Board of Assessment Appeals: You have the right to appeal the County Board of Equalization's(CBOE's)decision to the Board of Assessment Appeals(BAA). Such hearing is the final hearing at which testimony, exhibits, or any other evidence may be introduced. If the decision of the BAA is further appealed to the Court of Appeals,only the record created at the BAA hearing shall be the basis for the Court's decision. No new evidence can be introduced at the Court of Appeals. (Section 39-8-108(10), C.R.S.) Binding Arbitration: You have the right to submit your case to arbitration. If you choose this option the arbitrator's decision is final and your right to appeal your current valuation ends. (Section 39-8-108.5, C.R.S.) Selecting the Arbitrator: In order to pursue arbitration, you must notify the CBOE of your intent. You and the CBOE select an arbitrator from the official list of qualified people. Both you and the CBOE are entitled to participate. The hearings are informal. The arbitrator has the authority to issue subpoenas for witnesses, books, records,documents and other evidence. He also has the power to administer oaths, and all questions of law and fact shall be determined by him. The arbitration hearing may be confidential and closed to the public,upon mutual agreement. The arbitrator's written decision must be delivered to both parties personally or by registered mail within ten (10) days of the hearing. Such decision is final and not subject to review. Fees and Expenses: The arbitrator's fees and expenses are agreed upon by you and the CBOE. In the case of residential real property, such fees and expenses cannot exceed$150.00 per case. The arbitrator's fees and expenses, not including counsel fees, are to be paid as provided in the decision. I have spent a considerable amount of time researching information on the county's website,and received comparable comparative information from my realtor.After many comparisons to property in my neighborhood,I have found a$ 13,128 increase to be extremely excessive.On average property value of actual price,from county assessments in this area are, $149,000,for very similar properties to mine.I understand the time window of market data between,January 2005 and June 30,2006.Those are the comps I asked my realtor find. I am also stating emphatically,that this window of time presents a massive data conflict,in relation to all the other comparable property values listed on the county website. Only viewing properties that come up on the radar,during the specified time period creates a situation of viewing the full neighborhood picture,with huge blinders on. There are a significant number of three bedroom two bath ranch houses with unfinished basements,on quarter acre lots in this area. In general,they are all very much the same.Yes,amenities will vary to a degree. For the most part all were built in the same time period and very similar construction techniques and materials.To my complete amazement,when exploring actual value prices on the weld county website,dollar amounts were all over the place. I found some properties in the$ 138,000 range. I also found some up into the$ 168,000 range. I know construction, I have been in construction and related fields for over twenty five years.My father has also been in construction for over forty years. I have toured through the neighborhood many times, I know what I am seeing when I look at these properties.They are all very,very similar in construction.On the other hand,these extreme variations in actual value prices are,not right.These kinds of inconsistencies in actual value assessments,for extremely similar three bedroom two bath ranch homes in my area,greatly troubles me. I absolutely believe a $ 13,128 increase on my property is extremely excessive. I have found a consistent set of examples that I believe are very important and relevant.Some were purchases before January 2005 and a couple even after June 2006.These examples are extremely important also,to help substantiate my belief,that an average actual value for my property is$ 149,000 and not$ 155,000. I have submitted examples each one is 3 beds,2 baths, in my area with actual value assessments from$ 142,982 to $ 151,789. I have done the best I could to find a consistent grouping of very comparable properties.This is why I am absolutely convinced the valuation of my property at$ 155,200 is without a doubt excessive.
