said violation, and WHEREAS, Lowell Paul Dairy, Inc. was not present or represented at said hearing, although all parties were notified of said hearing by Department of Planning Services staff, and WHEREAS,the Board of County Commissioners deems it advisable to refer said violation to the Weld County Attorney's Office for legal action, with an instruction for delay of action upon such referral until April 13, 2007, to allow adequate time for the property owner to restore, remove or screen the noncommercial junkyard from all adjacent properties and public rights-of-way to bring the subject property into compliance and for an inspection of the property by the Department of Planning Services staff. There are two aspects of this violation: One is the presence of a large pile of tires, crates, wood and misc. debris located on the West side of the property. The other are complaints about the number of cows possibly exceeding what is allowed by Right in an Agriculturally zoned district. I spoke with a gentleman (I apologize I forgot his name, Allen I think?) that is representing David Paul and he is claiming that the use should be grandfathered in as they have been in operation since the early 70's. I had him speak with planner Brad Mueller and Brad and I explained that we would need a few things before we could process this as a Nonconforming Use (NCU). Brad has asked that he submitted some type of evidence that shows how long they have been in operation and then a current count of the number of head on the property. This number will be used to put a cap on the numbers that are allowed as a Use by Right through the NCU in the future. I have asked that this evidence and an NCU application be submitted to the Department of Planning Services within a 30 day time period. I have also attached the zoning violation letter that has been sent to Mr. Paul. I hope this clears up a few things for you and please feel free to contact me if you have any additional questions or concerns regarding this violation.
