HomeMy WebLinkAbout20073488.tiff RESOLUTION RE: ACTION OF THE BOARD CONCERNING PETITION AND AUTHORIZE VACATION OF A PORTION OF COUNTY ROAD 103 BETWEEN COUNTY ROADS 122 AND 126 - MULTIPLE PETITIONERS WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to Colorado statute and the Weld County Home Rule Charter, is vested with the authority of administering the affairs of Weld County, Colorado, and WHEREAS, the Board has been presented with a Road Petition from Eugene and Sharon Hahn, 52701 County Road 124, Grover, Colorado 80729; Lonesome Pines Land and Cattle Company, LLC, c/o C.J."Jim"Sturrock, 50001 County Road 122, Grover, Colorado 80729;and the U.S. Department of Agriculture, Forest Service, Pawnee National Grassland, 666 O Street, Greeley, Colorado 80631, a copy of said petition being attached hereto and included by reference, requesting vacation of a portion of right-of-way for County Road 103 between County Roads 122 and 126, being more fully described as follows: The public road right-of-way lying 30 feet on either side of the section line between Sections 27 and 28, and between Sections 33 and 34, all in Township 11 North, Range 60 West of the 6th P.M., Weld County, Colorado. WHEREAS, the County Attorney's Office and Departments of Public Works have recommended denial of said request since that portion of right-of-way is needed for the welfare of the traveling public, and WHEREAS, the petitioners, being the adjacent property owners on both sides of the road right-of-way, have waived written notice of this hearing, and WHEREAS, the Board of County Commissioners heard testimony and reviewed all other evidence presented therein by staff and the public, and WHEREAS, the Board of County Commissioners deems it advisable to deny the request to vacate said portion of road right-of-way. NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Weld County, Colorado, that the Road Petition from Eugene and Sharon Hahn; Lonesome Pines Land and Cattle Compnay, LLC, c/o C.J. LLC C. J. (Jim) Sturrock Mgr Gentlemen of the board, I submit this petition for the following reasons. Fencing along this easement is of significant age requiring replacement with new material. Cost efficiency realization by each owner with placement of the fence along the property line. In addition, allowing grass utilization to property line the same as fallowed owners have enjoyed by planting to the line, leveling the playing field. On the north east of 28 and north west of 27 corners the fences corner post sits squarely on the sections survey marker. From this marker south Eugene Hahn's fence veers to the east upon reaching the south east of 28 and south west of 27 survey marker it is 30+/- feet east of said marker. Once the survey company of Cedar Creek Wind Farm has correct the discrepancies along the west line of 28, 33, and 4, 9 Tp 10 — range 60 with Drexel, Barrel & Co. surveyor for Lonesome Pines Land & Cattle Co. LLC I'll be able to furnish maps. As the saying goes, "good fences make for good neighbors." My goal is to replace all perimeter fencing. So far 6 3/4 miles completed leaving 4 1/2 to go not including adjoining neighbors portions. Both Eugene Hahn and David Wilson are on board leaving Kenneth Everitt and George Ehmke to commit. Wayne Roth may come back up the rope on his verbal commitment made last April, only time will tell. I fully realize the formal vacation by Weld of the right-of-way allowing construction of fencing along property lines does not interfere with the rights of adjoining property owners' access to their property. It is not my intent to land lock any parcel, but to up grade perimeter fence for the purpose of maintaining Lonesome Pines Land & Cattle Company's cattle on the correct side based on the Colorado fencing law. Eugene has talked to Wayne three times on the telphone and made numerous other calls to him leaving messages with no reply . When Eugene did talk to Wayne , Wayne said it really didn ' t make any difference to him what happened to the right of way , that he would rather not get involved in it and that he did not have time to fill out the form . Wayne owns the east , south z mile of the county right of way . Wayne ' s land(Parcel # 021534000005) is on the corner with WCR 122 on one side and WCR 105 on the other . On behalf of Penny Everitt who owns Section 21, and Kenneth Everitt who operates the section for grazing, Howard Foster who has a hunting lease for the Section as well as Wayne Roth, owner of the S1/2 of Section 34, they wish to protest any abandonment by the county. In addition,the Everitts wish to protest the obstruction of the easement by fencing, and would renew their request that the county grant them a license to use the right of way of CR 103. Mr. Everitt does farm for Wayne Roth. Weld County does have a building located on Section 21, and CR 103 would give the County access to their building. Access from CR 105 is not practical in the winter, as it is frequently drifted shut with snow, and it would involve opening right of way over CR's 126 or 128, whereas access via CR 103 has historically been what was used.
