ROAD MAINTENANCE AND IMPROVEMENTS AGREEMENT
THIS AGREEMENT, made and entered into this 1st day of June
1983, by and between the COUNTY OF WELD, STATE OF COLORADO, hereinafter
called "County" and WESTERN PAVING CONSTRUCTION CO., hereinafter called
"Western". •
WHEREAS, Western has applied to the County for a Use by Special Review
Permit for an open-cut gravel pit located in the North 1/2 of the Northeast Quarter
of Section 16, Township 2 North, Range 68 West of the 6th Principal Meridian.
WHEREAS, Western is operating similar gravel pits in the immediate
vicinity of the above-mentioned gravel pit, and
WHEREAS, the gravel pits generate an increase in heavy truck traffic,
and
WHEREAS, the existing County roads that serve the gravel pits will require
increased maintenance and improvements due to the increase in heavy truck traffic,
and
WHEREAS, the County and Western have reviewed proposed maintenance
and improvements and acknowledges they will enhance the accessibility and safety
of the roads that serve the gravel pits.
NOW THEREFORE, in consideration of the mutual covenants and conditions
hereinafter set forth, the County and Western mutually agree as follows:
1 . The County roads that serve the gravel pits are Weld County Roao
20.5 between Weld County Road 1 and Weld County Road 7; Weld
County Road 7 between State Highway 119 and Weld County Road
18; and Weld County Road 20 between Weld County Road 7 and
Interstate 25.
2. Western agrees to excavate and patch any damage on the above-
mentioned roads that has been created by heavy truck hauling
from Western's gravel pits.
3. At any time in the future, when road damage has increased beyond
the point that patching can reasonably restore the road, Western
will cooperate with the County in the reconstruction of those parts
of the County roads.
4. The details of construction and the amount of aggregate base course
required will be determined by sampling and testing of the existing
roads by the Weld County Engineering Department.
5. When reconstruction is required, Western will supply the hot bituminous
pavement, aggregate base course, equipment, and labor for reconstruc-
tion.
6. When reconstruction is required, the County will reimburse Western
for the cost of AC-10 liquid asphalt for the manufacture of hot
bituminous pavement.
7. All construction and materials will be in accordance with the State
Department of Highways, Division of Highways, State of Colorado,
Standard Specifications for Road and Bridge Construction, 1981 .
IN WITNESS WHEREOF, the parties hereto have duly executed the agreement

serve the gravel pits.
NOW, THEREFORE, in consideration of the mutual covenants and conditions

RE: ROAD MAINTENANCE AGREEMENT
Dear Mr. Carlson:
We are in receipt of the Resolution approving our Use by Special
Review for an open-cut gravel pit in Weld County, and also the original
copy of the road maintenance agreement which was executed on
behalf of your Board.
We would like to call to your attention that we have deleted the
entire first sentence of Paragraph 4, as we feel that when the
reconstruction of the road bed is done that some areas may require
only an overlay, and that the 3" bituminous pavement would not
apply as specified. On the premise that this may occur, we have
therefore deleted that sentence from Paragraph 4, as we believe
that the wording in the balance of the paragraph will adequately
cover this.
You may initial the portion of Paragraph 4 that we deleted, on the
original and duplicate original you furnished and which the Board
has signed; or, you may sign the re-written agreement, with the
change in Paragraph 4, and return one copy to us for our records.
If you wish further clarification, or have any questions regarding
this, please do not hesitate to contact our office.
