CHUCK CARSON, CHAIRMAN RE: ROAD MAINTENANCE AGREEMENT Dear Mr. Carlson: We are in receipt of the Resolution approving our Use by Special Review for an open-cut gravel pit in Weld County, and also the original copy of the road maintenance agreement which was executed on behalf of your Board. We would like to call to your attention that we have deleted the entire first sentence of Paragraph 4, as we feel that when the reconstruction of the road bed is done that some areas may require only an overlay, and that the 3" bituminous pavement would not apply as specified. On the premise that this may occur, we have therefore deleted that sentence from Paragraph 4, as we believe that the wording in the balance of the paragraph will adequately cover this. You may initial the portion of Paragraph 4 that we deleted, on the original and duplicate original you furnished and which the Board has signed; or, you may sign the re-written agreement, with the change in Paragraph 4, and return one copy to us for our records. If you wish further clarification, or have any questions regarding this, please do not hesitate to contact our office. Yoursvery truly, WESTERN PAVING CONSTRUCTION Co. 7 /deh Ends as noted Frank M.
