Ward Living Trust 1568 Plum Court Brighton, CO 80601 Subject: USR-1385, Lot A of Recorded Exemption 2235; being Part of the SW4 NE4 of Section 31, T3N, R66W of the 6th P.M., Weld County, Colorado Dear Mr. Ward: Notice is hereby given that the property listed above, is not in compliance with USR-1385 (Special Use Permit).All conditions of the original permit must be in compliance by January 26,2007 or a Probable Cause public hearing, pursuant Chapter 23,Article 11(2), Division 4, Section 23-2-270 of the Weld County Code, will be scheduled. If the Probable Cause Hearing is scheduled,the purpose of this public hearing will be to review case number USR-1385, for compliance with the Development Standards, as approved by the Board of County Commissioners on June 26, 2002, to determine if probable cause exists to hold a hearing on revocation of the permit. Inspection by representatives of this office have determined that you are not in compliance with the following Development Standards: • There shall be no direct access onto State Highway 85. • The Use by Special Review area shall be limited to the plans shown hereon and governed by the Development Standards stated above and all applicable Weld County Regulations. Any material deviations from the plans and/or Development Standards as shown or stated above shall require the approval of an amendment to the Special Use Permit by the Planning Commission and the Board of County Commissioners before such changes from the plans and/or Development Standards shall be permitted. Camper tops are being stored outside the designated camper display area as indicated on the updated USR-1385 plat approved by the Department of Planning Services on March 11, 2005. Any other changes from the plans and/or Development Standards shall be filed in the office of the Department of Planning Services. If it is determined at the public hearing that there is probable cause that you are not in compliance with USR- 1385,the Board of County Commissioners will schedule a Show Cause public hearing to consider revocation of the Use by Special Review permit. Reference USR-1385 . Mr . Gathman , In regard to our phone conversation on Jan . 25 , 2.007 , thank you for your consideration and courtesy . As to the violation in regard to State Highway 85 access , emergency conditions or not , this gate shall never open again. It is currently chained and padlocked and will be replaced with a similar solid fence when weather permits , inviting no future violation , period . As to the storage issue , thank you once again for your courtesy as to your willingness to state specifics . Brighton,CO 80601-3642 Dear William M.Ward Living Trust' When the property located at 12524 County Road 25.5 adjacent to State Highway 85 at mile marker 248.576 went through the Weld County exemption process,the Colorado Department of Transportation(CDOT)participated in a referral process with Weld County regarding the parcel. In the referral process,CDOT mandated that the gated access onto State Highway 85 on the property be locked at all times,to prevent use of this access.The only authorized use of this access is for emergency service vehicles.CDOT has noticed this gate unlocked recently,as well as recent uses of this access. This unauthorized use of this access must cease immediately. Failure to do so will result in further action from CDOT.
