The Weld County Public Works Department has reviewed this proposal. This project falls primarily under the
purview of the Use by Special Review Standards, Weld County Code, Chapter 23, Article II, Division 4, Section
23. Our comments and requirements are as follows:
COMMENTS:
WCR 42 is a major arterial road, which requires a 140-foot right-of-way at full build out. There is presently a 60-
foot right-of-way. This road has been annexed and is being maintained by the Town of Johnstown. Pursuant to
the definition of SETBACK in the Weld County Zoning Ordinance (23-1-90), the required setback is measured
from the future right-of-way line. (Johnstown growth area)
ADT: WCR 42 between WCR 15 and WCR 17 has a recent traffic count reflecting 107 vehicles in a 72-hour
period. This count was taken in 2005.
QUIREMENTS:
Access: Utilize the existing gated access on WCR 42.
Off-street parking spaces including the access drive shall be surfaced with gravel and shall be graded to prevent
drainage problems.
Each parking space shall be equipped with wheel guards or curb blocks when necessary to prevent vehicles from
extending beyond the boundary of the space and from coming into contact with other vehicles, walls, fences or
planting.
Storm Water Drainage: The historical flow patterns and run-off amounts will be maintained on site in such a
manner that it will reasonably preserve the natural character of the area and prevent property damage of the type
generally attributed to run-off rate and velocity increases, diversions, concentration and/or unplanned ponding of
storm run-off.
The applicant must take into consideration storm water capture/quantity and provide accordingly for best
management practices.
The applicant shall berm the west side of the USR to channel the storm water to drain to the southwest corner of
the facility.
Dust Control: The Weld County Public Department recommends dust control on WCR 42 in front of the existing
raaidence for approximately 300 feet due to the heavy hauling associated with the semi-tractor trailer traffic
ociated with loading and off-loading facility. Dust control will be required twice a year or as needed
determined by the Weld County Public Works Motor Grader Division Supervisor.

1. Building permits shall be obtained prior to the construction of any building. .
2. A plan review is required for each building. Plans may require the wet stamp of a Colorado registered
architect or engineer.
3. Buildings shall conform to the requirements of the codes adopted by Weld County at the time of permit
application. The office trailer will most likely be classified as a B occupancy. The storage building will most
likely be classified as a S-2.
4. Buildings may require an engineered foundation based on a site-specific geotechnical report or an open
hole inspection performed by a Colorado registered engineer. Engineered foundations shall be designed by
a Colorado registered engineer.
5. Fire resistance of walls and openings, construction requirements, maximum building height and allowable
areas will be reviewed at the plan review. Setback and offset distances shall be determined by the Zoning
Ordinance.
6. Building height shall be measured in accordance with the adopted building code at the time of the building
permit application for the purpose of determining the maximum building size and height for various uses and
types of construction and to determine compliance with the Bulk Requirements from Chapter 23 of the Weld
County Code. Building height shall be measured in accordance with Chapter23 of the Weld County Code in
order to determine compliance with offset and setback requirements. Offset and setback requirements are
measured to the farthest projection from the building.
7. Provide letter of approval from Johnstown Fire Protection District prior to new construction.

Upon review of my case files and computer, an active Zoning Violation (VI-0600160)was noted. This
violation was initiated due to the operation of a"commercial landscaping sales and storage yard"facility
without the necessary Weld County Zoning permit. This case has not been presented to the Board of
County Commissioners through the Violation Hearing process.
This application if approved by the Board of County Commissioners will correct the violation. If this
application is denied, the business and all outdoor storage shall be removed within 30 (thirty) days of
denial or this case will be scheduled before the Board of County Commissioners to proceed through the
Violation Hearing process accordingly.

