HomeMy WebLinkAbout20070630.tiff RESOLUTION RE: APPROVAL OF TEMPORARY PERMIT FOR A 3.2 PERCENT BEER RETAIL LIQUOR LICENSE FOR CIRCLE K STORES, INC., DBA CIRCLE K STORE #2709846 AND AUTHORIZE CHAIR TO SIGN WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to Colorado statute and the Weld County Home Rule Charter, is vested with the authority of administering the affairs of Weld County, Colorado, and WHEREAS, Circle K Stores, Inc., dba Circle K Store#2709846, 10963 1-25 Access Road West, Longmont, Colorado 80504, presented to the Board of County Commissioners of Weld County, Colorado, an application for a Transfer of Ownership of a 3.2 Percent Beer Retail Liquor License, for the sale of fermented malt beverages containing not more than 3.2 percent of alcohol by weight, in sealed containers not for consumption at the place where sold, said License previously held by First Hand Management, LLC, dba Shell #7, and WHEREAS,Section 12-47-106.5, C.R.S., which became effective July 1, 1991, allows for the issuance by the Board of County Commissioners of a temporary permit to the transferee of an existing liquor license to authorize the transferee to conduct business and sell alcoholic beverages at retail in accordance with said license, subject to compliance with certain conditions, and WHEREAS, Circle K Stores, Inc. has complied with all of the conditions set forth in said Section, and WHEREAS, Circle K Stores, Inc. has also submitted the required application fee for said temporary permit of $100.00. NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Weld County, Colorado, that having examined said application and other qualifications of the applicant for the transfer of the 3.2 Percent Beer Retail Liquor License and having considered said request for a temporary permit, does hereby grant to Circle K Stores, Inc., dba Circle K Store#2709846, 10963 1-25 Access Road West, Longmont, Colorado 80504, a Temporary Permit to conduct business and sell fermented malt beverages containing not more than 3.2 percent of alcohol by weight, in sealed containers not for consumption at the place where sold, at retail at said location in accordance with the license previously held by First Hand Management, LLC, dba Shell #7, subject to all other rules and regulations set forth by the Board of County Commissioners of Weld County, Colorado, for a period of 120 days, or until such time as the application for Transfer of Ownership is approved by the State of Colorado, whichever shall occur first. Until the Transfer of Ownership has been considered by the Board of Commissioners and notification has been received from the State advising whether this Transfer of Ownership request has been approved or disapproved, the Board hereby authorizes the continued sale of 3.2% fermented malt beverages in sealed containers not for consumption at the place where sold at this establishment which is located at 10963 1-25 Access Road West, Longmont, Colorado 80504, under a Temporary Permit which has been approved by the Board on March 12,2007. This Temporary Permit allows Circle K Stores, Inc.,dba Circle K Store#2709846, to conduct business and sell 3.2% fermented malt beverages in sealed containers not for consumption at the place where sold, at retail at said location in accordance with the license previously held by First Hand Management, LLC, dba Shell #7, subject to all other rules and regulations set forth by the Board of County Commissioners of Weld County, Colorado, for a period of 120 days, or until such time as the application for Transfer of Ownership is approved by the State of Colorado, whichever shall occur first.
