WHEREAS,the Board of County Commissioners of Weld County, Colorado, pursuant to
Colorado statute and the Weld County Home Rule Charter, is vested with the authority of
administering the affairs of Weld County, Colorado, and
WHEREAS,James Anderson,3528 County Road 28,Longmont,Colorado 80504,c/o Todd
Hodges Design, LLC, 1269 North Cleveland Avenue,Loveland,Colorado 80537,has presented to
the Board of County Commissioners an application for a Permit for Temporary Assembly on land
within the unincorporated portion of the County of Weld, State of Colorado,to be held from 10:00
a.m.until 11:00 p.m.,on September 22-23,and 28-30,and October 5-7, 12-14, 15-17, 19-21,22-24,
and 26-28, 2007, on property described as follows:

further described as a part of Section 32,Township 2
North, Range 68 West of the 6th P.M.,Weld County,
Colorado
WHEREAS,said applicant has paid Weld County the sum of ONE-HUNDRED DOLLARS
($100.00)for said Weld County Permit for Temporary Assembly, and
WHEREAS, having examined said application, the Board deems it appropriate to grant a
Weld County Permit for Temporary Assembly to James Anderson, and
WHEREAS,said permit shall be issued subject to compliance with the terms and conditions
as set forth in the application materials and upon the express condition and agreement that the
temporary assemblage will be conducted in strict conformity to all laws of the State of Colorado,and
WHEREAS,any violation to said terms and conditions shall be cause for revocation of said
permit and forfeiture of bond.
NOW,THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Weld
County,Colorado,that said Weld County Permit for Temporary Assembly on September22-23,and
28-30, and October 5-7, 12-14, 15-17, 19-21,22-24,and 26-28, 2007, be,and hereby is, granted
to James Anderson to conduct a temporary assemblage at the hereinabove described location.

taken this 5th day of September, 2007, IT IS HEREBY GRANTED a permit for a temporary
assemblage on land within the unincorporated portion of the County of Weld,State of Colorado,to
be held from 10:00 a.m.until 11:00 p.m.,on September22-23,and 28-30,and October 5-7, 12-14,

2. Nature or purposes of the assembly: Development Standard #20 of USR-1232 indicates,
"The applicant must obtain a Temporary Assemblage Permit in compliance with
Ordinance#85 for any activity including more than 489 participants at any one time,providing
no overnight camping is authorized by this Development Standard." This request is for a
maximum of 10,000 persons per day during September 22—November 1, 2007.
3. Dates and hours during which the assembly is to be held: September 22 — November 1,
2007. Staff arrives at 7 a.m. The site is open to the public from 10 a.m. — 11 p.m. The last
staff may leave at 1 a.m.
4. Maximum number of persons to be allowed at assembly at any one time:
10,000 persons daily over a 13-hour period of time.
5. The maximum number of tickets to be sold, if any: The maximum number of tickets sold in
one day was 8,000.
6. Identify plans to limit number of persons to the maximum identified above: Sale of entrance
tickets. The last ticket sale is at 9:45 p.m.

7. Identify plans for supplying potable (drinking) water, including the source, number, and
location of facilities, and type and means of disposing of waste deposited: Bottled water is
sold on site. Patrons are allowed to bring non-alcoholic beverages on site. Waste
generated on site includes snack food wrappers as well as plastic and aluminum bottles.
Waste is collected in garage cans located on site and collected at least every 48 hours by a
contracted service provider. Please see contract for providers (2006) enclosed.
8. Identify the plans for holding, collecting, and disposing of solid waste materials: See
response above. Any waste generated will be collected and hauled away. Please see the
2006 contract enclosed.
9. Identify the plans for providing separate toilet facilities for males and females, including the
source, number, and location,type and the means of disposing of wastes deposited: There
is one enclosed restroom for women and one for men in the Concessions Building. The
men's restroom has a urinal and a toilet with hand-washing facilities. The women's restroom
has two toilet stalls and hand-washing facilities. Port-A-Lets are provided. Please see
contract for the provider (2006) enclosed. The Port-A-Lets are cleaned once a day by the
contract company.
