RE: ACTION OF THE BOARD OF COMMISSIONERS REGARDING VIOLATION VI#0600150
AGAINST LAND HOME DEVELOPMENT,C/O TRENTON PARKER FOR VIOLATION OF
THE WELD COUNTY CODE
WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to
Colorado statute and the Weld County Home Rule Charter, is vested with the authority of
administering the affairs of Weld County, Colorado, and
WHEREAS, Land Home Development, c/o Trenton Parker, VI #0600150, is allegedly in
violation of the Weld County Code, and
WHEREAS, despite efforts by the Planning staff to resolve said matter, the violation has
not been corrected, and
WHEREAS, on the 13th day of February, 2007, a public hearing was held before the Board
of County Commissioners for the purpose of hearing testimony relating to said violation, and
WHEREAS,Land Home Development, c/o Trenton Parker was not present or represented
at said hearing, although all parties were notified of said hearing by Department of Planning
Services staff, and
WHEREAS, the Board deems it advisable to bring legal action against those individuals
named above to correct said violation.
NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Weld
County, Colorado, that the Weld County Attorney be, and hereby is, authorized to proceed with
legal action against Land Home Development, c/o Trenton Parker to remedy the violation of the
Weld County Code, and any other persons occupying the properties, any persons claiming an
interest in the properties, and any persons acting in active concert with the identified parties.

Weld County Sheriffs Office posted the property on January 25, 2007
Currently the property is in violation of Chapter 23-3-20, 23-3-30, 23-3-30.F, 23-3-30.1 and 23-3-30.L and
Chapter 23, Article IV(4), Division
REMEDY
To bring the property into compliance the following shall occur:
► The mobile homes shall be permitted or removed from the property.
► The Noncommercial Junkyard shall be restored, removed or completely screened from all
adjacent properties and public rights-of-ways.
► The number of Commercial Vehicles shall be reduced according to the Weld County Code.
RECOMMENDATION
The Department of Planning Services recommends that this case be referred to the County Attorney's
Office for immediate legal action.
CASE HISTORY
March 14, 2002 Initial complaint received.
March 27, 2002 VI-0200052 was presented to the Board of County Commissioners through the
Violation Hearing process. The Board referred this violation to the County
Attorney's Office for immediate legal action.

May 4, 2004 Due to change in staff and lack of information, court dismissed 02-CV-558.
March 24, 2006 County Attorney's Office directed our office to close the old violation (VI-0200052)
and start a new violation case (VI-0600150)for the Noncommercial Junkyard,
Mobile Homes and Commercial Vehicle aspect as well as a separate violation for
the illegal land split (VI-0600169).
April 4, 2006 Property inspected. Property remains in violation.
April 14, 2006 Bethany Salzman and Jacqueline Hatch, Planner, discussed options to correct an
illegal land split with County Attorney's Office.
October 25, 2006 As required per RE-4471, Mr. Parker submitted a brief statement explaining his
intent to correct all outstanding violations regarding this property.
October 30, 2006 Illegal land split corrected.
January 5, 2007 Received confirmation of correction of illegal land split. VI-0600169 case closed.
January 10, 2007 Letter sent to Sheriffs Office for service to the property owner indicating that the
violation case was scheduled before the Board of County Commissioners.
February 5, 2007 Received completed Affidavit of Service from the Weld County Sheriffs Office.

Dear Mr. Parker:
The property referenced above remains in violation of the Weld County Code. I have scheduled a
meeting with the Board of County Commissioners on February 13,2007,at 10:00 a.m.,to consider the
violations occurring on the property. The above mentioned property remains in violation of the
following Section(s) of the Weld County Code:
Chapter 23, Article III, Div 1 "A(Agricultural)Zone District"
Section 23-3-20 "Uses allowed by right."
Section 23-3-30 "Accessory uses."
Section 23-3-30.F "MOBILE HOME subject to the additional requirements of Article IV,
Division 3 of this Chapter."
Section 23-3-30.1 "Noncommercial junkyard."
Section 23-3-30.L "Up to two (2) semi-trailer(s) may be used for accessory storage on
agricultural parcels not in an approved or recorded subdivision plat,or lots which are part of
a map or plan filed prior to the adoption of any regulations controlling subdivisions in the A
(Agricultural)Zone District. (One (1)semi-trailer used as accessory storage on lots in an
approved or recorded subdivision plat,or lots which are part of a map or plan filed prior to
the adoption of any regulations controlling subdivisions in the A(Agricultural)Zone District,
may be permitted according to the procedure and requirements outlined in Sec. 23-4-165
of this Chapter for the purpose of storing goods inside the unit."
Chapter 23, Article IV, Div 3 "Mobile Homes"
Section 23-4-130 "No MOBILE HOME may be located or relocated in the County after
August 25, 1981, except in accordance with this Division, including the issuance of any
zoning permit which may be required by this Section. Each MOBILE HOME located or
relocated in the County after said date must have a BUILDING permit for a MOBILE
HOME issued pursuant to Chapter 29 of this Code. An application for any zoning or
building permit fora MOBILE HOME required by this Division shall include the following:"

To bring the property into compliance, the following shall occur:
The "Noncommercial Junkyard" consisting of iron/metal, derelict vehicles, wood and
miscellaneous debris shall be removed or screened from adjacent properties and public-
rights-of way.
The Mobile Homes and modular structures shall obtain appropriate permits(if applicable
to apply); otherwise, they shall be removed from the property. The Weld County Code
states that"A mobile home or manufactured home converted or in its original condition,
shall not be used as an "agriculturally exempt building" or as a temporary structure for
storage." •
The Weld County Code has been revised to allow up to 2 (two)semi trailers to be utilized
on a property as storage units provided they do not fall into derelict condition, they
maintain current license plates and they remain situated on their tires and remain mobile.
This hearing will take place in our Hearing Room, located at 918 10th Street, Greeley, Colorado. It is
recommended that you or a representative be in attendance to answer any questions the Board of
County Commissioners might have about the violations.
Please also be advised that I will be taking video and/or pictures from the road or adjacent properties
the business day before or as soon as possible to the above mentioned Violation Hearing date.
The Department of Planning Services' staff will be recommending that the Board of County
Commissioners authorize the County Attorney to proceedwith legal action to remedy the violation. Our
records indicate that you were made aware of the nature of the violation including the action necessary
to correct the violation, and that you were given sufficient time to remedy this violation. If you have any
questions concerning this matter, please call me.

Yes. I think we should. I talked to his attorney, Max Minnig, who said that he is withdrawing as Tranton's
attorney. Max told me that Trenton does not own the property and there seems to be something worked out as
far as ownership in the area. I got a call from Ron Harms, the other owner, and I will call him back to get more
info on Trenton.
