We are long time members of the Eaton Country Club and also have family living in the Hawk Stone Community. Current growth patterns in the area would certainly indicate that the city of Eaton, Colorado is ready to expand on both sides of the country club. A dairy located in the vicinity could only prohibit such growth, as well as be detrimental to the golf course. Please give this plan careful consideration, and totally abandon such a venture. Our opposition is two-fold. First, we live one and one- half miles south and currently experience detrimental effects from the cattle feeding operations in the vicinity of the proposed dairy. If this dairy were allowed to be built, we believe it would seriously impact the value of our property. The area adjacent to our property on the south is residential (Hawkstone Subdivision) and would also be adversely impacted. Further it is our understanding future residential development is planned to the east of WCR 39 between WCR 76 and WCR 78 which would also be adversely impacted by the proposed dairy. It is one thing to have to endure the detrimental impact of cattle feeding operations that already exist. But to allow a dairy to become the neighbor of a residential community is reprehensible and should not be allowed. Our additional opposition is as members of the Eaton Country Club. I play golf 2 or 3 times a week and know it will not be an enjoyable environment because of the increased odor and insect problems inherent with dairy operations. It is marginally acceptable with the current cattle feeding operations to the north when the wind is from the north as it is many days. For these reasons we would ask that this request be denied. I am a resident of the Hawkstone community,just to the south of the proposed dairy site. We chose to purchase a home in this area, in part, because of the rural setting. However, placing a livestock facility of this magnitude so near an established residential area seems inappropriate and incompatible. I have very serious concerns that this will impact the value of my home, as no one will want to live in a neighborhood plagued with the problems such a massive dairy can cause. If you have ever been around a dairy farm, you know about the overwhelming number of flies. This may seem like a diminutive issue, but the cumulative effect of their waste is atrocious (and very difficult to clean)not to mention a serious health concern, both from the diseases the insects carry themselves as well as the pesticides needed to keep them under control! Furthermore, we would have to face other problems such as water and air pollution, detestable odor, dust and extensive truck traffic. None of these conditions are conducive to raising a family, as many of us in the Hawkstone community are trying to do. Had we known we would be moving in to a situation where our health and comfort would be traded for filth and stench, I assure you we would have built a home elsewhere. Please do not put my community in jeopardy. Weld County should not mix land uses in this way. Placing a dairy of this size so near a growing neighborhood is inappropriate and wrong. The concerns that we have are as follows: 1. The planning commission has approved several residential sites within close proximity to where the proposed dairy is going to be placed. The planning commission has also approved a site for a church to be placed within about 1 mile of the proposed dairy site. Does Weld County have a Comprehensive Plan for this area and if so, does it make sense to allow an 8,000 head dairy to be located so close to these new residential lots,the Eaton Country Club and the Town of Eaton's Hawkstone residential subdivision? 2. Weld County Road 39 is a highly traveled road. Although we understand that there was a traffic count, it was taken in June, at a slow time of the year. There is sugar beet dump located across WCR 39 to the west which creates an enormous amount of traffic. There are several months during the year that there is a lot of traffic, especially during harvest. We do not believe that the road or the bridges would be able to handle the several thousands of trucks per year that will be going in and out of this dairy. There are many residential accesses to WCR 39, as well as 2 major residential subdivisions, and the main entrance to the Eaton County Club. We believe that the increase in traffic would be unsafe for the people that live and drive this road. 3. There are already several (at least 4) feedlots within about a 1 mile radius of the proposed dairy site. Each of these feedlots are already feeding several thousand head of livestock. Weld County has made no attempt or at least no progress in the last several years to deal with the severe dust problems, fly problems or odor problems that these existing facilities create. To approve this special use permit would just exponentially multiply these problems. We would encourage the Planning Commission to not approve this application for the Site Specific Development Plan and Special Review Permit. At the very least, the Planning Commission should not approve this permit until the applicants comply with all of the requirements are met and specify in detail how the fly problems, dust problems, odor problems and