RE: APPROVE CANCELLATION AND RELEASE OF COLLATERAL FOR SITE PLAN
REVIEW, SPR #403 - JAMES AND DONNA BRIENZA
WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to
Colorado statute and the Weld County Home Rule Charter, is vested with the authority of
administering the affairs of Weld County, Colorado, and
WHEREAS, by Resolution dated December 4, 2006, the Department of Planning Services
approved Site Plan Review, SPR #403, for James and Donna Brienza, 15350 Hanover Court,
Brighton, Colorado 80601, for a Plumbing Company on the following described real estate, to wit:
Part of the S1/2 of Section 31, Township 1 North,
Range 66 West of the 6th P.M., Weld County,
Colorado, and
WHEREAS, on June 18, 2007, the Board of County Commissioners of Weld County,
Colorado, approved an Improvements Agreement According to Policy Regarding Collateral for
Improvements (Private Road Maintenance), between the County of Weld, State of Colorado, by
and through the Board of County Commissioners of Weld County, and James and Donna Brienza
with terms and conditions being as stated in said agreement, and accepted check #2911, from
Empire Plumbing, Inc., P.O. Box 1194, Brighton, Colorado 80601, in the amount of$3,468.00,and
WHEREAS, it has been determined by the Board that the collateral being held by Weld
County is no longer necessary to secure said Improvements Agreement According to Policy
Regarding Collateral for Improvements (Private Road Maintenance)for James and Donna Brienza,
and
WHEREAS, staff from the Weld County Departments of Public Works and Planning
Services have conducted a visual inspection and recommend release of said collateral.
NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Weld
County, Colorado, that check#2911, from Empire Plumbing, Inc., in the amount of$3,468.00 be,
and hereby is, canceled and released.
BE IT FURTHER RESOLVED by the Board that the Clerk to the Board be, and hereby is,
directed to return said collateral to the appropriate issuing party.

SUBJECT: SPR-403
The Department of Planning Services received a letter from the applicant dated 10/18/07
indicating the improvements have been done on the site. Two site inspections on 10/24/07 and
10/26/07 by the Weld County Department of Public Works and the Planning Department
indicate all improvements have been completed.
The Department of Public Works and the Department of Planning Services is recommending
release of the collateral in the amount of three thousand four hundred sixty eight dollars
($3,468.00) for the on-site improvements.

Dear Ms. Martin:
The owner's have asked that I request a final review and release of their
collateral for the improvements required by SPR-403. At their own expense, they
had an inspection of the site by an independent engineer — Ken Hickey. Included
is a review of the site, inspection of required improvements and a letter of
completion.
Please review this for final acceptance, so the collateral can be returned in a
timely manner. Thanks for your attention in this matter.

(SPR-403) today and determined the following items still need to be done prior the release
of the collateral: the addition of 7 curb stops and an ADA sign. The property owner was
on site and was informed of these items. Let me know if you have any other questions.

Michelle -thanks for updating me! I did talk to Mr. Brienza and he said that as soon as you gave him the final
items - he purchased and installed the parking blocks and ADA sign. Also, he stated that a photo was not
appropriate and that a re-inspection was required.
On behalf of the Brienza's -a re-inspection is requested, so the collateral can be released.
If there is anything I can do from here, since I'm in Brighton, let me know....
