RESOLUTION
RE: ACCEPT PETITION AND AUTHORIZE VACATION OF PORTIONS OF ROAD RIGHTS-
OF-WAY LOCATED EASTERLY OF ASH AVENUE IN THE CITY OF GREELEY,
COLORADO -VARRA COMPANIES, INC.
WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to
Colorado statute and the Weld County Home Rule Charter, is vested with the authority of
administering the affairs of Weld County, Colorado, and
WHEREAS,the Board has been presented with a Road Petition from Varra Companies, Inc.,
1431 East 16th Street,Greeley,Colorado 80631,c/o Drexel,BarrelI and Company,6513 West 4th
Street, Greeley, Colorado 80634, a copy of said petition being attached hereto and included by
reference, requesting vacation of portions of road right-of-way, being more fully described as
follows:
All those portion of road rights-of-way granted on the
recorded plat of the Union Colony,lying with property
presently owned by Varra Company, Inc., and lying
easterly of Ash Avenue in the City of Greeley,
Colorado,described as follows:All road right-of-way
as granted on the recorded plat of the Union Colony
lying within that tract of land as described in Exhibit A
and depicted on Exhibit C, as attached hereto, and
WHEREAS, the County Attorney's Office and Department of Public Works have
recommended approval of said request since that portion of right-of-way is not needed for the safety
and welfare of the traveling public, and
WHEREAS,the petitioners, being the adjacent property owners on both sides of the road
right-of-way, have waived written notice of this hearing, and
WHEREAS,any persons owning dedicated and recorded easements and rights-of-way for
the use of the right-of-way to be vacated, if any, may continue such use after formal vacation by
Weld County, and
WHEREAS,the Board of County Commissioners heard testimony and reviewed all other
evidence presented therein by staff and the public, and
WHEREAS,the evidence showed that the vacation of those portions of right-of-way which
are described above will not leave any land adjoining the roadway without an established public road
or private access easement connecting the land with another established public road, and
WHEREAS,the Board of County Commissioners deems it advisable to vacate said portions
of road rights-of-way, with said vacation to become effective upon recording as required below.

described above be, and hereby are, vacated.
BE IT FURTHER RESOLVED by the Board that the Clerk to the Board be, and hereby is,
directed to record this Resolution in the records of the Weld County Clerk and Recorder.
The above and foregoing Resolution was,on motion duly made and seconded,adopted by
the following vote on the 20th day of August, A.D., 2007.

FROM: PETITIONER: VARRA COMPANIES, INC.
The undersigned real property owner of that property described in Exhibit A attached
hereto, hereby petitions that the road rights-of-way described and shown and illustrated in
Exhibits B and C attached hereto be declared abandoned and vacated by Weld County
and hereby waive the ten (10) day notice of hearing on this matter provided at least forty-
eight (48)hour verbal notice is given.
The properties and owners of said properties adjoining said right-of-way are set forth in
Exhibit D attached hereto.
Existing utilities, including, but not limited to, oil and gas pipelines, sewer, gas, water or
similar pipelines and appurtenances, ditches or canals and appurtenances and electric,
telephone and similar lines and appurtenances within the right-of-way of holding a
recorded interest to use or cross this right-of-way are: none
As support for this petition, Petitioner states that the right-of-way has not been
constructed nor maintained by Weld County; that no part is within a City or Town of a
County other that the County of Weld: that no portion of the right-of-way is shown as
part of an approved or recorded subdivision plat, map or unincorporated community
legally filed prior to any regulations controlling subdivisions: that the right-of-way is not
used by the public: that vacation of the right-of-way will not leave any land adjoining
said right-of-way without an established public road or private access easement
connecting said land with another established public road.
Petitioner agrees that they will permit any persons owning dedicated and recorded
easements and rights-of-way, if any, to continue such use after formal vacation by Weld
County. Further, Petitioner agrees to pay costs of providing notice including publication

SUBJECT: Western Sugar Cooperative
Drexel BarrelI & Company has provided a road petition to vacate rights-of-way owned by Western Sugar
Cooperative. The subject property fronts Ash Avenue, which has been annexed by the City of Greeley. The
multiple parcels have a ccess through existing right-of-way and frontage Ash Avenue and would not be
considered a land-locked parcel.
The Assessor's map identifying multiple parcels, but does not show any platted right-of-way through these
parcels.
By vacating the proposed existing rights-of-way, the ownership needs to be retained under one ownership, as
there are multiple parcels within this proposal. If individual parcels are sold off, access needs to be gained
through an easement or other means. Once again, there is frontage and direct access to Ash Avenue.
The road petition has not been signed, dated, or stamped by the petitioner, Western Sugar Cooperative. The
Clerk to the Board will not accept or schedule petitions or agreements without original signatures.
Summary: Exhibit C, as it exists, provides right-of-way to all parcels within the proposed vacation area. If
any individual parcels within the proposed vacation are sold, access to a publicly maintained road should be
provided. If Western Sugar decides to combine their parcels and develop this site, access and frontage is
available from Ash Avenue.
The Weld County Public Works (Development Review) has no conflict in the proposed vacation as long as
there is reasonable access to the individual parcels or the combined parcel as a whole to the nearest publicly
maintained road.
