RESOLUTION
RE: APPROVE CANCELLATION AND RELEASE OF COLLATERAL FOR SECOND
AMENDED SITE PLAN REVIEW, 2ndAMSPR #41- FRED AND MARCIA ROTHAUGE
WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to
Colorado statute and the Weld County Home Rule Charter, is vested with the authority of
administering the affairs of Weld County, Colorado, and
WHEREAS,by Resolution dated September8,2006,the Department of Planning Services
staff approved Second Amended Site Plan Review, 2ndAMSPR #41, for Fred and Marcia
Rothauge, do Macrum Building Systems, 916 38th Avenue Court, Suite 5, Greeley, Colorado
80634, for warehousing of drilling fluid products, drilling supplies, as well as storage and
maintenance of drilling equipment for a well construction and service company on the following
described real estate, to wit:
Part of the W1/2 of the SW1/4 SW1/4 of Section 20,
Township 2 North, Range 66 West of the 6th P.M.,
Weld County, Colorado, and
WHEREAS, on January 22, 2007, the Board of County Commissioners of Weld County,
Colorado, approved an Improvements Agreement According to Policy Regarding Collateral for
Improvements (Private Road Maintenance), between the County of Weld, State of Colorado, by
and through the Board of County Commissioners of Weld County, and Fred and Marcia Rothauge
with terms and conditions being as stated in said agreement,and accepted check#193,from Fredy
Alfred Rothauge, in the amount of $25,125.00, and
WHEREAS, it has been determined by the Board that the collateral being held by Weld
County is no longer necessary to secure said Improvements Agreement According to Policy
Regarding Collateral for Improvements(Private Road Maintenance)for Fred and Marcia Rothauge,
and
WHEREAS, staff from the Weld County Departments of Public Works and Planning
Services have conducted a visual inspection and recommend release of said collateral.
NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Weld
County, Colorado, that check#193 from Fredy Alfred Rothauge, in the amount of$25,125.00 be,
and hereby is, canceled and released.
BE IT FURTHER RESOLVED by the Board that the Clerk to the Board be, and hereby is,
directed to return said collateral to the appropriate issuing party.

COLORADO FROM: Jacqueline Hatch
SUBJECT: 2nd AMSPR-41, Fred and Marcia Rothauge
The applicant for 2nd AMSPR-41, Fred and Marcia Rothauge c/o Robert Coon has submitted the
attached email dated April 3, 2007. The applicant is requesting a full release of collateral. The
Department of Planning Services and Public Works have conducted site visits for compliance
and find that the site is in compliance with the recorded plat.
The collateral for the Improvements Agreement is in the amount of twenty five thousand one
hundred and twenty five dollars ($25,125.00) for the improvements on-site and was accepted by
the Board of County Commissioners on September 8, 2006.
Staff is recommending that the request for release of collateral for twenty five thousand one
hundred and twenty five dollars ($25,125.00) be approved at this time since the site at 13027
County Road 18 meets the Weld County Code and the recorded 2n° AMSPR-41 plat.

SUBJECT: 2ndAmSPR-41, Fred & Marcia Rothauge
At the request of the applicant and Planning Services, the Public Works Department inspected
the outstanding items associated with collateral in the amount of$22,040. The outstanding
items were sidewalk and additional paving for parking. These items were field-verified on
4/10/2007.
The Weld County Public Works recommends release of the transportation portion to the Exhibit
A. All other non-transportation items should be verified by Planning Services prior to release.