ground water contamination will be dealt with. For them to say that they will deal with these issues"per existing industry practices" is too vague. We understand that Weld County is a"right to farm" county. That is one of the reasons we live here. We are not opposed to the dairy locating in Weld County, however this is a poor choice for a location. Just because this is a"right to farm" county does not mean that there should be a blatant disregard for the existing neighbors and future growth of this area. My wife and I strongly object to the placement and location of the proposed dairy on grounds that it does not fit with the comprehensive plan for this area and it will adversely impact the surrounding residents/landowners. Specifically, I am concerned about the proposed dairy's impact on traffic, dust, flies, mosquitoes, likelihood of diseases (West Nile Virus, Mad Cow, etc.), odors (manure, effluent, compost dead rotting carcasses, spoiled milk, etc.), contamination of air and groundwater, noise (planning to operate 24 hours a day 7days a week 365 days a year) and its visual effect. Enclosed you will find an aerial map of the area surrounding the Subject Property, which shows surrounding properties, homes, residential subdivisions, the Eaton Country Club and towns of Eaton and Ault. As you can see from the map,the land owners that share common property lines with the Subject Property, and that would be most effected by this operation is ours (Skyberg) located on the west side of the Subject Property, and the Martins, located on the east side of the Subject Property. The Martins submitted a letter of opposition to this operation on November 20, 2006. The fact that we never received the required notice, explains the late date in which we have submitted this letter. The previous land owner, Neal Eskstrum, who owned this property for over 12 years and who sub-divided and sold small sections to several of the neighbors, including our property, respected all of the surrounding property owners and felt very strongly that a dairy operation or feedlot operation developed on the Subject Property, between Skyberg and Martin, would be too close to the adjacent property owners. Neal felt so strongly about this that, when approached by the DeHaan's, he took steps to ensure that his property would not be sold to them. He ended up selling the property to Todd Bean with the understanding that Mr. Bean would develop some of the property into larger(5 to 20 acre) country homesteads with the remainder to likely be farmed as is has always been. We also researched the area and found that nearby Eaton's comprehensive plan for this area was to add residential growth both in subdivisions (Hawkstone & others) and in larger (5 to 10 acre) country estates, that at the time were, and still are today continuing to be developed. Generally speaking, residential growth in Northern Colorado is moving toward the north and east. The other compelling reason we decided to settle in this area is the close proximity to the Eaton Country Club and the plans that adjacent landowners had with plans to build nice country homes in the area and/or sub-divide their property to sell to other families desiring to move into the area and enjoy the relaxed, country-style living. The property values of all of the surrounding properties, especially those directly adjacent to the Subject Property would plummet, if this operation were allowed to take place. Nobody wants to live within 500 feet, let alone a mile (Hawkstone is 1 mile south) of 8,000 concentrated head of dairy cattle. Also, with the massive invasion of insects (specifically flies and mosquitoes), the property adjacent to and sharing a common property line with the Subject Property, would become virtually worthless. The developed properties adjacent to the Subject Property are currently valued around $500,000 to$750,000. The Subject Property falls within the City of Ault's jurisdiction and will, in the future, be annexed by Ault. The City of Ault is in strong opposition to this proposed dairy operation. The parts of the application that I have seen so far, only vaguely and in generalities, address the issues required to be addressed by Weld County Planning and that will have major impact to the surrounding property owners and community. The application references and contains bulletins from CSU, but does not address specifics for the Subject Property. The measures required to be performed at one property will not necessarily work for a different property. The plans for this property must be specific as to how each issue will be addressed. Based upon this fact, the application must be denied. The following issues need to be specifically addressed and clarified as to how this operation effects the Subject Property and surrounding properties: 1. Environmental impacts a. Potable water supply. How much water will be required for a dairy of this size? North Weld County Water does not have the resources to supply this huge water requirement. The plan calls for a commercial well, but this makes no sense, given the domestic wells that already exist in the area and the drought conditions that exist in Northern Colorado. How much water will the commercial well be allowed to supply? I understand