NAASEH-SHAHRY WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to Colorado statute and the Weld County Home Rule Charter, is vested with the authority of administering the affairs of Weld County, Colorado, and WHEREAS, the Board of County Commissioners of Weld County, Colorado has reviewed the request of Louis Katona, Hosein Naaseh-Shahry and Rebecca J. Naaseh-Shahry for an exemption from the definitions of "subdivision" and "subdivided land" in -- Section 30-28-101 (10) , CRS 1973, as amended, and Section 2-1 of the Weld County Subdivision Regulations, and WHEREAS, the Board finds that Louis Katona, Hosein Naaseh- Shahry and Rebecca J. Naaseh-Shahry are the owners of certain parcels of land located in part of the Southwest Quarter of Section 19, Township 7 North, Range 67 West of the 6th P. M. , Weld County, Colorado. The legal descriptions of said tracts of land are set forth in Exhibit "A" being attached hereto and incorporated herein by reference, and NOW, THEREFORE, BE IT RESOLVED by the Board of County Com- missioners of Weld County, Colorado that the abovedescribed parcels be, and hereby are, declared to be exempt from the definitions of "subdivision" and "subdivided land" as set forth in Section 30-28-101 (10) , CRS 1973, as amended, and Section 2-1 of the Weld County Subdivision Regulations, and BE IT FURTHER RESOLVED by the Board that the resulting parcels of land as described above be, and hereby are, considered to be single lots. The above and foregoing Resolution was, on moiton duly made and seconded, adopted by the following vote on the 28th day of October, A.D. , 1981. NAASEH-SHAHRY, as joint tenants with right of survivorship and not as tenants in common, whose mailing addresses , for the purposes of this Agreement, are 331 Juniper Place, Loveland, Colorado 80537 , hereinafter referred to as "the Purchasers. " WITNESSETH: WHEREAS, the parties hereto have entered into a "Receipt and Option Contract (Vacant Land) " dated July 13 , 1981 , hereinafter referred to as "the Purchase Contract" ; and WHEREAS , the subject matter of the Purchase Contract is Chose certain parcels of real estate located in Weld County, Colorado, which are legally described on Exhibit "A" attached hereto and incorporated herein by reference and hereinafter referred to as "the Property" ; and WHEREAS, the closing of the sale of the Property by the Seller to the Purchasers took place on July 31 , 1981 ; and WHEREAS, certain matters remain to be completed after closing , which are not to be merged into documents executed at closing. The parties hereto acknowledge that the Property conveyed to the Purchasers by the Seller at closing by general Warranty Deed contains approximately eleven and three-tenths ( 11 . 3) acres . The parties hereto further acknowledge that a ' portion of the Property , consisting of approximately one and three-tenths (1 . 3) acres , was conveyed to the Purchasers together with the other ten (10) acres making up the Property in order to comply with the Weld County Subdivision Regulations. The parties further acknowledge that the Seller is the owner of other real Xx property located adjacent to and East of the Property and that it is the desire of the Seller to re-acquire the said one and three-tenths ( 1 . 3 ) acre parcel and "attach" the same to the Seller ' s said adjacent real estate. Said re-acquisition of the said one and three-tenths (1 . 3) acre parcel and attachment of the said parcel to the Seller ' s said existing real estate will require the approval of the Weld County Board of County Commissioners . The Seller shall have ninety (90) days from the date of this Agreement to achieve said approval , in which event , the Purchasers shall promptly reconvey to the Seller the said one and three-tenths (1 . 3) acre parcel by general Warranty Deed, free and clear of all liens and encumbrances . 2 . The location of the portion Of the Property consisting of approximately ten (10) acres is colored in red on the map attached hereto as Exhibit "B. " The one and three-tenths (1 . 3) acre parcel to be reconveyed to the Seller by the Purchasers upon" approval of the Weld County Board of County Commissioners is colored on said map in yellow. 3 . The parties hereto acknowledge that the Purchasers intend at closing to grant to Savings Industrial Rank a Deed of Trust in order to secure a new loan being obtained by the Purchasers . Upon approval of the "attachment" of the one and three-tenths (1 . 3) acre parcel of the Property to the Seller ' s adjacent real estate by the Weld County Board of County Commissioners , the Purchasers , at their sole cost and expense , ' shall cause the said one and three-tenths (1 . 3) acre parcel to be released from the lien of the said Deed of Trust. By execution of this Agreement , the said Savings Industrial Bank agrees to release the said one and three-tenths (1 . 3) acre parcel from the lien of the said Deed of Trust upon the reconveyance thereof by the Purchasers to the Seller. 4 .