Environmental Health Services has reviewed this proposal for a mulch loading and
unloading facility-outdoor storage of mulch. We have no objections to the proposal,
however, we do recommend that the following conditions be part of any approval:
We recommend that the following requirements be met prior to allowing the plat to be
recorded:
1. The applicant shall submit evidence of an Air Pollution Emission Notice
(A.P.E.N.) and Emissions Permit application from the Air Pollution Control
Division (APCD), Colorado Department of Health and Environment. Alternately,
the applicant can provide written evidence that they are not subject to these
requirements.
2. The applicant shall submit a dust abatement plan for review and approval, to the
Environmental Health Services, Weld County Department of Public Health &
Environment.
3. An individual sewage disposal system is required for the office trailer. The
applicant shall submit an application from the Weld County Department of Public
Health and Environment. The septic system shall be installed according to the
Weld County Individual Sewage Disposal Regulations. The septic system is
required to be designed by a Colorado Registered Professional Engineer
according to the Weld County Individual Sewage Disposal Regulations.
4. The applicant shall provide current evidence that the facility has an adequate
water supply (i.e., well or community water system).
5. The applicant shall submit evidence of an Aboveground Storage Tank permit
from the Colorado Department of Labor and Employment (CDL&E), Oil
Inspection Section for any aboveground storage tanks located on the site.
Alternately, the applicant can provide evidence from the (CDL&E), Oil Inspection
Section that they are not subject to these requirements.
We recommend that the following requirements be incorporated into the permit as
conditions that must be met one month prior to operation:
1. A stormwater discharge permit may be required for a
development/redevelopment /construction site where a contiguous or non-
contiguous land disturbance is greater than or equal to one acre in area. Contact
the Water Quality Control Division of the Colorado Department of Public Health
and the Environment at www.cdphe.state.co.us/wq/PermitsUnit for more
information.
We recommend that the following requirements be incorporated into the permit as
development standards:
1. All liquid and solid wastes (as defined in the Solid Wastes Disposal Sites and
Facilities Act, 30-20-100.5, C.R.S., as amended) shall be stored and removed for
final disposal in a manner that protects against surface and groundwater
contamination.
2. No permanent disposal of wastes shall be permitted at this site. This is not
meant to include those wastes specifically excluded from the definition of a solid
waste in the Solid Wastes Disposal Sites and Facilities Act, 30-20-100.5, C.R.S.,
as amended.
3. Waste materials shall be handled, stored, and disposed in a manner that controls
fugitive dust, fugitive particulate emissions, blowing debris, and other potential
nuisance conditions.
4. The applicant shall comply with all provisions of the Underground and Above
Ground Storage Tank Regulations (7 CCR 1101-14).
5. Fugitive dust and fugitive particulate emissions shall be controlled on this site.
The facility shall be operated in accordance with the approved dust abatement
plan at all times.
6. This facility shall adhere to the maximum permissible noise levels allowed in the
Commercial Zone as delineated in 25-12-103 C.R.S., as amended.
7. Adequate handwashing and toilet facilities shall be provided for employees and
patrons of the facility.
8. Sewage disposal for the facility shall be by septic system. Any septic system
located on the property must comply with all provisions of the Weld County Code,
pertaining to Individual Sewage Disposal Systems.

9. The facility shall utilize the existing public water supply.
10.A permanent, adequate water supply shall be provided for drinking and sanitary
purposes.
11.The operation shall comply with all applicable rules and regulations of the State
and Federal agencies and the Weld County Code.

Re: Case Number USR 1566
Thank you for the referral. The property is located within the Johnstown Planning Area and is
within an area designated for urban residential development. The Stroh Farms (Pioneer Ridge)
single family neighborhood is located approximately one-half mile northeast, and is expanding
southward towards CR 42.
The Town has not received comments or complaints regarding the mulch unloading operation or
the truck traffic on the gravel road, presumably because the parcel and CR 42 is distant from
development. In the short term, the Town has no concerns with the use, except dust control is
needed on CR 42 extended to CR 17.
In the long term, the mulch facility will have a greater, adverse impact as residential land uses
move closer. Stroh Farms (Pioneer Ridge) residential development to the northeast is planned to
extend south to 42 in the next three to five years, and the developer will need to improve the one-
half mile segment of CR 42 west of CR 17. The Town will not want the heavy trucks on the road
section unless the operator or the County assists with an increase in the pavement specification.
The Town recommends that the Special Review Use be granted for a period of up to five years
and be extended (or not) subject to formal re-examination of impacts of the use on the
developing area around the site.
