Environmental Health Services has reviewed this proposal for an oil and gas storage
facility. We have no objections to the proposal, however, we do recommend that the
following conditions be part of any approval:
We recommend that the following requirements be met prior to allowing the plat to be
recorded:
1. The applicant shall submit evidence of an Air Pollution Emission Notice
(A.P.E.N.) and Emissions Permit application from the Air Pollution Control
Division (APCD), Colorado Department of Health and Environment. Alternately,
the applicant can provide evidence from the APCD that they are not subject to
these requirements.
2. The applicant shall submit a dust abatement plan for all driving and parking areas
for review and approval, to the Environmental Health Services, Weld County
Department of Public Health & Environment.
3. The applicant shall provide current evidence that the facility has an adequate
water supply (i.e., well or community water system).
4. The applicant shall submit evidence of a Colorado Discharge Permit System
(CDPS) from the Water Quality Control Division of the Colorado Department of
Health and Environment for any proposed discharge into State Waterways, if
applicable.
5. The applicant shall submit evidence of an Aboveground Storage Tank permit
from the Colorado Department of Labor and Employment (CDL&E), Oil
Inspection Section for any aboveground storage tanks located on the site.
Alternately, the applicant can provide evidence from the (CDL&E), Oil Inspection
Section that they are not subject to these requirements.

6. The applicant shall submit a waste handling plan, for approval, to the
Environmental Health Services Division of the Weld County Department of Public
Health & Environment. The plan shall include at a minimum, the following:
1) A list of wastes which are expected to be generated on site (this should
include expected volumes and types of waste generated).
2) A list of the type and volume of chemicals expected to be stored on site.
3) The waste handler and facility where the waste will be disposed (including
the facility name, address, and phone number).
We recommend that the following requirements be incorporated into the permit as
conditions that must be met one month prior to construction activities:
1. A stormwater discharge permit may be required for a
development/redevelopment /construction site where a contiguous or non-
contiguous land disturbance is greater than or equal to one acre in area. Contact
the Water Quality Control Division of the Colorado Department of Public Health
and the Environment at www.cdphe.state.co.us/wq/PermitsUnit for more
information.
We recommend that the following requirements be incorporated into the permit as
conditions that must be met prior to the issuance of the Certificate of Occupancy:
1. An individual sewage disposal system is required for the proposed office facility
and shall be installed according to the Weld County Individual Sewage Disposal
Regulations.
2. The septic system is required to be designed by a Colorado Registered
Professional Engineer according to the Weld County Individual Sewage Disposal
Regulations.
We recommend that the following requirements be incorporated into the permit as
development standards:
1. All liquid and solid wastes (as defined in the Solid Wastes Disposal Sites and
Facilities Act, 30-20-100.5, C.R.S., as amended) shall be stored and removed for
final disposal in a manner that protects against surface and groundwater
contamination.

2. No permanent disposal of wastes shall be permitted at this site. This is not
meant to include those wastes specifically excluded from the definition of a solid
waste in the Solid Wastes Disposal Sites and Facilities Act, 30-20-100.5, C.R.S.,
as amended.
3. Waste materials shall be handled, stored, and disposed in a manner that controls
fugitive dust, fugitive particulate emissions, blowing debris, and other potential
nuisance conditions.
4. The applicant shall operate in accordance with the approved "waste handling
plan".
5' The applicant shall comply with all provisions of the Underground and Above
Ground Storage Tank Regulations (7 CCR 1101-14).
6. Fugitive dust and fugitive particulate emissions shall be controlled on this site.
The facility shall be operated in accordance with the approved dust abatement
plan at all times.
7. The operation shall comply with all applicable State noise statutes and/or
regulations.
8. Adequate handwashing and toilet facilities shall be provided for employees and
patrons of the facility.
9. Sewage disposal for the facility shall be by septic system. Any septic system
located on the property must comply with all provisions of the Weld County Code,
pertaining to Individual Sewage Disposal Systems.
10.A permanent, adequate water supply shall be provided for drinking and sanitary
purposes.
11.All potentially hazardous chemicals must be stored and handled in a safe manner
in accordance with product labeling and in a manner that minimizes the release
of hazardous air pollutants (HAP's) and volatile organic compounds (VOC's).
12.If applicable, the applicant shall obtain a stormwater discharge permit from the
Colorado Department of Public Health & Environment, Water Quality Control
Division.
13.The operation shall comply with all applicable rules and regulations of the State
and Federal agencies and the Weld County Code.

engineered foundation plans bearing the wet stamp of a Colorado registered architect or
engineer must be submitted for review. A geotechnical engineering report preformed by a