their"plan" is to abandon 5 existing wells that are not in use (although I believe these are being used) on the property and swap them for an industrial well. When the irrigation pond in the southwest comer of the property was put in the 5 wells were already swapped for this irrigation pond and so shouldn't these 5 wells be abandoned? If so, is this not a violation? b. Contaminated ground water and run off. Our entire area, including the Subject Property, has a stratum of hard shale 5' to 15' below the surface. How will the manure and urine from the cattle be controlled so as not to contaminate the ground water in the area? No matter what measures are taken, practically speaking, the ground water will eventually become contaminated. What effect will this have on the neighbors who have domestic wells? Some of the local residents have already experienced contaminated run off from neighboring feed lots that have only a few hundred head of cattle. What amount of run off can be expected from 8,000 head of cattle? How will this run off be controlled since there is a stratum of shale 5' to 15' below surface? Once this contamination hits the shale, it will sheet flow to the neighboring properties. This cannot be guaranteed! c. Air pollution. The massive amount of manure and urine that will be created from the cattle, the inevitable stench from rotting dead cattle carcasses, sour and rotting milk, compost piles, silage, air pollution from truck and 18-wheel semi traffic, air pollution from all of the pesticides, storage ponds required to control the raw water sewage, etc. will create an unbearable odor. The prevailing winds are from the north and northwest. This odor will absolutely saturate the interior all homes, clothing, etc. that are within a % mile radius. Also, since the City of Eaton, Hawkstone subdivision, Eaton Country Club, and other estates are due south and southeast of the Subject Property, the stench will overpower these homes, businesses and communities. How does the applicant address this major issue? This air pollution cannot be eliminated or controlled. This is one of the primary reasons we feel that a dairy does not belong on this property or the surrounding area. d. Noise pollution. This facility is planning to be in operation 24 hours a day, 7 days a week, 365 days a year and so this constant activity will create a substantial amount of noise. What maximum db noise level will be required for this operation and who will enforce this requirement? Contributing factors for the noise will be 8,000 head of dairy cows making noise all day and night, employees, heavy truck and 18-wheel semi traffic, milking and processing machines operating 24 hours a day, tractors, ATV's, pickup trucks and other machinery required to support an operation of this size, backup electrical generators. e. Light Pollution. We are not aware of any dark sky ordinances in place for Weld County, which leaves the door wide open to an unrestricted amount of light for this dairy and the resulting light pollution to adjacent public roadways, the neighboring properties and surrounding communities. A massive amount of lighting will be required to keep the cattle awake 18 hours a day for feeding and milking. How has the applicant addressed this issue? What specific measures will be taken to control this contamination? What maximum foot-candle lighting restriction and glare control will Weld County enforce for this operation to ensure that light pollution does not adversely effect the surrounding neighbors and the Eaton Country Club? How will the applicant comply with these restrictions? 2. How will the electric power requirements be met? Reliability of the electricity in the area is very low, with flickers and power outages taking place dozens of times each year. How will this operation deal with this issue? Will there be on-site backup generators to feed the load when there are power outages? If so, how will this noise be controlled? 3. How does Weld County plan to address the massive increase in heavy truck and 18- wheel semi traffic along both paved and gravel roads? How will Weld County address these trucks turning across double-yellow lines? How will Weld County address the safety concerns that this increase in traffic will obviously have upon the current residents and children in the area? 4. Flies, mosquitoes and other insects will be a major problem. The storage ponds required to control the raw water sewage will but will also be a breeding ground for mosquitoes. How will each of these pests be controlled? Does the applicant plan to use pesticides and poisons to try and control the insects, further contaminating the air, soil and water? No matter what form of control that is used, the flies cannot be controlled. These pests will absolutely fill the homes of the surrounding neighbors and will be a continual problem for outdoor animals and people working and playing outdoors. 