It is the opinion of the Department of Planning Services' staff that the applicant has shown compliance with Section 23-3-30.M of the Weld County Code, as follows: Parking and operation of one (1) COMMERCIAL VEHICLE on property on less than eighty(80)acres in size, when not a LOT in an approved or recorded subdivision, or a LOT which is part of a map or plan filed prior to adoption of any regulations controlling subdivisions. Parking and operation of up to five (5) COMMERCIAL VEHICLES from property equal to, or greater than, eighty(80) acres in size when used to haul agricultural goods, equipment, or livestock, as long as the number of trips does not exceed sixty(60) per day to and from the property. When the property is located within an approved or recorded subdivision or part of a LOT which is part of a map or plan filed prior to adoption of any regulations controlling subdivisions, such USE may be permitted through Section 23-4-950 of this Code. The Department of Planning Services' staff recommendation for approval is conditional upon the following: 1. All permits for commercial vehicles shall not be transferable by the applicant and/or owner to any successor; the zoning permit shall terminate automatically upon conveyance or lease of the property. The commercial vehicle shall be removed from the property, or a new zoning permit shall be applied for and approved. 2. Approval of this application for a zoning permit for a commercial vehicle shall not be considered to release the applicant from complying with any private covenants in place. 3. The property is in violation of Chapter 23 of the Weld County Code(Violation#0600204).The applicant shall schedule a final inspection with the Weld County Zoning Compliance Officer and submit a copy of the closure letter indicating compliance with Chapter 23 of the Weld County Code. 4. All vehicles located on the property must be operational with current license plates, or be screened from all adjacent properties and public rights of way,or be removed from the property.All other items considered to be part of a noncommercial junkyard must also be removed from the property or screened from adjacent properties and public rights-of-way. 5. We are unable to attend the hearing so are reiterating our objections in a letter sent to Voneen Macklin on Nov.28,2006. Mr. Jackson has access to his property only through easement on a private road granted from our property.The road is north from WCR 2 and is a private residential road. We solely maintain this road. Mr. Jackson does not. He continually invades our privacy, using this residence access for his Junk Hauling business and a Camp Ground for assorted RV use by whomever. The last hearing the Weld County Commissioners had concerning this I was able to get off work. I cannot this time. I trust this letter will do as my voice of opposition to giving Mr. Jackson a permit. Mr. Jackson runs a hauling business. This is totally the wrong kind of business to be established in a residential area because he keeps and stores a lot of what he hauls on his property creating an eyesore for the rest of the neighborhood. We should not have to put up with it. Mr. Jackson also allows other non family people to park their RV's and campers on his property and stay for extended periods of time without applying for permission from Weld County, which is also a violation of zoning. This is what we have to deal with. Late last year I called the Weld County Sheriff Dept to report Mr. Jackson's treatment of a sheep he had. After two attempts to get them to come and investigate I gave up. Three weeks ago the sheep died from neglect and I believe malnutrition. The sad thing is the dead carcass is still on his property rotting. He is very irresponsible with his business and his animals. I ask the Commissioners to deny Mr. Jackson's request and that you also give him 30 days or whatever you think he needs to clean up his property from previous business done there.
