RE: APPROVE PARTIAL VACATION OF USE BY SPECIAL REVIEW PERMIT, SUP #103 -
JACK FRANK
WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to
Colorado statute and the Weld County Home Rule Charter, is vested with the authority of
administering the affairs of Weld County, Colorado, and
WHEREAS, by Resolution dated June 30, 1971, the Board did approve the request of Joe
Satterfield for Use by Special Review Permit #103, for a Dog Kennel Operation in the A
(Agricultural)Zone District, on the following described real estate, to-wit:
A parcel of land located in the S1/2 NE1/4 SW1/4,
and N1/2 SE1/4 SW1/4 of Section 22, Township 2
North, Range 66 West of the 6th P.M., Weld County,
Colorado
WHEREAS,the Board has received a request from the current property owner,Jack Frank,
15357 County Road 18, Fort Lupton, Colorado 80621, to vacate a portion of said Use by Special
Review Permit#103, and
WHEREAS,the Board of County Commissioners heard all of the testimony and statements
of those present, studied the request of the applicant and the recommendations of the Department
of Planning Services staff and all of the exhibits and evidence presented in this matter and, having
been fully informed, deems it advisable to approve said partial vacation, conditional upon the
following:
1. Pursuant to Section 23-2-200.G.5 of the Weld County Code, the applicant shall
submit a revised Partial Vacation Use by Special Review Plat, conforming to
Section 23-2-260.D of the Weld County Code.
NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Weld
County, Colorado, that Use by Special Review Permit#103 be, and hereby is, partially vacated,
with the abovementioned condition.

SUBJECT: Partial Vacation of SUP-103
The Department of Planning Services has received the attached letter signed August 27, 2007
from Jack Frank. Mr. Frank is requesting that SUP-103 for a kennel be partially vacated. The
property has been divided since the approval of SUP-103. The partial vacation will allow the
SUP-103 boundary to be located within Mr. Frank's property only.
Background information:
Legal Description: Lot B RE-2847 being part of W2 E2 SW4 of Section 22, T2N, R66W of
the 6th P.M., Weld County, CO
Location: North of and adjacent to CR 18; and approximately ' mile east of CR 31.
SUP-103: SUP-103 was approved by the BOCC on June 28, 1971, for a dog kennel
operation in the A (Agricultural) Zone District.
Parcel number: 1309 22 000059
Should the Board of County Commission choose to approve the request for a partial vacation of
SUP-103, Planning Staff recommends that a revised Partial Vacation USR plat of SUP-103 be
submitted as required by Section 23-2-200.G.5.

Dear Ms. Hatch,
This is to inform you that I am requesting to amend the boundaries that are
outlined in the original SUP 103 and partially vacate certain portions of the
original Special Use Permit.
Per your request, I need to vacate the special use permit for the portion of
land that belongs to the-Hacketts to the south and west ofmy property line. I
need to vacate the special use permit for the portion of land that belongs to
the Cardillos that is due west of my property line. I need to vacate the
special use permit for the portion of land that belongs to the Leggs to the
east of my property line. And I need I am moving the eastern border for the
SUP in towards the west of my east property line by 145 feet. Please see
diagrams comparing the old borders that you supplied me with to the newly
requested borders that are only within my property lines. I would prefer to
not encroach upon my neighbors even in the slightest.
