HomeMy WebLinkAbout841053.tiff RESOLUTION RE: APPROVAL OF RECORDED EXEMPTION NO. 721 - ROSS SHANDY AND RAYMOND CLARK WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to Colorado statute and the Weld County Home Rule Charter, is vested with the authority of administering the affairs of Weld County, Colorado, and WHEREAS , the Board of County Commissioners , pursuant to its authority under Section 30-28-101 (10) (d) , CRS , as amended, did determine at a public meeting held in the Chambers of the Board, that a certain parcel of land, to be divided into two parcels , as shown on the plat known as Recorded Exemption No. 721 , does not come within the purview of the definition of the terms , "subdivision" and "subdivided land" , and WHEREAS , the request for Recorded Exemption No. 721 was submitted by Ross Shandy and Raymond Clark for property which is located in Part of the NE4, Section 17 , Township 1 North, Range 65 West of the 6th P.M. , Weld County, Colorado, being more particularly described in the plat which shall be provided by the applicant and known as Exhibit "A" , said plat to be recorded, and WHEREAS , this request is to divide the property into parcels estimated to be approximately 39 acres and 15 acres. NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Weld County, Colorado, that the hereinabove described parcel of land be, and hereby is, exempt from the definitions of "subdivision" and "subdivided land" . BE IT FURTHER RESOLVED by the Board that this approval is conditional upon the applicant submitting a mylar plat to the Department of Planning Services to be recorded in the office of the Weld County Clerk and Recorder. The plat shall be drawn in accordance with the requirements of Section 9-2C. (4) of the Weld County Subdivision Regulations . The parcel of land on which this request is being made is described as part of the NE1, Section 17, TIN, R65W of the 6th P.M. , Weld County, Colorado. The property is located two (2) miles southwest of Hudson on Weld County Road 10. The property contains approximately 54 acres of Class IIe (prime) , IIIe, IVe, and VIIe irrigated and IIIc, IVe, VI, and VIe nonirrigated soils. The parcel of land under consideration is the total contiguous land holdings of the applicant. The request is to divide the property into parcels of 39 acres and 15 acres, more or less. The property was split illegally with Mr. Clark purchasing the 15 acre parcel in 1978 and Mr. Shandy ppIchasing the 39 acre parcel in 1982. Both parcels will be used for pasture and single family residences. Based upon the submitted information and policies of the County, the Department of Planning Services staff recommends the request be approved for the following reasons: 1. The request complies with Section 9-2C. of the Weld County Subdivision Regulations submission requirements; and 2. The request complies with Section 9-2E. of the Subdivision Regulations as follows: 8x/4053 Board of County Commissioners November 21, 1984 Page 2 - The 54 acres, more or less, under consideration will be compatible with the existing surrounding land-uses and with future development of the surrounding area as prermitted by the existing agricultural zoning. The proposal is also consistent with the intent of the Agricultural Zone District in which it is located. - The proposal was reviewed by the town of Hudson and was found to comply with their long-range Comprehensive Plan. - The proposal is in compliance with Section 1-3 of the Weld County Subdivision Regulations and the proposed land division complies with the Weld County Comprehensive Plan. Therefore, the proposed use is consistent with efficient and orderly development. - The proposal does not exist in an overlay district area. - The proposed lots meet minimum lot size requirements for land division. - The proposed lots are not part of a recorded exemption within the last five (5) years. - The two lots proposed will have adequate access from Weld County Road 10 and Weld County Road 41. 4• The Department of Planning Services staff recommendation for approval is conditional upon the following: 1. The applicant shall submit a mylar plat to the Department of Planning Services to be recorded in the office of the Weld County Clerk and Recorder. The plat shall be drawn in accordance with the requirements of Section 9-2C. (4) of the Weld County Subdivision Regulations. Which was owned by John Burack Jr. and Joann Burack, then in 1982 was sold, Part A- to Ross M. Shandy who now lives on parcel/J . Parcel/ belonging to Greg and Becky Abbott. As noted on sketch, these are small parcels around these properties , after the Board, may exempt parcels ., I would like to proceed with a well , sewer and a building permit for a modular home diagramed in packet. The reason for establishing the 15 acres into one lot , is because it was seperated illegally, then sold to Raymond E. Clark on October 12, 1978. We would like to have it established into the parcel that we purchased on that date. The 15 adzes will be used as pasture and housing. The acreage in question is surrounded by 5 small acreage with homes on them. It is 1 mile from the subdivision known as Vantage Acres. We propose to drill a domestic deep well , from 750 ft. to 1000ft. Household use and lawn and garden irrigations plus livestock. Septic Tank, 1 ,250 gallon - final disposal by 1 , 200 ft. Leach Field will be the disposal system used.
