A public hearing was conducted on May 21, 2007, at 9:00 a.m., with the following present:

The following business was transacted:
I hereby certify that pursuant to a notice dated May 4,2007, and duly published May 9,2007, in the
Fort Lupton Press, a public hearing was conducted to obtain public input regarding the Adoption
of the Two Rivers Parkway(Weld County Road 27)Alternative Alignment Study,which was drafted
by the Weld County Department of Public Works. Bruce Barker, County Attorney, made this a
matter of record.
Wayne Howard, Department of Public Works, gave a presentation of the project, and stated
County Road 27is also known as Two Rivers Parkway, and 83rd Avenue in some areas of Greeley.
He stated there will be two segments of the road which will be included in the presentation today,
the first is the south segment which begins at State Highway 60 and goes north to County Road
378 for approximately a mile and a half, and the north section begins at County Road 64.5 and
goes north to State Highway 392. He further stated this is one of the seven strategic roadways
which were identified to provide an effective transportation system. Mr. Howard explained these
roads are strategic due to their location and connectivity between other major arterial highways
within Weld County. He stated the purpose of the project is to establish preferred alignments for
two segments of Two Rivers Parkway, which currently have poor connectivity with other major
intersections and a high number of traffic accidents, and improved alignments will create safer
intersections while increasing the capacity of the roadway. He further stated the project need is
to identify preferred alignments at this time which will help to serve as a guide to preserve
rights-of-way for when the arterial roadways are needed. Mr. Howard explained planning for the
roadway now will allow the roadway to be implemented in an orderly fashion and will minimize
future impacts. He stated the project began with identifying the project framework, and then staff
collected data, identified and evaluated the alternative routes, presented the alternatives for public
input, re-evaluated the alternatives, and are now recommending the preferred alignment.
Mr. Howard stated Option #1 runs straight north from State Highway 60, along the old railroad
right-of-way, and connects back into the Two Rivers Parkway, and Option#2 runs a similar path.
He stated the north segment has three alternative routes; the first route heads due north, across
the railroad, curving toward the existing roadway, crossing State Highway 392, and then heads
north and ties back into Two Rivers Parkway. He further stated Option #2 is a straight alignment

which ties into the existing Highway 392 intersection, and has three cul-de-sacs due to the closings
of a bridge and the railroad crossing. Mr. Howard stated Option#3 is similar to Option#2, without
two of the cul-de-sacs, a bridge would need to be replaced, and it would run parallel to the power
lines. He stated there were seven criteria considered when evaluating the options: Horizontal and
Vertical Geometry, Public Support, Transportation Effectiveness, Environmental Impacts,
Right-of-Way Impacts, Safety, and Cost. He explained the breakdown of those criteria is not
included in this presentation but will be in the in final report. Mr. Howard stated public participation
has been a part of the process, and there were three public meetings. He stated the first meeting
was regarding the south segment of Two River Parkway and was held in the Town of Milliken. He
stated the second meeting was regarding the north segment and was held in the City of Greeley.
He further stated the participants at the first two meetings were supportive of the options available.
He explained the third meeting was a combined open house regarding both the north and south
segments, and there were several one on one meetings with landowners. Mr. Howard stated
through the process, the preferred option for the south segment is Option #1. He reiterated
Option#1 begins at State Highway 60 and heads across the Big Thompson River, it follows the old
railroad right-of-way, and then ties into the existing Two Rivers Parkway. He stated staff
anticipates leaving the existing Two Rivers Parkway open for local traffic; however, the majority of
traffic would utilize the new route. He stated the recommended option for the north segment is
Option #3. Mr. Howard stated Option #3 follows the section line as it leaves County Road 64.5,
and it runs parallel to some high voltage power lines. He reiterated the goal is to construct the new
roadway as it is needed. He explained a cul-de-sac may be needed for Option#3 on the south end
due to the railroad crossing unless the railroad will permit a new crossing, and a new bridge will be
required since the alternative route will cross the Greeley-Loveland Canal#2. He stated the next
step is to request the Board adopt the final alignments to preserve the right-of-ways. Chair Long
suggested Mr. Howard remain available for questions from the public afterthe meeting,and invited
public testimony.
Noel Hayes, property owner, stated a large part of the south alignment will be routed through
his property. Mr. Hayes stated Option #1 will affect his property less than the other alternatives.
He explained he will lose some irrigated land; however, it is much better than losing a house. In
response to Judy Firestien, property owner, Mr. Howard stated the County is preserving
rights-of-way; however, there are no plans for construction at this time. He further stated as the
need for the roadway increases, the time-line will be mapped out. In response to Chair Long,
Mr. Howard stated there are no plans for construction in the five-year plan for the north nor the
south section of the alignment. In response to Ms. Firestien, Mr. Howard stated there are currently
no plans for widening the existing roadway near her property; however, as the need increases, it
will be considered since it is a strategic road. Mr. Howard explained the activity occurring on State
Highway 16 is being conducted by the Colorado Department of Transportation (CDOT). He stated
CDOT is making improvements to the intersection, including installing a traffic signal. George Hall,
property owner,stated he has no objection to the alignment and will accept what is proposed today.
Mr. Hall stated CDOT is doing a great job of turning the intersection into a safer T-intersection. He
stated he is confident the County will always be fair with the landowners, and he looks forward to
these plans becoming reality. Responding to Mr. Hall, Mr. Howard stated the 140-foot distance
mentioned previously is normally based on the distance from the section line; however, staff has
made exceptions, such as placing curves in the road, depending on the circumstances at the time
of design. He explained many things are considered and 140 feet from the section line is not
always an appropriate distance. Commissioner Jerke encouraged the property owners in
attendance to speak their minds while they have this opportunity. Ken Tigges, property owner,