5. The increased risk of West Nile virus, mad cow disease, hoof-and-mouth disease, e-coli and other related diseases is a real concern for our community. How will these items be controlled to ensure that our families, children, pets and animals remain safe from this increased threat? If the Planning Commission approves this and the dairy becomes operational, how will those of us who are financially impacted by this (such as in decreased property value), be fairly compensated for our losses? It is clear that the applicant has not considered the impact this will have on all of us. It appears that the applicant is not at all concerned about the neighbors, likely because the applicant has no intention of making this their home. They did not have enough respect for the neighbors nearby this property to discuss their plans or the size of this operation with us ahead of time. The applicant has no intentions of building a home on this property and obviously this is purely a business driven proposition. The applicant has not given any thought (or even seems to care) about how this will effect the existing surrounding community or the future plans for this area. The direction that this area has been heading in over the last several years is multiple acre lots for residents that want to live in the country; and live the quite life. This type and massive size of operation is NOT in the best interest of the City of Ault, City of Eaton, the nearby Hawkstone and other area subdivisions, the Eaton Country Club, the property owners directly adjacent to the Subject Property and all of the area farmers and ranchers. This type and size of operation, if allowed to proceed, would have devastating effects on the health, commerce, and lives of every individual living within several mile of the Subject Property as well as the members and business of the Eaton Country Club. Due to the fact that: 1) All of the issues that are required by Weld County Planning to be addressed in the application have not been fully and specifically addressed in detail but rather have only been discussed in vague generalities, 2) This operation does not blend with the comprehensive plan and the residential growth that has been taking place for several years in this area, and 3) The overwhelming lack of support shown by all of the surrounding neighbors; The Planning Commission must deny this request for a special use permit for a livestock confinement operation consisting of 8,000 head of dairy cattle. The Planning and County Commissioners have the duty to not only ensure that this operation conforms to all of Weld County's requirements, but most importantly to represent what is in the best interest of the community in this area. I'm a farmer and livestock producer. This request is simply not in the right place. It is too close to the Towns of Eaton and Ault. We have significant development occurring all around the area. I'm sure the applicants will make the case of what the dairy will bring economically to help our community. The simple fact is that our agricultural community is rapidly disappearing. The cities are buying the farms for the water and drying them up. The cities are bringing their sludge and waste to be spread on the remaining acres. This Dairy does not have an excessive supply of feed. A significant portion will be shipped in from outside of Weld County. The waste, however,will all need to be dealt with here. It is already a problem for area feeders and dairies,this request will make it a huge problem. Where does the 6,900 acres of land they need spread manure come from? Their request has all of the cute little bulletins from CSU but no specifics as to where the waste will be spread. I have been involved in Agriculture my whole life and I know, for a fact,that dairies generate flies,odor and dust. They will tell you about the control measures but why do you think that none of the owners will live here,or for that matter none of their employees. When you pile 138,430 tons of manure you are going to have flies and odor for miles in each direction. There is nothing wrong with a dairy, what is wrong is where the DeHann's are trying to put this one. The new dairy model is once you get run out of one place by development you just relocate to the next area where you will be consumed by growth in 10 years. This is a bad location for a dairy; the facility is being built on top of shale and there is no where for the run off to go other than to contaminate the ground water. From the application,the water supply is not at all clear. What is the amount of water required to run the dairy of this magnitude? The plan calls for the establishment of a commercial well permit and how much water is that request seeking? At the present time,the existing permits for cattle are by no means at there upper limit. If you were to grant the DeHann request there would be a concentration of around 15,000 to 16,000 head of cattle bordering each other. In addition,there is a special use permit for the Beet Dump used for the collection and storage of area sugar beet production right in the middle of it all. How does this concentration fit the comprehensive growth plan for the area? 3. I have serious concerns about the massive increase in traffic if the request for the additional cattle is approved. I have discussed my concerns with the Weld County Road and Bridge Department. It was indicated that the present level of traffic is fairly high for a county road. It should be noted that the traffic count did not occur during peak harvest season when the trucks are running in all