I am not only the Agent, or"Tax Rep" as referred to by the Assessor, I am the owner's spouse and the subject property is my domicile. The form of title is for financial planning purposes only. In any event, two Authorization Appointing an Agent statements are enclosed. One was submitted with the original appeal and one for the Weld County Board of Equalization. I am also a Colorado licensed Certified General Appraiser and have been appraising real property since 1974. I am appealing the Assessor's decision denying our Protest of Real Property Value to the Weld County Board of Equalization. I request the 2007 Tax Year value be adjusted to $330,500.00. The reasons are as follows: 1. The assessor's method of valuing the land may be materially flawed as all lots on both sides of Hunters Cove Road (including the subject which faces Hunters Cove Road) are valued at $100,000.00 regardless of size or view. Please see Exhibit 1 which includes a map and assessed values of all lots which do not face WCR 7 or WCR 32 and are located on and/or adjacent to Hunters cove Road. No value adjustment has been made for size or location. The lot across from the subject, 262 Hunters Cove Drive, is adjacent Hunters Cove Road and has a lot size that is nearly one-half acre (approximately 20,473 sq. ft.) larger than the subject property. This is significant because horses and other hoofed animals are allowed in this neighborhood and the size of the lot reflects the amount of animals the Town of Mead allows on the property. All lots across from the subject on Hunters Cove Road (Addresses: 107, 109, 111, 113, 115, 117, 119, 121, 123, 125, 127, and 129) back to the Mulligan Reservoir. (See Exhibit 1) This reservoir is 90%to 100% full 365 days a year—even during the worst drought as in 2002. Apparently the Assessor has given no consideration to the view of the reservoir or the additional privacy. All lots being valued at$100,000.00 gives the appearance of each parcel not being valued separately. A picture of a typical view from a lot that backs to Mulligan Reservoir is included. (See Exhibit 2.) Since this will be scanned in black and white I will bring a color photo to the hearing. July 14, 2007—Page two I question weather this is in compliance with CRS 39-5-104. Valuation of property. This states: "Each tract or parcel of land and each town or city lot shall be separately appraised and valued, except when two or more adjoining tracts, parcels, or lots are owned by the same person, in which case the same may be appraised and valued either separately or collectively. When a single structure, used for a single purpose, is located on more than one town or city lot, the entire land area shall be appraised and valued as a single property." I believe this may be grounds to disqualify the Assessor's Notice of Denial, per se, and grant our Notice of Protest of Real Property Value. (Please see Exhibit 3 which is a copy of CRS 39-5-104.) 2. The primary reason for this Appeal to the Weld County Board of Equalization is the Assessor's value of$368,043.00 is not accurate. See the Notice of Protest of Real Property Value dated May 9, 2007 and delivered to Brenda Dones, Chief Deputy Appraiser, on May 16, 2007. This contains 36 pages which include a detailed and property specific analysis of the subject and comparable sales using appropriate adjustments. Marketing time and information from the MLS (Multiple Listing Service) which may not be available to the Assessor are also included. See Exhibit 4—all 36 pages. For your convenience I have also enclosed a list of all sales in Mead from January 1, 2005 through June 30, 2006 as reported by the Assessor's office. See Exhibit 5. The Competitive Market Analysis for 2007 Tax Purposes and supporting data(Exhibit 4) give significant support to our request for a 2007 Tax Year value of$330,500.00 and not the Assessor's value of$338,043.00. This hearing will be held at the Weld County Department of Planning Services, Conference Room, 918 10th Street, Greeley, Colorado. You have a right to attend this hearing and present evidence in support of your petition. The Weld County Assessor or his designee will be present. The Board will make its decision on the basis of the record made at the aforementioned hearing, as well as your petition, so it would be in your interest to have a representative present. If you plan to be represented by an agent or an attorney at your hearing, prior to the hearing you shall provide, in writing to the Clerk to the Board's Office, an authorization for the agent or attorney to represent you. If you do not choose to attend this hearing, a decision will still be made by the Board by the close of business on August 3, 2007, and mailed to you on or before August 10, 2007. Because of the volume of cases before the Board of Equalization, all cases shall be limited to 15 minutes. Also due to volume, cases cannot be rescheduled. It is imperative that you provide evidence to support your position. This may include evidence that similar homes in your area are valued less than yours or you are being assessed on improvements you do not have. Please note: The fact that your valuation has increased cannot be your sole basis of appeal. Without documented evidence as indicated above, the Board will have no choice but to deny your appeal.