10. Identify the plans to provide for medical facilities, including the location and construction of
any structures, the names, addresses, and hours of availability of emergency medical
technicians and nurses and provisions for emergency ambulance service: The First Aid
center is located near the site entrance. During high-use times, private security personnel
are on site. At least one EMT is employed as a first responder to all emergencies. One or
more employees are trained as EMT. Through the USR process, the Weld County
Ambulance, Sheriffs Department and Fire Protection District reviewed our plans. We would
be happy to provide each emergency responder a set of plans.
11. Identify the plans, if any,to illuminate the location of the assembly, including the source and
amount of power, and the location of lamps: Illumination for the parking lot is achieved by
lights attached to existing poles. These lights do not spill onto adjacent properties.
Additional on-site lighting is placed on the property and illuminates congregation areas.
12. Identify the plans for parking vehicles, including size and location of lots, points of highway
access and interior roads, including routes between highway access and parking lots: An
existing one-acre gravel parking lot is located in the southwestern portion of the property.
This area can accommodate anticipated numbers of vehicles. In the event more space is
needed, an additional 15 acres can accommodate overflow parking. This sandy area is a
hay field and is compacted by repetitious farming. Traffic comes from Weld County Road
3.25 to access the parking lot. Internal traffic circulation is not necessary as the parking lot
is the port of entry for the site entertainment. At busy times, we do have 6 employees
working in the parking lot to manage traffic flow.
13. Identify the plans for communications with hospital, police, and fire services, including the
source, amount, and location of communication equipment: I keep a cell phone or walkie-
talkie with me at all times. In addition, all employees are outfitted with communication
devices. The private security personnel are also equipped with communication devices.
The First Aid Station, the Ticket Booth and the Concessions Building have communication
devices. In the event of an emergency, a mobile mega phone is used.
14. Identify the plans for camping facilities, if any: Not Applicable.
15. Identify the plans for fire protection: We are currently in Mountain View Fire Protection
District. I regularly meet with LuAnn Penfold, Fire Marshall. She, or her staff members,
have been on site often. I have completed her requests and we have passed all inspections.
Please see most recent inspection notice of compliance attached.
16. Identify the plans for security, including the number of guards,their deployment,their names,
addresses, credentials and hours of availability and description of peer group control, if any:
Private security services are contracted through Delta Security. Please see contract for
services from 2006 enclosed.
17. Identify the plans for sound control and sound amplification, if any, including number,
location, and power of amplifiers and speakers: Station-specific music is located int he
outdoor haunted activity. All other communication is achieved by walkie-talkie/cell phones.
In the event of an emergency, a mobile mega phone is also used. In the event of an
emergency, such as the need for emergency evacuation, an air horn is used to get patrons
attention.
18. If applicable, identify plans for meeting County health standards for food concessions and
concessionaires who will be allowed to operate on the grounds, including the names and
addresses of all concessionaires and their license permit numbers:
I am the only concessionaire and am in the process of updating my permit with Weld County
Health Department.
19. Identify the plans, if any, for an electrical system: Electric power exists on site.
20. Identify the plans to ensure that trees, underbrush, large rocks, and other natural features
shall be left intact and undisturbed, and natural vegetative cover retained, protected and
maintained so as to facilitate drainage, prevent erosion, and preserve the scenic attributes;
and the plans to abate dust on the site: Vegetation such as the corn stubble in the corn
maze and pumpkin vines in the pumpkin fields may be damaged. However,these areas are
replanted to corn and pumpkins each year. The overflow parking area may be trampled
upon. This 15-acre area is a hay field and is replanted each year.
21. Attach a statement by a bonding company licensed to do business in the State of Colorado
indicating its intent to furnish a bond required in Section 12-1-30.B.13 of the Weld County
Code to ensure performance by the applicant of each of the terms and conditions of the
temporary assemblage permit.