stated there are houses located at the intersection of O Street and 83rd Avenue,and inquired if the
power lines or the homeowners will have priority when a decision is required. Responding to
Mr. Tigges, Mr. Howard stated the power lines established there have their own right-of-way and
most people are accustomed to not building underneath those power lines. Mr. Howard further
stated the County will strive to hug the power line right-of-way, and even encroach on the
right-of-way when possible, when constructing the roadway. Mr. Howard stated there is an
abandoned house north of the power lines; however, there are no homes with residents currently
in the area. Lisa Antuna, property owner, stated she lives to the east of the proposed roadway and
she is concerned about the amount of traffic which may be created by the roadway. Chair Long
reiterated the roadway will be built as the need increases. Mr. Howard stated the existing County
Road 27 has been identified as a main arterial, and this study has identified a better location for
the existing roadway. He stated traffic is increasing; however, the study is very conceptual at this
point and it does not provide the type of detail Ms. Antuna is interested in. In response to
Ms. Antuna, Mr. Howard stated in theory the roadway will increase traffic in the future, since
strategic roadways generally have reliable connections with state highways. Mr. Howard further
explained, in theory, the traffic will increase on the roadway since the County is creating a safer
roadway and a more direct route with fewer obstacles. Harold Daniels, property owner, stated he
owns property along the south section of the proposed highway, and he wants assurance he will
have access to his property from the roadway. Mr. Howard explained Mr. Daniels owns a large
amount of property and though he cannot guarantee how the roadway will be designed, at least
one access to Mr. Daniels property will be guaranteed. Mr. Daniels stated it would be
advantageous for him to have access to the new roadway. In response to Mr. Daniels, Mr. Howard
stated staff have not surveyed enough of the land to determine which side of the section line the
majority of the roadway will fall on. Mr. Howard explained it will depend on the layout of the bridge,
since the bridge is susceptible to flooding conditions, and an in-depth hydraulic study must be
completed to design the bridge before the roadway is planned around it. Further responding to
Mr. Daniels, Mr. Howard stated 140 feet in width is the standard amount of distance required;
however, the bridge will likely need to be wider than that. Mr. Howard stated Mr. Daniels has
attended all of the meetings and has been a pleasure to work with. In response to Mr. Daniels,
Mr. Barker stated the determination of whether or not Mr. Daniels will have an access to the new
roadway depends on the number of existing accesses and planning concerns. Chair Long stated
it is not the County's intention to close an existing access. Mr. Daniels stated there is not an
existing access on that side of his property. Mr. Barker stated staff will work with Mr. Daniels
regarding the access. Mr. Howard stated since access cannot be granted prior to the roadway
being constructed, it will not happen until the project moves forward. He further stated if an access
is closed, a new access route will be created; however, it is hard to say at this point in the process
whether a new access route will be created. Mr. Howard stated if a new access is to be created
on his property, staff will work with Mr. Daniels at that time to determine the best location to select
in order to prevent sight issues when exiting the property. In response to Mr. Daniels, Mr. Howard
stated there are no plans for acquiring right-of-way at this time, only preserving it. Dave Mitchell,
property owner, stated he applauds staff for the straight alignment of the road design, and it is a
terrific route, particularly considering the high power lines. Mr. Mitchell stated this roadway is badly
needed, and he has noticed a significant increase in traffic in the three years he has lived at his
residence. Mr. Hayes stated he has lived on his property since the early 1950s and it was a quiet,
lonely road then. He stated now the traffic begins at 5:00 a.m., and it is extremely difficult to exit
the property. Mr. Tigges stated the roads which travel north and south across the Highway 34
bypass have too many stoplights, and he hopes an overpass may be added to help ease

