RE: APPROVAL OF RECORDED EXEMPTION NO. 542 - ALFRED J. PETERS
WHEREAS, the Board of County Commissioners of Weld County,
Colorado, pursuant to Colorado statute and the Weld County Home
Rule Charter, is vested with the authority of administering the
affairs of Weld County, Colorado, and
WHEREAS, it has been determined by the Board of County Com-
missioners at a public meeting held in the Chambers of the Board,
that the division into two parcels of land, as shown on the plat
known as Recorded Exemption No. 542, being the property of Alfred
J. Peters, described as part of the N1/2 SEa, Section 20, T5N,
R64W of the 6th P.M. , Weld County, Colorado, being more particu-
larly described in Exhibit "A" , attached hereto and incorporated
herein by reference, does not come within the purview of the
definition of the terms, "subdivision" and "subdivided land" ,
pursuant to its authority under Section 30-28-101 (10) (d) , CRS
1973, as amended.
NOW, THEREFORE, BE IT RESOLVED by the Board of County Com-
missioners that the hereinabove described parcel of land owned
by Alfred J. Peters, be, and hereby is, exempt from the definition
of the terms , "subdivision" and "subdivided land" .
BE IT FURTHER RESOLVED by the Board that this approval is
conditional upon sufficient easement for the Latham Ditch being
placed on the Recorded Exemption Plat and being accompanied by
a letter from the Latham Ditch Company.
The above and foregoing Resolution was, on motion duly made
and seconded, adopted by the following vote on the 31st day of
March, A.D. , 1982.

Re: Recorded Exemption #542
Dear Commissioners:
The attached letter and related materials are in reference to a request
for a recorded exemption from Alfred J. Peters. The property is described
as part of the N1 NE1, Section, T5N, R64W of the 6th P.M. , Weld County,
Colorado. The property is adjacent to the southwest edge of Kersey on
Weld County Road 541; north of Sandy Knolls Estates. The size of this
parcel is approximately 4.0 acres, more or less. The request is to split
the property into two parcels of 2.0 acres, more or less. The applicant
will continue to own parcel "A" which contains the existing improvements.
The unimproved parcel "B" would be sold at a later date.
Based upon the information in the adopted policies in the County, the
Department of Planning Services staff recommends the request be approved
for the following reasons:
1. The request complies with the subdivision requirements of
Section 9-2 C.
2. The request complies with Section 9-2 E. as follows:
- The 4.0 acres, more or less, under consideration has
low utility for agricultural use due to the small acreage
of the parcel. No reduction of agricultural land use
for production will occur.
- These facts support the proposal as being consistent with
the intent clause of the Agricultural district; the
proposed use being compatible with existing and surround-
ing land uses; the proposed use not being inconsistent
with efficient and orderly developments. The proposal
being in compliance with Section 1-3 of the Weld County
Subdivision Regulations; and the proposed land division
complying with the Weld County Comprehensive Plan.

- Weld County Road 541 would serve as the public road for this
proposal
- A letter from the Central Weld County Water District, dated
February 22, 1982, indicates the proposal will have an
adequate water supply.
- The proposal was reviewed by the town of Kersey, who had
no objections to this request. It is also in compliance
with Section 1-3 of the Weld County Subdivision Regulations
and the proposed land division complies with the Weld County
Comprehensive Plan; therefore, the proposed use is not
inconsistent with efficient and orderly developments.
- The proposal does not exist in an Overlay District Area.
- The proposed lots meet the minimum size requirements for
land division.
- A letter from the Weld County Health Department indicates
an adequate means for the disposal of sewage.
- The proposed lots are not part of a recorded exemption
within the last five (5) years.
CONDITIONAL STATEMENT:
Sufficient easement for the Latham Ditch be placed on the recorded exemp-
tion plat and be accompanied by a letter from the Latham Ditch Company.

To my knowledge the purpose and nature for this two acre (m/1 ) parcel
would be for a home and some livestock which I believe complies with the
surrounding area uses. Sandy Knolls which is located directly south of said
property and across Road 54; is zoned agricultural and divided into one acre
parcels. The area to the north is agricultural and zoned the same. This would
be orderly and consistent with the existing use.
The purpose for this proposed exemption is to utilize the ground. It
is now primarily waste, due to the fact that there is no irrigation water.
It is almost perfect to build a home on and have a few livestock, which
is consistent with the surrounding uses.
Attached is a map of the proposed exemption. Also enclosed is a copy of
the deed to this property which shows the exact legal description.

Dear Mr. Oxenfeld:
This letter is to inform you that the Planning Commission of the
Town of Kersey discussed the above mentioned recorded exemption
at their regular meeting held on February 10, 1982. Mr. Peters
was present at this meeting to explain his proposal to the
Planning Commission members.
Although this recorded exemption proposal does not conform to
our comprehensive plan, the Commission members voted to notify
the County that they have no objections to this proposal , since
the proposal does conform to the existing land use of other
parcels in the area .
