Hi Chris—Sorry for the long email. I'm currently reviewing these minutes from the website in order to compare to
Connell Resources' adjacent proposed USR-1606 referral and I found some fairly substantial inaccuracies in
them. I don't want to be hypercritical; however, some of the inaccuracies convey misinformation. I don't know
what the process would be to amend them at this point in time, but I wanted to point out some of them as follows:
Page 6, Paragraph 2 indicates that the Sunset PUD includes "an elementary school site"?
Page 6, Paragraph 4 indicates that the project is west of and adjacent to WCR 23—rather than east
Page 8, bottom Paragraph: "...he had an agreement showing some of the existing and proposed industrial uses
in the area which he passed out to the Board..." I actually distributed an aerial photograph exhibit— not an
agreement.
Page 8, bottom Paragraph: "...that development began with Owens-Illinois and would be served by Windsor
infrastructure..." I actually clarified that "The first development in the industrial park was Owens-Illinois which was
approved through the Weld County process and that site is currently served by Windsor infrastructure."
Page 8, bottom Paragraph: "...Windsor recently approved a maintenance facility and water needs for Connell
Resources in unincorporated Weld County..." The Town did not approve a maintenance facility. I actually stated
that Connell Resources had formally requested water service from the Town for a proposed maintenance facility
and the Town informed them that they would need to annex since they are in the Town's GMA.
Page 8, bottom Paragraph: "...the Windsor town board is also recommending denial of the application..." The
Windsor Town Board has not had the opportunity to review or make recommendation regarding the project as the
applicant has not made any attempt to annex to the Town. I stated that I was attending the meeting at the
direction of the Windsor Planning Commission and the comments that I conveyed were those of the Planning
Commission.
Page 9, Paragraph 1: "Chad Auer asked Mr. Ballstadt if removing the commercial component was a substantial
change. Mr. Ballstadt stated the amended application was reviewed by the Planning Commission and there was
no change from Windsor's original referral comments. Mr. Auer asked what the process was for incorporating
SPO input and if the Willow Springs residents were included in that process. Mr. Ballstadt replied Windsor held
several open houses conducted at various locations with Willow Spring's residents and surrounding areas in
attendance." This should be clarified, as Mr. Auer asked Mr. Ballstadt if surrounding property owners were
included during the Town's process to update the Comprehensive Plan and East Side Industrial Subarea Plan, as
that is the process that included open houses, etc. As written, the paragraph implies that the Town held o.-
houses to consider the amended Sunset PUD referral and that is not the case.

Page 9, Paragraph 2: "Bruce Fitzgerald asked when their Comprehensive Plan was redone and if the zoning for
the property was also changed within that time period. Mr. Ballstadt said it was changed within the last two
years." I believe that Mr. Fitzgerald must have been referring to the Town's land use depiction and not zoning, as
the Town cannot change the zoning if the property is not annexed into the Town, and I did not indicate that the
Town had changed the zoning of the property.
Page 9, Paragraph 2: "Mr. Ballstadt said Windsor has IGA's with Severance and Larimer County." I actually
stated, "The Town has IGA's with Severance, Larimer County, Greeley, Fort Collins and Timnath and would
welcome an IGA with Weld County as long as the IGA were tailored to address meaningful items for both
jurisdictions."
Page 9, Paragraph 4: "Mr. Ehrlich asked Mr. Ballstadt about the East Side Industrial Sub-area plan boundaries
and Mr. Ballstadt replied the boundary is an eighth of a mile either side of SH 392 and is projected as commercial
with light industrial projected further to the south." The reference to an eighth of a mile either side of SH 392
pertains to the Town's IGA with Severance and not the East Side Industrial Subarea Plan.
Page 9, Paragraph 5: "Paul Branham asked how long ago Willow Springs was approved by Weld County. Mr.
Ballstadt replied it was 1993." I don't believe that I answered this question. It may have been Weld County staff,
as I don't know where the 1993 date came from.
Page 10, bottom Paragraph: "Mr. Ochsner also said the applicant had made their case because Windsor has
said they will not annex the property." This statement may have been made after I left the meeting, however, I
just want to clarify that Windsor has never said that the Town will not annex the property. The Town's
recommendation is actually that Weld County refer the applicant to the Town for annexation.
There were some other items, however, the aforementioned were of more concern as they misrepresent what
was said. Can you tell me if there is a way to correct these items at this point? Thanks for your help.
Also, can you please tell me if this project has been scheduled for the Board of County Commissioners yet?
