RESOLUTION
RE: APPROVE VACATION OF USE BY SPECIAL REVIEW PERMIT#1358-HAL GARWOOD
WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to
Colorado statute and the Weld County Home Rule Charter, is vested with the authority of
administering the affairs of Weld County, Colorado, and
WHEREAS,on November20,2001,the Weld County Planning Commission approved Use
by Special Review Permit#1358 for a 195-foot communication tower in the A (Agricultural) Zone
District, for Robert and Cozette Legino, on the following described real estate, to-wit:
Part of the S1/2 NE1/4 of Section 20, Township 11
North, Range 67 West of the 6th P.M., Weld County,
Colorado
WHEREAS, the Board has received a request from the current property owner, Hal
Garwood, 1220 Kerr Gulch Road, Evergreen, Colorado 80439, to vacate said Use by Special
Review Permit#1358, and
WHEREAS,the Board of County Commissioners heard all of the testimony and statements
of those present, studied the request of the applicant and the recommendations of the Department
of Planning Services staff and all of the exhibits and evidence presented in this matter and, having
been fully informed, deems it advisable to approve said vacation.
NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Weld
County, Colorado, that Use by Special Review Permit#1358 be, and hereby is, vacated.

SUBJECT: Vacation of USR-1358
March 26, 2007
Hal Garwood has requested a vacation of Use by Special Review Permit, USR-1358, for a 195-
foot communication tower located east of and adjacent to County Road 126.5.
This permit was approved by the Weld County Planning Commission on November 20, 2001 for
Robert and Cozette Legino.
The site is located in part of the South half of the Northeast quarter of Section 20, Township 11
North, Range 67 West of the 6th P.M., Weld County, Colorado.
The Department of Planning Services, on behalf of the applicant, is recommending this land
use permit to be vacated. The letter requesting vacation of USR-1358 is attached.
