RE: APPROVAL OF SERVICE PLAN FOR THE BRIGHTON AREA FIRE PROTECTION
DISTRICT AND THE CITY OF BRIGHTON.
WHEREAS, the Board of County Commissioners of Weld County,
Colorado, pursuant to Colorado statute and the Weld County Home
Rule Charter, is vested with the authority of administering the
affairs of Weld County, Colorado, and
WHEREAS , the Board of County Commissioners of Weld County,
Colorado held a public hearing at the hour of 2 : 00 o 'clock p.m.
for the purpose of considering the proposed service plan for the
Brighton Area Fire Protection District and the City of Brighton,
and
WHEREAS, the Board of County Commissioners heard the testi-
mony and statements of those present, heard the recommendations of
the Weld County Planning Commission, and being fully informed,
finds that said service plan meets the criteria set forth in
Section 32-1-205 , CRS 1973 , as amended, and that said service
plan should be approved.
NOW, THEREFORE, BE IT RESOLVED by the Board of County Commis-
sioners of Weld County, Colorado that the service plan of the
Brighton Area Fire Protection District and the City of Brighton
be, and hereby is, approved.
The above and foregoing Resolution was, on motion duly made
and seconded, adopted by the following vote on the 3rd day of
September, A.D. , 1980.

The following business was transacted:
I hereby certify that pursuant to a notice dated August 11, 1980 and
duly published August 14 , August 21 and August 28, 1980 in the Johnstown
Breeze a public hearing was held on the request of The Brighton Area
Fire Protection District for consideration of a service plan.
Mr. Honn read the Planning Commission' s favorable recommendation.
Everett Brown, legal counsel for the Brighton Fire Protection District
was present and elaborated on their request. The request is to
expand the present district to include the City of Brighton. At the
present time the City of Brighton provides all the equipment and controls
the volunteers for the fire protection district. - Both the City of Brighton
and the Board of Directors of the district feel it would be much more
. serviceable, efficient and econmical if the City was included in the
present district. The City Manager of Brighton and the Chairman of the
Board of Directors for the fire district were both present.
Mr. Honn stated that there is only about a two block area of the City of
Brighton in Weld County that will be ,effected by this addition to the:
present fire protection district.
Commissioner Roe made a motion to approve the service plan for the
Brighton Area Fire Protection District. Commissioner Carlson seconded
the motion and it carried unanimously.

NOTICE is hereby given of a hearing before the Board
of County Commissioners of Weld County, Colorado, on
the 3rd day of September, 1980 at the hour of 2 : 00 P .M.
in the Weld County Commissioners ' hearing room, first
floor, Weld County Centennial Denter , 915 10th Street,
Greeley, Colorado, for the purpose of considering the
service plan of the proposed Brighton Area Fire Pro-
tection District. This notice is given pursuant to
the Special District Control Act, Section 32-1-201
et sea. , CRS 1973 .
Copies of the Service Plan are on file at the Office
of the Clerk to the Board of County Commissioners
located on the 3rd floor , Weld County Centennial
Center, 915 10th Street, Greeley, Colorado and may
be inspected during regular business hours .
Within 20 days after the completion of the hearing,
the Board of County Commissioners will consider the
approval of the Service Plan.
All interested parties under the law will be afforded
an opportunity to be heard at said hearing.

Pursuant to the provisions of Part 2 of Article 1, Title 32 , C. R. S. 1973 ,
as amended, NOTICE IS HEREBY GIVEN, that the Board of County Commissioners
of the County of Adams , State of Colorado, will conduct a public hearing

PROTECTION DISTRICT
The Brighton Area Fire Protection District presently
existing and the City of Brighton, Brighton, Colorado, hereby
petition and apply to the County Commissioners for a Resolution
approving the service plan of the proposed District in
accordance with the "Special District Control Act" , C.R. S .
32-1-201 and as grounds therefor states as follows :
1. The Brighton Area Fire Protection District includes
territory in Adams and Weld Counties . The District was formed
in 1961 and since the date of formation has been, and now is,
an active Fire Protection District under the Statutes of the
State of Colorado.
2. The District has never included the City of Brighton,
Colorado.
3. The City of Brighton and the District, for sometime,
have been investigating the feasibility of forming a Fire
Protection District to include the City of Brighton and a
committee from the City of Brighton and the District have met
from time to time on a regular basis to study the formation of
such a District over the past 2 years and more.
4 . The City and the District recommend that a Fire
Protection District be formed to include the City of Brighton
and that this issue be submitted to the qualified electors of
the City and the District to determine the issue .
WHEREFORE, the Petitioners request a Resolution from the

Board of County Commissioners of the County of Adams and the
County of Weld approving the service plan of the proposed
District.

SERVICE PLAN
In accordance with the Special District Control Act
contained in C.R.S. 32-1-201-209 the following service plan
is submitted:
1. Financial survey and a preliminary engineering or
architectural survey showing how the proposed services are
to be provided and financed.
Since the proposal is essentially the inclusion of
additional territory within the District or a consolidation
between the District and the City of Brighton, it is submitted
that this particular statutory requirement is inapplicable.
The District will continue to function as it has in the past.
The City of Brighton is presently the owner of the fire
equipment accessories and two fire stations. This property
would be turned over to the District. At present the City of
Brighton provides fire service to the District under an inter-
governmental contract whereby the cost of fire service is paid
one-half by the District and one-half by the City from mill
levies assessed by each.
2 . A map showing the proposed District boundaries is
attached. The District boundaries will not change except for
the inclusion of the City of Brighton within the District.
3. Estimate of the population of the District after
inclusion: 15 , 000 (presently 3, 000)
4 . Valuation for assessment of the proposed District:
(a) City of Brighton (1979) $28 , 887, 600. 00
(b) Present District valuation (1979) $47 , 215, 090. 00
5. Facilities to be constructed, standards of construction,
estimates and costs and other major expenses related to the
formation and operation of the District.
The District would not contemplate constructing additional

facilities until same are required either within the City or
outside the City limits and construction outside would depend
upon the development of real estate within the District.
There is no major expense contemplated related to the forma-
tion of the District. The major expenses involved in the
operation of the District would be no different from the
expenses now paid by the City of Brighton and the District for
fire service.
The present District has no bonded indebtedness and none
is contemplated at this time upon formation of the new District.

RE : Brighton Area Fire Protection District
Gentlemen :
For sometime the City of Brighton and the Fire District
have been discussing the feasibility of including the City
within the District. The mechanics of accomplishing this
will be :
(a) The City will have an election to vote on the
issue of inclusion, and
(b) At the same time, the District will have an
election on the issue of dissolution of the District.
Assuming both votes are favorable, then a new District
would be formed and accordingly, please find enclosed a
Petition Under the Special District Control Act together
with a brief Service Plan.
It seems apparent that the Special District Control Act
did not contemplate a consolidation or merger type action as
we propose, but nevertheless it appears to apply in this case.
Since relatively little staff time will be taken on
this application, we request that the processing fee be at
a minimum and request that it be limited to cover the actual
costs of publication, etc.
Kindly schedule this Petition for public hearing and we
will appear with representatives from the City and the
District to discuss this proposal.
