"V RESOLUTION
RE: AUTHORIZATION TO CERTIFY EXPENSES TO THE WELD COUNTY TREASURER
INCURRED IN THE ABATEMENT OF A DANGEROUS BUILDING KNOWN AS THE
RESIDENTIAL STRUCTURE LOCATED AT 33039 COUNTY ROAD 39, LUCERNE,
COLORADO, TITLED TO RICHARD J. GERSTENBERGER
WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to
Colorado statute and the Weld County Home Rule Charter, is vested with the authority of
administering the affairs of Weld County, Colorado, and
WHEREAS, the Department of Building Inspection informed the Board that Richard J.
Gerstenberger has a building on his property, located at 33039 County Road 39, Lucerne,
Colorado, and such building is considered to be dangerous to persons under Section 302 of the
1997 Uniform Code for the Abatement of Dangerous Buildings, as adopted by Chapter 29 of the
Weld County Code, and
WHEREAS, on July 16, 2007, by Resolution #2007-2034, the Board of County
Commissioners of Weld County approved the abatement of the dangerous building described
above, and
WHEREAS, on October 15, 2007, by Resolution #2007-3231, the Board deemed it
advisable to Rescind Resolution#2007-2034,dated July 16,2007,and to Authorize the Abatement
of a Dangerous Building known as the residential structure located at 33039 County Road 29,
Lucerne, Colorado, titled to Richard J. Gerstenberger, with new terms as stated in said
Resolution #2007-3231, and
WHEREAS, an invoice in the amount of$5,380.00, for the abatement of the building, was
provided to Weld County by Agritrack, Inc., and has been paid, and
WHEREAS, an invoice in the amount of$1,200.00, for an asbestos study, was provided to
Weld County by RLH Engineering, Inc., and has been paid, and
WHEREAS, a request has been made of Richard J. Gerstenberger to reimburse Weld
County, and he has not done so, and
WHEREAS, the Board of County Commissioners of Weld County has the ability, under
Section 29-2-80 of the Weld County Code, to certify the expenses of abatement to the Weld
County Treasurer, to be collected with property taxes if said expenses are not paid by the property
owner.
NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Weld
County, Colorado, that cost of abatement and the costs of the Asbestos survey shall be certified
to the Weld County Treasurer, and shall be collected with the property taxes.

RE: Property located at 33039 County Road 39, Lucerne, Colorado
Legal Description: Lots 1, 3, and 5, Block 1 North Greeley, AKA
Town of Lucerne, County of Weld, State of Colorado
Dear Mr. Gerstenberger:
This letter is written to you as the owner of the above-described real
property to provide you with important information concerning said
property.
First, a Resolution was adopted by the Board of County Commissioners of
Weld County on July 16, 2007, determining that the building you own at
the above-referenced location was a dangerous building. Pursuant to
that determination, the Board made a determination to abate the
building. The abatement was accomplished by fencing off the property in
order to make it inaccessible to the public.
Second, pursuant to Weld County Code, Section 29, the cost of abatement
is to be paid by the property owner. Therefore, at this time, you owe
Weld County the amount of $6, 780. This amount was paid by Weld County
to two private contractors, to abate the property, and now must be paid
you. (See enclosed statements/reports from Agritrack and from RLH
Engineering, Inc. )
The $6, 780 must be paid by you to Weld County on or before October 22,
2007. If you fail to pay that amount by that time, the matter will be
heard at a meeting of the Board of County Commissioners of Weld County
on the 24th day of October, 2007, at the hour of 9:00 a.m. The meeting
will take place in the Hearing Room of the Centennial Building located
at 915 Tenth Street, Greeley, Colorado. At that time the Board will
consider a request by the County to certify the debt to the Weld County
Assessor. At the time of certification, the obligation will become a
lien on the property, and will be collected as a tax in 2008, along
with the property taxes .