directions. It should also be factored in that the existing special use permits are operating at about one half of their entitled use. We currently have a large volume of truck traffic already. I use WCR 39 daily and the bridge south of Highway 14 on WCR 39 is extremely narrow. I am not sure there is room for two semi trucks to meet on that bridge. The application does not accurately reflect the amount of increased vehicle activity. I would ask that the Planning Commission review that part of the application. In Agriculture everything happens at the same time. When one farmer is harvesting so is everyone else. The seasons also dictate what our actions are. We are unable during the growing season or during the harvest season to remove manure. The fact that we can only spread manure during the winter months compresses everything. It is too much activity in a very short time. 4. There is already a problem with dust, odor and flies. At this point everyone within the neighborhood accepts that the feedlots were here first. That is not the case with this request. It is too large of a concentration in too small of an area. The magnitude of this request will have impact for miles. The economic impact will be devastating as well to surrounding property owners. Anyone who tells you there will not be flies, odor and dust around a dairy has never been near one. There is a reason that the owners and their labor force do not want to live there. 5. I am a farmer and cattle feeder that operates adjacent to the DeHann property. Several of the issues which I feel are a problem with this request are the following. This area is rapidly losing agricultural production. The City of Thornton has started to dry up quite a few of the 90 farms they own in this area. They are taking the water to Thornton and planting the farms back to grass. The significant sale of water to other cities is drying up farms. The rapid development of housing has decreased the amount of farm land in Weld County. This special use request represents a large burden on an ever diminishing area. What makes no sense is where they are going to get rid of the waste that the dairy produces. Based on their application they say they are going to produce 138,430 tons of manure per year. It is generally accepted that you can spread around 20 ton per acre on irrigated land. Based on the manure production they will require 6,912 acres of irrigated land to handle the waste. This is in addition to all of the other feedlots and dairies in northern Weld County. Specifically,how will the waste be handled? .I realize some of the manure will be composted. How much and where will it go? I would like to see a detailed map outlining where this new waste will be utilized. As a livestock producer I am painfully aware of the growing problem. Dairies buy significant commodities outside of this area a lot of the hay comes from Nebraska and Wyoming. Weld County is already a corn deficit area meaning we use more than we rise. Most dairies ship in the majority of their hay from outside of Weld County. The one question I have is what are DeHann's going to do with the manure? Make each truck take a load back to Nebraska after they unload the hay. The cities of Fort Collins and Greeley are bringing their sludge and slurry to this area to be spread. The applicant does not address where it goes specifically. 6. The location of the proposed dairy is on top of the hill and quite limited soil cover over the shale. This is a bad location fora dairy in that the shale will carry the waste into the surrounding wells. I rely on shallow water well as do several of my neighbors which can easily be contaminated. What steps will taken to safe guard our ground water. n 7. The huge size of the dairy located on top of the highest point for miles, it will alter the landscape and be able to be seen for miles around. This is for an 8,000 head dairy farm 500 feet from our front door. This area already has two feed lots within a mile of our residence. There is also a dairy farm on the corner of Highway 14 and County Road 43. At this time, we are burying five gallons of flies each year. To allow 8,000 more cows this will multiply the amount of flies sixteen fold or more. Where is the cut off for health standards? With the diseases being transmitted by flies and mosquitoes, I believe this will hinder our quality of life in this area. This is slowly becoming more of a residential area with Ault being only three miles away. What chance does Ault have to grow putting a very large dairy farm so near the town? Who wants to live that close to the smell, traffic and air pollution this will create? We will never be able to sell our property or even get our initial investment back out of the property in this area. Those of us who live within a few miles of this operation stand to loose no matter what standard of life we look at. I realize we have received this notice because we are within feet of this proposal, has the residents who live within a five mile radius received any notice? The wind does blow nearly continuously up here in all directions. Have you forgotten what Greeley and Severance smelled like with feed lots so close to town? I believe the smell will truly hamper any development in this area not