congestion. Chair Long stated CDOT is responsible for Highway 34; however, the County is
involved with the process by providing data to the State. Chair Long closed the public input portion
of the hearing.
In response to Chair Long, Mr. Barker stated in the past, specifically regarding the
alignments along Interstate 25, the study was presented in a public hearing and the Resolution
followed two to three weeks later after the Board had conducted work sessions. Mr. Barker stated
a Resolution has not been created; however, if the Board is comfortable doing so, it may adopt a
Resolution today and present it for signatures at the next meeting. He further stated another option
is the Board may schedule a date to present the Resolution in a few weeks, and notification may
be given to the property owners of the date chosen. Chair Long stated for the sake of consistency,
it may be best to wait for the Resolution to be completed. Commissioner Jerke stated it may be
appropriate to state the direction of the Resolution today so the public is aware of the Board's
intent. He stated he is in favor of Option#1 for the south segment, since Mr. Hayes indicated it is
his preference, and the engineers support it. Chair Long and Commissioner Garcia concurred with
Commissioner Jerke's support for Option #1 for the south segment of roadway. Commissioner
Rademacher stated Option#3 was the staff recommendation for the north segment of the roadway.
Chair Long stated Option#3 seems to accommodate the public; therefore, he is in favor of it. In
response to Chair Long, Mr. Barker suggested scheduling the Resolution to be heard June 6,2007.
In response to Commissioner Jerke, Mr. Barker stated there is not a need to renotify the property
owners by mail of the date; however, the Board may want to assemble the proposed Resolution
and mail it to the property owners. Commissioner Jerke stated he is interested in providing the
notification to the property owners. Mr. Barker suggested waiting until June11, 2007, to present
the Resolution in order to provide sufficient time to notify the property owners, and the Board
unanimously concurred.
There being no further discussion, the hearing was completed at 10:30 a.m. This
Certification was approved on the 23rd day of May, 2007.

Parkway and SH 60 and Two Rivers Parkway and SH 392.

Dear Weld County Commissioners:
We wish to encourage your support of Option#1 for the South Segment of Two Rivers Parkway that
begins at State Highway 60 and ends at WCR 378 where it aligns with the existing Two Rivers
Parkway. This Option#1 has been the preferred option by the adjoining landowners who have the
greatest impact from the changing route and increased traffic.
As landowners, our property extends to the north end of the proposed South Segment which aligns with
the current Two Rivers Parkway at the junction with WCR 378. In Option#1 the road will cut across the
corner of our property(cropland and abandoned railroad right-of-way) near our western boundary and
will follow our western boundary southward toward the junction with State Highway 60. (The route also
crosses Waste Management land to our north, as well as other neighbors' cropland to the west and
south.)
However, we strongly support this Option#1 route following the abandoned railroad right-of-
way instead of Option#2 which would follow the present WCR 27 '/z route that travels southward past
our Spomer Ranch driveway entrance and historic family house. The increased traffic already causes a
dangerous situation when leaving and entering our driveway. The traffic noise is also annoying and
disruptive especially during late evening and early morning hours.
On Option#2, the proposed 140-foot right-of-way could literally destroy our beautiful Victorian family
home, that was built by our Spomer grandparents and has been in our family for more than four-

generations, because the roadway would come within a few feet of the house. Access in and out of our
driveway would also be impossible. Neighboring residences across the highway make it impossible to
adjust the roadway to one side or the other from the center line of the current road to avoid the negative
and unacceptable impacts to the homes affected.
In addition, an electric power line and Greeley domestic water pipeline parallel the edge of the current
WCR 27 1/2 (Two Rivers Parkway) section from WCR 378 to Big Thompson River. These utilities
would be impacted when widening the roadway for to the Option#2 route, and cement irrigation ditch
and structures adjacent to the current road would be affected.
Therefore,being one of the most affected adjacent landowners, we strongly favor Option#1 curving to
follow the general direction of the abandoned railroad right-of-way near the junction with WCR 378
and leaving the route of the current Two Rivers Parkway route at that point.
We hope that you will accept the extensive research and study, public meetings with local landowners,
and the resulting recommendation of the Weld County Public Works Department regarding the
Preferred Option#1 for the South Segment of Two Rivers Parkway.