22. Attach a statement by an insurance company licensed to do business in the State of
Colorado stating its intent to provide liability insurance, as required by Section 12-1-30.B.14
of the Weld County Code, to protect against injury to persons or property occurring as a
result of such an assembly.
23. Submit$100.00 fee for each event where three-hundred fifty(350)or more people assemble
or can reasonably by anticipated to assemble at any one(1)location, unless the location is
properly zoned for such assembly, in which case one permit shall be required for the total
number of events scheduled for that location for the reminder of the calendar year, not to
exceed ten (10) events per year. As used herein, the term event means an assembly or
anticipated assembly which is scheduled to last for three (3) consecutive days or less.

CONTAINER SERVICE TERMS AND CONDITIONS
TERM. This Agreement is for a term of three years and shall be renewed for successive three-year terms without further action by the parties,but may be terminated at the end of any
three-year term by either of the parties by giving 60 days prior written notice of termination(sent certified mail)to the other. Western Disposal Services,Inc.(hereinafter referred to as the
Contractor)agrees that if Customer no longer requires any collection,disposal,recycling or processing services due to discontinuance of its business within the area in which Contractor
provides collection service,Customer may terminate this Agreement upon written notice to the Contractor at least 30 days prior to the intended termination date,but only upon payment of
all amounts then due Contractor. In the event that any payment is not made by the last day of the month in which billing is rendered,Contractor may terminate this Agreement upon notice
to Customer,recover any of Contractor's equipment on Customer's property and recover liquidated damages as described below.
CHARGES. Customer will pay the Contractor on a monthly basis for the collection and disposal,recycling and processing services provided by the Contractor in accordance with the
scheduled charges shown above. Changes in the schedule of charges,frequency of collection service,number,capacity and type of equipment may be agreed to orally or in writing by the
parties. Consent to changes shall be evidenced by the actions and practices of the parties. Contractor may adjust the charges from time to time upon 30 days notice prior to the
adjustment to reflect increases in the Consumer Price Index and other reasonable increases,including but not limited to landfill costs,recyclables processing costs,fuel costs,increases in
the weight per container yard of the customer's materials and operational costs due to government regulations. The Customer will be responsible for all taxes,fees,or other charges,
including any increases,imposed by federal,state or local laws and regulations on or related to the collection,transportation,recycling,processing or disposal of Customer's waste and the
services performed by the Contractor under this Agreement. Customer will provide clear access to all containers on collection days(this includes snow accumulations). If any container is
blocked so as to prevent a pickup,pickup will not be made. Any returns in attempting to pick up will be charged as an"extra pickup"for dumpsters. Customer will be responsible to pay
for any additional volume of waste collected and other accumulated items which are not placed within the container(s)provided.
PAYMENT and LATE CHARGES. Payment is due in full by the twentieth of the month in which billing is rendered. Contractor may charge and Customer agrees to pay a late fee for all
past due payments as follows: $1.00 per rebilling or 11/2 percent interest per month on past due balance,whichever is greater. Customer agrees to pay a$25.00 handling charge for
checks retumed.
EXCLUSIVE RIGHT TO PROVIDE SERVICES. Customer agrees not to contract with,or permit,any person or entity other than Contractor to remove,dispose of,processor recycle its
waste,during the period that this contract is in effect. Violation of this provision shall constitute a material breach of this Agreement.
LIQUIDATED DAMAGES. In case of breach by Customer,Customer agrees to pay the Contractor as liquidated damages and not as a penalty a sum equal to 75%of the entire
remaining balance of the contract,which amount Customer agrees to be a reasonable estimate of Contractor's damages.
WASTE DEFINED. "Waste"shall include all solid wastes,including all compostable and recyclable materials,but excluding liquids and biosolids. Customer warrants that waste delivered
to Contractor hereunder will not contain any hazardous or toxic waste as defined by local,state or federal laws or regulations.
