This project falls primarily under the purview of the Use by Special Review Standards, Weld County Code, Chapter 23, Article II, Division 4, Section 23. Our comments and requirements are as follows: COMMENTS: Weld County Road Classification Plan (FHU): WCR 41 (1st Avenue) is a local paved road and requires a 60-foot right-of-way at full build out. There is presently a 60-foot right-of-way. This road is maintained by Weld County. Pursuant to the definition of SETBACK in the Weld County Zoning Ordinance (23-1-90), the required setback is measured from the future right-of-way line. --We do not have any average daily traffic counts on WCR 41 between WCRs 60 and 62. Our most recent aunt is one mile north of this location reflecting 621 vehicles. REQUIREMENTS: Access: Utilize the existing access road directly across from "F" Street as identified in your Hungenberg tank battery site. The easement shall be a graded and drained road to provide an all-weather access. Storm Water Drainage: The applicant is required to comply with all Colorado Department of Health and Environmental (CDPHE) regulations regarding berming and spill prevention for materials and liquids stored on site. The applicant is required to comply with all Colorado Department of Health and Environment, Water Quality Control Division regulations regarding storm water quality permitting and protection and construction storm water discharges. The proposed Oil and Gas Production Facility is also located in close proximity to the established aircraft traffic pattern for Runway 9/27. Furthermore, it borders the Runway Critical Zone for Runway 9/27, as adopted by Colorado State Statute. Although this land use is compatible with the Greeley-Weld County Airport Surrounding Land Use Guidelines,the Greeley-Weld County Airport Authority strongly recommends that an FAA Aeronautical Study under Part 77 of the Code of Federal Regulations be conducted prior to approval of this Special Review Permit for any new oil and gas well added to the Oil and Gas Production Facility. If the roadways within this property are not maintained or adopted by the county, individuals residing on this property should be made aware that the Sheriffs Office will have limited traffic enforcement powers in regard to traffic complaints. 2. A plan should be developed to maintain roadways on the property,especially during inclement weather conditions for emergency vehicles. 3. Since there are oil or gas production facilities within this property,they need to be fenced off in order to mitigate the potential for tampering. These facilities are known to create an attractive nuisance for young people. Tampering not only creates a significant danger to safety but also of environmental damage with extensive mitigation and clean-up costs. The Sheriffs Office lacks the ability to absorb any additional service demand without the resources recommended in the multi-year plan provided to the Weld County Board of County Commissioners or as indicated by growth not considered at the time the plan was developed. A building permit shall be obtained prior to the construction or placement of any structure such as the tank battery. An electrical permit will be required for any electrical service to equipment. A plot plan shall be submitted when applying for building permits showing all structures with accurate distances between structures, and from structures to all property lines. 2. A plan review is required for each building (other than the tank battery) for which a building permit is required. Plans shall bear the wet stamp of a Colorado registered architect or engineer. Two complete sets of plans are required when applying for each permit. A Tank battery requires an oil and gas permit. 3. Buildings shall conform to the requirements of the various codes adopted at the time of permit application. Currently the following has been adopted by Weld County: 2003 International Building Code; 2003 International Mechanical Code; 2003 International Plumbing Code; 2002 National Electrical Code; 2003 International Fuel Gas Code and Chapter 29 of the Weld County Code. 4. Setback and offset distances shall be determined by the Zoning Ordinance. 5. Building height shall be measured in accordance with the Building Code for the purpose of determining the maximum building size and height for various uses and types of construction and to determine compliance with the Bulk Requirements from Chapter 27 of the Weld County Code. Building height shall be measured in accordance with Chapter 23 of the Weld County Code in order to determine compliance with offset and setback requirements. Offset and setback requirements are measured to the farthest projection from the building. 6. We have no objections to the proposal, however, we do recommend that the following conditions be part of any approval: We recommend that the following requirements be met prior to allowing the plat to be recorded: -- 1. The applicant shall submit a dust abatement plan for review and approval, to the Environmental Health Services, Weld County Department of Public Health & Environment. We recommend that the following requirements be incorporated into the permit as conditions that must be met 45 days after first production: 1 . The applicant shall submit evidence of an Air Pollution Emission Notice (A.P.E.N.) and Emissions Permit application from the Air Pollution Control Division (APCD), Colorado Department of Health and Environment. Alternately, the applicant can provide evidence from the APCD that they are not subject to these requirements. We recommend that the following requirements be incorporated into the permit as conditions that must be met one month prior to construction activities: 1. A stormwater discharge permit may be required for a development/redevelopment /construction site where a contiguous or non- contiguous land disturbance is greater than or equal to one acre in area. Contact the Water Quality Control Division of the Colorado Department of Public Health and the Environment at www.cdphe.state.co.us/wq/PermitsUnit for more .— information. We recommend that the following requirements be incorporated into the permit as development standards: 1. All liquid and solid wastes (as defined in the Solid Wastes Disposal Sites and Facilities Act, 30-20-100.5, C.R.S., as amended) shall be stored and removed for final disposal in a manner that protects against surface and groundwater contamination. 2. No permanent disposal of wastes shall be permitted at this site. This is not meant to include those wastes specifically excluded from the definition of a solid waste in the Solid Wastes Disposal Sites and Facilities Act, 30-20-100.5, C.R.S., as amended. 3. Waste materials shall be handled, stored, and disposed in a manner that controls fugitive dust, fugitive particulate emissions, blowing debris, and other potential nuisance conditions. 4. Fugitive dust and fugitive particulate emissions shall be controlled on this site. The facility shall be operated in accordance with the approved dust abatement plan at all times. 5. The operation shall comply with all applicable State noise statutes and/or regulations 6. Adequate toilet facilities (port-a-potty) shall be provided during drilling/construction. 7. Bottled water shall be utilized for drinking and hand washing during drilling/construction. 8. All potentially hazardous chemicals must be stored and handled in a safe manner in accordance with product labeling and in a manner that minimizes the release of hazardous air pollutants (HAP's) and volatile organic compounds (VOC's). 9.
