The applicant has complied with the application re- quirements listed in Section 21. 7 et seq. , of the Weld County Zoning Ordinance. 2. The request is in conformance with Section 21. 6 of the Weld County Zoning Ordinance as follows : a. The subject site is located adjacent to the municipal boundaries of the City of Greeley and Garden City, Garden City is not zoned, however, uses within the municipal boundaries of Garden City adjacent to the subject site are commercial and service oriented uses , and are compatible with uses allowed in the County' s Commercial-Three Zone District. Property adjacent to the subject site within the municipal boundaries of Greeley is zoned Industrial-Two. The City' s "I-2" classification allows wholesale sales by right and retail sales by special review, and is compatible with the County' s Commercial- Three zoning. Corp. (Economy Lumber) for a Change of Zone from I-3 (Industrial-three) to C-3 (Commercial-three) . Chairman N. Carlson informed the applicant that only three Commissioners were present and that they could continue this hearing to a date when all five Commissioners could be present. The applicant chose to have this request heard today. Lee D. Morrison, Assistant County Attorney, read this application into the record. Rod Allison, Planning Department representative, made the favorable Planning Commission recommendation of record. David Stookesberry, representing Economy Lumber, was present to answer any questions. Commissioner Brantner moved to approve the application of E.B.I. Corp. (Economy Lumber) for a Change of Zone. Commissioner Martin seconded the motion and it carried unanimously. Louis Rademacher - yes, while he realizes this is not good farm land, he is afraid with the land divided into plots it will become cluttered with debris and just grow-up into weeds. Bill McMurray - no; Sharon Linhart - yes; Stephen Hamilton - yes; Paulette Weaver - yes; -Doug Graff - yes; Jack Holman - Yes, it is his feeling residential development should take place around existing towns and titles so services may be provided that are usually requested by home- owners in these areas. Corporation (Economy Lumber) REQUEST: A Change of Zone from Industrial-Three to Commercial-Three LEGAL DESCRIPTION: Part of Lot 8 and vacated 27th Street Road of Arlington Gardens Subdivision; located in part of Section 17, T5N, R65W of the 6th P.M. , Weld County, Colorado LOCATION: 500 27th Street, Greeley; south and adjacent to Garden City APPEARANCE: David Stookesberry, Vice—President, Economy Lumber Company, Inc. , reported E.B.I. Corporation is now Greeley Economy Lumber and Hardware, Inc. He stated it was not their intent to circumvent any County requirements pertaining to their new building. When they applied for their industrial revenue bonds, they had to have a letter from the County stating that they were in compliance with the zoning. He obtained such a letter and their industrial revenue bonds were approved with that letter, and their building permit was issued. Later, during the construction phase of the project, they were informed the proper zoning for this area should be Commercial Three. Therefore, they submitted an application for a change of zone. It is his feeling the Commercial-Three zoning actually represents the businesses that are here more accurately. The Chairman asked Mr. Stookesberry if he had reviewed the recommendations and conditions as set forth by the Department of Planning Services staff. He stated he has no objections to anything as outlined. The Chairman called for discussion from the audience. There was none. Rod Allison explained the city of Greeley's no position stand on this request. The Chairman asked that reading of the Department of Planning Services staff Comments and the Conditions as outlined by the staff be dispensed with and that they be filed with the summary as a permanent record of these proceedings.
