RE: APPROVE VACATION OF USE BY SPECIAL REVIEW PERMIT#1180 - MICHAEL AND
SHEILA DAVIS
WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to
Colorado statute and the Weld County Home Rule Charter, is vested with the authority of
administering the affairs of Weld County, Colorado, and
WHEREAS,by Resolution dated April 22, 1998,the Board approved Use by Special Review
Permit #1180 for a Single Family Dwelling and Accessory Structures on a parcel less than the
minimum lot size in the A(Agricultural)Zone District for Michael and Sheila Davis on the following
described real estate, to-wit:
Part of the SW 1/4 of Section 28, Township 2 North,
Range 68 West of the 6th P.M., Weld County,
Colorado
WHEREAS, the Board has received a request from Michael and Sheila Davis, c/o
LANDPROfessionals, LLC, 4350 State Highway 66, Suite 4, Longmont Colorado 80504,to vacate
said Use by Special Review Permit#1180, and
WHEREAS,the Board of County Commissioners heard all of the testimony and statements
of those present, studied the request of the applicant and the recommendations of the Department
of Planning Services staff and all of the exhibits and evidence presented in this matter and, having
been fully informed, deems it advisable to approve said vacation.
NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Weld
County, Colorado, that Use by Special Review Permit#1180 be, and hereby is, vacated.

SUBJECT: Vacation of USR-1180
The Department of Planning Services has received the attached letter dated December 5, 2006
from Michael and Sheila Davis. Mr. and Mrs. Davis are requesting that USR-1180 for a single
family dwelling and accessory structure on a parcel of less than the minimum lot size in the
Agricultural Zone district be vacated. This vacation is a requirement for Recorded Exemption
RE-4219.
Background information:
Legal Description: Part of S2 SW4 of Section 28 and the NW4 of Section 33, all in T2N,
R68W of the 6th P.M., Weld County, CO.
Location: East of County Road 5 and approximately 1 mile north of State Highway
52
USR-841: USR-1180 was approved by the BOCC on April 22, 1998, for a single
family dwelling and accessory structure on a parcel of less than the
minimum lot size in the Agricultural Zone District.