The Weld County Public Works Department has reviewed this proposal. This project falls primarily under the
purview of the Use by Special Review Standards, Weld County Code, Chapter 23, Article II, Division 4, Section
23. Our comments and requirements are as follows:
COMMENTS:
Weld County Road Classification Plan (FHU): WCR 30 is a collector road and requires an 80-foot right-of-
way at full build out. There is presently a 60-foot right-of-way. This road is maintained by Weld County.
Pursuant to the definition of SETBACK in the Weld County Zoning Ordinance (23-1-90), the required setback is
measured from the future right-of-way line.
--WCR 49 is classified by the County is a Strategic Roadway, which requires a 140-foot right-of-way at full build
ut. There is presently a 60-foot right-of-way. This road is maintained by Weld County. Pursuant to the
definition of SETBACK in the Weld County Zoning Ordinance (23-1-90), the required setback is measured from
the future right-of-way line.
Our most recent average daily traffic count (ADT) for WCR 30 reflects between 372 and 770 vehicles. The
most recent ADT count on WCR 49 is between 3,154 and 4,061 vehicles.
Access: The applicant is proposing a 25-foot ingress and egress. Both locations will be fenced and gated.
If a drainage culvert is required, a 15-inch corrugated metal pipe is the County's minimum size requirement. If
the applicant chooses to place a larger culvert, please contact the Public Works Department to adequately size
your culvert.
Scot Lewis, staff traffic engineer, will be evaluating road improvements associated with access to the WCR 30
and the WCR 49 intersection associated with the proposed site. Contact Scot Lewis at 304-6496, X 3726.
Circulation/Loading Area/Parking: The applicant is proposing to pave the circulation pattern and the
adjacent parking lot along with the approaches to WCR 30. Your base and pavement design should reflect the
type of heavy vehicles utilizing the site.
Storm Water Drainage: Brian Varrella, staff drainage engineer, will evaluate the storm water drainage
analysis. Brian may be reached at 304-6496, X3741.
The applicant shall follow-up with Scot and Brian on any review and approval of these items.
.ach off-street parking space shall be equipped with wheel guards or curb stops where needed to prevent
vehicles from extending beyond the boundaries of this space and from coming into contact with other vehicles,
walls, fences, or plantings.
The applicant is identifying one parking space which should conform to all standards of the Americans with
isability Act. These parking spaces shall be properly striped and signed.

Colorado will be required. This report shalt be supported with all. appropriate and applicable engineering
design calculations. These calculations shall be included as an appendix to the report. .`
'Weld County will not maintain drainage related areas, medians, and this must be addressed by the owner.
Final drainage construction and erosion controls plans (conforming to the final drainage report) stamped,
signed, and dated by a professional engineer license in the State of Colorado shall be submitted with each
plan (phase), These plans(storm water management plans)shall be based upon urban drainage methodology.
The applicant is required to comply with all Colorado Department of Health and Environmental (CDPHE)
regulations regarding berming and spill prevention for materials and liquids stored on site,
The applicant is required to comply with all Colorado Department of Health and Environment, Water Quality
Control Division regulations regarding storm water;quality permitting and protection and construction storm
water discharges.
The applicant is required to comply with all Colorado Oil and Gas Conservation Commission (COGCC) rules
and regulations including drill pad construction,storm water controls,and reclamation.

The Sheriffs Office recommends the following improvements for this business:
1. Mail distribution for the home and business should be limited to as few locations as possible
with a central drop off location within the property. It should be developed so that residents do
not have to cross a county road to obtain their mail.
2. A permanent sign should be placed at the entrance to the property that meets the planning and
zoning standards and is approved by the county commissioners, detailing the name of the
business, address, and a graphical presentation of the roadways within the property. There
should be a plan developed to maintain this sign.
3. If the roadways within this property are not maintained or adopted by the county, individuals
residing on this property should be made aware that the Sheriffs Office will have
limited traffic enforcement powers in regard to traffic complaints.
4. A plan should be developed to maintain roadways on the property, especially during
inclement weather conditions for emergency vehicles.
5. If there are oil or gas production facilities within this property,they need to be fenced off in
order to mitigate the potential for tampering. These facilities are known to create an attractive
nuisance for young people. Tampering not only creates a significant danger to safety but also of
environmental damage with extensive mitigation and clean-up costs.
6. If you intend to name any of the roads on the property you should be present these names to
the Sheriffs Office for approval. This will eliminate duplication of street names within the county.
If you do name any of the roads they will need to be properly marked with clearly visible
reflective signs.
The Sheriffs Office lacks the ability to absorb any additional service demand without the resources
recommended in the multi-year plan provided to the Weld County Board of County Commissioners or as
indicated by growth not considered at the time the plan was developed. I have no other comments on this
proposal.

Re: USR-1614 — Site Specific Development Plan and Special Review Permit for an
Oil and Gas Support Facility
Dear Ms. Martin:
This referral does not appear to qualify as a "subdivision" as defined in Section 30-
28-101(10)(a), C.R.S. Therefore, pursuant to the State Engineer's March 4, 2005
memorandum to county planning directors, this office will only perform a cursory review of
the referral information and provide comments. The comments do not address the
adequacy of the water supply plan for this project or the ability of the water supply plan to
satisfy any County regulations or requirements. In addition, the comments provided
herein cannot be used to guarantee a viable water supply plan or infrastructure, the
issuance of a well permit, or the physical availability of water.
The referral information does not indicate that groundwater will be used to serve the
facility, however, SemCrude, L.P. has submitted a well permit application to construct a well
on the property for industrial, irrigation and commercial purposes. The application was filed
on April 5, 2007. That well permit application has not yet been evaluated by the State
Engineer's Office, therefore, it is unknown if there will be any issues with the applicant
obtaining a permit to construct the proposed well.