RESPONSIBILITY FOR EQUIPMENT. Customer acknowledges that it has the care,custody and control of the equipment provided by Contractor and accepts responsibility for the
equipment and its contents except when it is being physically handled by employees of the Contractor. Therefore,Customer expressly agrees that Customer will be responsible for the
safekeeping of the equipment,including without limitation blocking or anchoring to withstand wind,vandals,and other conditions,and for the condition of the location(s)and approaches
thereto,and shall insure that the containers are located upon a hard,level,weather-resistant surface. Customer accepts responsibility for the safe use of the equipment by Customer and
those it authorizes to load waste therein,Customer agrees to defend,hold harmless and indemnify Contractor against all claims,lawsuits,and any other liability for injury to persons or
damage to property or the environment connected with or arising out of Customer's (including Customer's employees and agents)use of the equipment or breach of any warranty or
obligation in this Agreement by Customer. All equipment fumished by the Contractor for use by the Customer which the Customer has not purchased shall remain the property of the
Contractor and the Customer will have no right,title or interest in the equipment. Customer agrees to notify Contractor should the equipment become damaged or unsafe for any reason.
If Customer,directly or indirectly,permits Contractor's equipment to be modified,altered,damaged,made deliberately inaccessible to Contractor,removed,hidden,stored or otherwise
maliciously interfered with,Customer shall pay for all damage,loss of use,storage fees,delivery costs,and attorney's fees in regaining possession of the equipment and restoring it to its
normal working condition.
WEIGHT and LOADING OF CONTAINERS. Customer will not exceed weight limit of containers and if exceeded will be responsible for unloading dumpsters to lift weight. Customer
agrees not to fill a dumpster more than one-third full with material such as dirt,concrete,brick,gravel,and earthen debris which will reach the weight limit of the container. Customer
agrees to only load containers level with the top of the container. Customer will be responsible for additional costs incurred if containers are overfilled.
DRIVEWAYS and PARKING AREAS. Contractor shall not be responsible for damage to Customer's pavement or other driving surfaces resulting from the weight of Contractor's
vehicles.
ASSIGNMENT. This Agreement shall be binding on the parties and their successors and assigns.
This is a legally binding contract,and Contractor agrees to provide and Customer agrees to accept the services and equipment at the charges and frequency of collection indicated above
subject to the terms and conditions specified in this Agreement. The parties agree that the venue for any dispute relating to this Agreement shall be in the Small Claims,County Court,or
District Court,Boulder County,Colorado,and the parties consent to the jurisdiction of such courts. The parties expressly waive their right to demand a trial by jury. Customer agrees that
Contractor hall be entitled to recover from Customer all of Contractor's attorneys'fees and costs that Contractor incurs in enforcing this Agreement.

In response to your request, Environmental Health Services has reviewed the Temporary
Assembly Permit, LC0022, for Jim Aderson, dba aMAIZEing Farm Events, LLC, located
at 6728 WCR 3 %,Erie, Colorado.
Dan Joseph contacted Brenda Anderson on August 22,2007 and discussed what facilities
were going to be made available during the event. She stated that 14 portable toilets would
be supplied during the days listed on the application. The Department has determined that
this should be a sufficient number of portable toilets for the event. However, Brenda
Anderson stated that there were no portable hand washing stations available for the
portable toilets. The Department recommends that 1 portable hand washing station be
made available for every two portable toilets in use.
In addition, the Department also recommends placing at least one portable hand washing
at the following locations: the animal petting area, picnic area for guests, and near the
kiddie koral (note: hand sanitizer may be used in addition to hand washing, but should not
replace hand washing).
Dan Joseph also discussed food operations with Brenda Anderson. She stated that they will
provide refrigerated trucks to ensure that they have enough capacity for the amount of
people that they are expecting. She also stated that no cooking would be done outside the
kitchen area. The Department has determined that this should be sufficient to ensure
proper temperatures are maintained during the event. In the event that this is not enough
refrigeration, then addition units must be obtained or the menu limited.
