RE: APPROVAL OF DELETION OF CONDITION #1 FROM RE #578 - THEODORE
AND WILMA WACKER
WHEREAS, the Board of County Commissioners of Weld County,
Colorado, pursuant to Colorado statute and the Weld County Home
Rule Charter, is vested with the authority of administering the
affairs of Weld County, Colorado, and
WHEREAS, on the 17th day of November, 1982, the Board of
County Commissioners of Weld County, Colorado approved RE #578 ,
with conditions, for Theodore and Wilma Wacker, and
WHEREAS, condition #1 stated that a 75 foot right-of-way
from the centerline of State Highway 392 be designated and shown
on the final plat before recording, and
WHEREAS, the Colorado Division of Highways has submitted
new evidence showing that they have found that the present
right-of-way at the location of the recorded exemption is suf-
ficient to accommodate future widening of the highway, and
WHEREAS, the Department of Planning Services recommends
that condition #1 now be deleted from RE #578 , and
WHEREAS, the Board of County Commissioners deems it advis-
able to delete said condition from RE #578 .
NOW, THEREFORE, BE IT RESOLVED by the Board of County Com-
missioners of Weld County, Colorado that condition #1 in RE #578
for Theodore and Wilma Wacker be, and hereby shall be, deleted.
The above and foregoing Resolution was, on motion duly made
and seconded, adopted by the following vote on the 6th day of
December, A.D. , 1982.

Re: Deletion of Condition Oil from Recorded Exemption #578 that was
approved on November 17, 1982, for Theodore and Wilma Wacker.
Dear Commissioners:
The Colorado Division of Highways has submitted new evidence to the
Department of Planning Services staff regarding the recommendation
for a dedicated reservation along State Highway 392.
The original request was to allow for a one-hundred-fifty (150) foot
right-of-way, seventy-five (75) feet each side of the centerline of
Highway 392, because of the projected traffic. The Division of High-
ways has reevaluated the existing right-of-way at the location of the
recorded exemption and found the present right-of-way to be sufficient
to accomodate future widening of the highway.
The Department of Planning Services staff recommends that Condition #1
of Recorded Exemption #578 be deleted because of this new information
submitted by the Colorado Division of Highways.

Dear Mr. Oxenfeld:
This office reviewed the Theodore and Wilma Wacker application for a
Recorded Exemption, and comments were provided to you in our letter of
November 3, 1982. Due to an error in the determination of the existing
right of way north of the highway centerline, we are retracting our request
for additional right of way along State Highway 392. The present right of
way should be sufficient to accommodate future widening of the highway along
this property.
