RESOLUTION RE: ACTION OF THE BOARD OF COMMISSIONERS REGARDING VIOLATION VI#0300206 AGAINST ROBERT ANDERSON FOR VIOLATION OF THE WELD COUNTY CODE WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to Colorado statute and the Weld County Home Rule Charter, is vested with the authority of administering the affairs of Weld County, Colorado, and WHEREAS, Robert Anderson, VI #0300206, is allegedly in violation of the Weld County Code, and WHEREAS, despite efforts by the Planning staff to resolve said matter, the violation has not been corrected, and WHEREAS, on the 10th day of April, 2007, a public hearing was held before the Board of County Commissioners for the purpose of hearing testimony relating to said violation, and WHEREAS, Robert Anderson, property owner, was present at said hearing, and WHEREAS,the Board of County Commissioners deems it advisable to close said violation by waiving the landscaping plan in the Amended Site Plan Review Permit application allowing the application to be completed and the Plat recorded after the hearing today, which will bring the subject property into compliance. According to the Weld County Land Use Code effective date August 25, 1981 Section 23 states that, "No land, building or structure shall be used developed, erected, constructed, reconstructed, moved or structurally altered or operated in any Zone district that requires a Site Plan Certification until a Site Plan Certification has been approved by the Department of Planning Services." Section 34.2.5 of the Weld County Land Use Code effective date August 25, 1981 also states that a site plan review is required for a building in the I-1 zoning district. On December 22, 1976 the property in questioned changed from agricultural zoning to Industrial. The information you provided shows that on November 11, 1981, Robert Anderson, applied for a building permit for a commercial building in the Industrial zone district. As this date of November 11, 1981, is after the adoption of the Weld County Land Use Code, of August 25, 1981, the applicant(Mr. Anderson) is required to do a Site Plan for operating a business in the Industrial Zone district unless the applicant can submit additional information to the Department of Planning Services. The applicant has already applied, and been conditionally approved,for a Site Plan Review(SPR-282). In 1997, we applied for a Site Plan Review to add on to the existing building, so we could expand our business. After going through several steps, we withdrew our application due to the requirement of a fire hydrant and the cost of bringing in a water line from more then a half a mile for the hydrant would have been to costly. In order to grow we knew we should move and attempt to sell the land. A contract was made with Perdon Development. In 2003, we received a letter from Weld County. Requiring a Site Plan Review on our existing building. At this time the adjacent property was under consideration for annexation into the Town of Windsor, which would also include this building and property. Weld County put the Site Plan Review on hold, pending the annexation. The Annexation failed and now the developers are trying to get the development approved in Weld County. At this time the Site Plan Review is in effect again. We have completed most of the Site Plan Review, but are asking to be exempt from a Landscaping plan and the collateral improvement agreement. One of our concerns is that this property of 76 acres are under contract and we really don't know what the property lines will be to this lot. Our Access will change if this development is approved. Weld County has stopped the PUD from proceeding until this issue with the Site Plan Review is completed. We feel like we were not in violation when building this building, we had permits when it was built and after 25 years we need to resolve this.