only in Ault but any town in our close proximity. Who will be responsible for maintaining the traffic and dust this will create on County Road 41? The traffic with diesel trucks in and out of this dairy farm will be considerable. Although we do not have a well on our property, it is our understanding that the water table here is relatively high. This farm will be washing its pens on a daily basis. Where is the water to run off to? Water seepage from this big of an operation, along with all the cow urine makes for a potential pollution problem for the well water in this area. This also brings up the mosquito factor and the disease transmission potential. It is also come to our attention that like feed lot, with a dairy farm of this size there will be a large amount of outside lighting. With our property in such close proximity how are we to sleep with our home lit up continuously? We are totally opposed to this operation in our area. Even considering what few jobs she may argue will come to the area; they are not worth the potential problems it will create. This will not add to the economy or quality of life in this area. It is our understanding that none of the DeHanns or even their employees would live at this site. If they don't want to live near their own dairy, why should we be sentenced to do so? Where would all of the water come from? How could they even conceive of asking to drill a well,when many area farmers are not allowed to use their existing ones? During heavy rains we have experienced runoff from Double J feed lot. It runs east down the field and into our driveway. This was from several hundred head—not several thousand How would this affect our domestic well with manure and urine seeping into the ground? Where does all of the feed come from? What happens to the manure? Would it be hauled away or just allowed to pile up,creating a drainage problem? How would they handle dust control-fly control-drainage? There are already many special use permits in existence in this area which allow for many,many head of cattle,do we really need more? A dairy this size makes a major impact on the neighborhood. Weld County is still an agriculture county that is being pushed out by development. To allow this dairy to go in will only make things more difficult down the road. We have seen Greeley have to buy out old existing feedlots because the nuisance it has caused. These feedlots were seasonal where as this dairy will be in full production 365 days a year. A dairy is far different than cattle feedlot due to the amount of excrement the cattle put out and a far more offensive odor. This is due to the ration of feed being of different grains, than for feeding cattle for beef consumption, and water consumption being much higher. There should be grave concern over water contamination problem and air pollution. This will cause great problems for the community. The growth of these areas went in knowing what was around them. To put this in on top of the developing communities I feel would be a mistake. In 10-15 years with the growth plans of these communities it will be a problem that can be prevented very easily right now by not approving it. With the amount of water that is required for a dairy, how will it be possible to justify this use of water with the problems we are faced with today? The cattle alone will consume 240,000 gallon a day and this does not include the lagoons and disbursement of the waste. Again I do not feel that this fits into the growth plan for this area. The proposed location of this dairy operation is 1.5 miles from my residence in the liawkstone subdivision. I am opposed to the dairy being built because of items including but not limited to : air and water pollution, odor, dust,excessive truck traffic,fc,fly and other insect problems. Another area of concern is that the dairy operation does not fit the overall growth plan for the area and is detrimental to my established community. The County has approved several residential lots in the vicinity, therefor approving a livestock facility of this magnitude seems to be a contradiction to those recently approved residential lots. It would seem that the County is trying to mix land used that are not compatible. I'm sure the County is aware of the town of Ault pursuing the building of a prison. These two projects would be approximately 1 mile apart and the combined impact to all residents nearby would be enormous. Lastly I oppose this project because I feel that the quality and peaceful enjoyment of my community would be in jeopardy. I have also included a map of the area where this 8,000 head commercial dairy operation is planned. Every land owner in the area, the City of Ault, residents of Hawkstone subdivision, residents of Ault, residents of Eaton and members of the Eaton Country Club are all strongly opposed to this size of operation, in this area. The air pollution, lighting and visual pollution, quality of water in the adjacent domestic wells and huge heavy truck traffic increase, will cause the quality of life for all of the surrounding communities to drastically decline, will force land owners adjacent to the dairy to sell their property at a huge loss and will cause the value of the surrounding properties to plummet.
