HomeMy WebLinkAbout20070657.tiff HEARING CERTIFICATION DOCKET NO. 2007-12 RE: CHANGE OF ZONE#1135 FROM THE A (AGRICULTURAL) ZONE DISTRICT TO THE E (ESTATE) ZONE DISTRICT - JASON AND LISA SLATER A public hearing was conducted on March 14, 2007, at 10:00 a.m., with the following present: Commissioner David E. Long, Chair Commissioner William H. Jerke, Pro-Tem - EXCUSED Commissioner William F. Garcia Commissioner Robert D. Masden Commissioner Douglas Rademacher Also present: Acting Clerk to the Board, Jenny VanEgdom Assistant County Attorney, Cyndy Giauque Planning Department representative, Hannah Hippely Health Department representative, Char Davis Public Works representative, Don Carroll The following business was transacted: I hereby certify that pursuant to a notice dated February 23, 2007,and duly published February 28, 2007, in the Fort Lupton Press, a public hearing was conducted to consider the request of Jason and Lisa Slater for a Change of Zone, CZ #1135, from the A (Agricultural) Zone District to the E(Estate)Zone District. Cyndy Giauque,Assistant County Attorney,made this a matter of record, and advised Jason Slater,applicant,that he has the option of continuing the matter to a date when the full Board will be present. However, if he decides to proceed today, it will require three affirmative votes,or in the case of a tie vote,CommissionerJerke will listen to the record and make the determining vote. Mr. Slater indicated he would like to proceed today. Hannah Hippely, Department of Planning Services,presented a brief summary of the proposal and entered the favorable recommendation of the Planning Commission into the record as written. She stated the site is located north of Weld County Road 86 and west of Weld County Road 19. She stated the surrounding properties are agricultural in nature,and staff received referrals from seven agencies. Char Davis, Department of Public Health and Environment,stated the existing residence on the site is served by a well and a septic system. She stated the applicants intend to complete the Resubdivision process for the creation of a new lot, and the new lot will be served by a water tap from the North Weld County Water District and a septic system. Don Carroll, Department of Public Works, stated the site is located north of State Highway 14, and is within the Black Hollow Acres Subdivision. He stated the site is accessed from Weld County Road 86. Mr.Slater stated his 30-acre property is located within the Black Hollow Acres Subdivision, and all the lots within the subdivision are between 10 and 60 acres in size. He further stated upon approval of the Change of Zone and the subsequent Resubdivision for the creation of an additional lot, he will construct a residence on the second lot, with a flagpole access to Weld County Road 86. No public testimony was offered concerning this matter. In response to Chair Long, Ms. Hippely stated the zoning of the property must be modified in order to consider a Resubdivision for the creation of an additional lot. She further stated this is the process that must be followed for older subdivisions with A(Agricultural) Zoning. In response to Commissioner Garcia, Mr.Slater stated the Weld County School District RE-4(Windsor area)has requested that the cash-in-lieu fee paid be a bit higher than typical, due to the impact from the proposed new lot. He further stated he understands that the cash-in-lieu fee will need to be paid to the District before the plat may be finalized. In response to Chair Long, Mr. Slater stated he has reviewed, and concurs with, the Conditions of Approval as proposed. Commissioner Masden moved to approve the request of Jason and Lisa Slater for a Change of Zone,CZ#1135,from the A(Agricultural)Zone District to the E(Estate)Zone District, based on the recommendations of the Planning staff and the Planning Commission, with the Conditions of Approval as entered into the record. The motion was seconded by Commissioner Rademacher, and it carried unanimously. There being no further discussion, the hearing was completed at 10:30 a.m. This Certification was approved on the 19th day of March 2007.
