I must admit I do not know what portions of the Weld County Land Use Codes or industry related safety standards the Gun Club is not in compliance with, but I do know that during their hours of operation we hear the reports of gunfire as clearly as if the guns were being discharged on our property. I don't know what types of firearms are being discharged at the Gun Club,but we are located about 3/4 mile due East of the Gun Club, and I must admit we do harbor some concerns regarding the possible errant shot from either a pistol or rifle. If all firings are restricted to shotguns, then my safety concerns are significantly reduced. I realize the Gun Club was organized 50 years ago, and if they have been in the same location all that time then effectively they were there long before any development around them took place. This reminds me of folk who move in next to an airport, and then complain about the noise from the airport. However, a gun club potentially poses a much greater risk to the health and safety of their neighbors than an airport does. As the Town of Berthoud, and Larimer and Weld County have allowed re-zoning of agricultural land into residential land in proximity to the Gun Club, the Gun Club has to have seen the proverbial "handwriting on the wall" as to the potential longevity of their operation in their current location. They are right in the way of Berthoud's and the County's inevitable over time development to the East towards 1-25. The Gun Club's presence effectively de-values the properties within ear shot of their operation, but more importantly if they are not operating their club in a safe manner, then they pose a real threat to their neighbors. If they are going to co-exist for some period of time with the evolving development in their proximity, they must operate in full compliance with all existing laws and regulations for land use and certainly prove full compliance with their own industry's safety standards. That is their only defense in maintaining their operation. If they fail to comply with any of the applicable Land Use regulations or safety standards, their operations should be in fact closed down immediately. Any grandfathering of deviations from current standards would be inappropriate and not in the best interests of the County or its residents. I sincerely encourage the Board to demand full compliance from the Berthoud Gun Club in all County Land Use and Industry Standard Safety issues. Dick Persons 880 E. As far back as then, and even before, dirt bikes and the sport of off-road riding have been targeted by environmental groups to be eliminated. Dirt bikers have had to join forces with the American Motorcycle Association to lobby for survival of the sport they love. The AMA has worked with environmental groups and the Government to establish standards for noise and pollution that off-road motorcycles must comply with. The result is that, while the sport has been limited, there are still open trails to ride throughout the Nation. Sport shooting, such as is done at the Berthoud Gun Club, is likewise a targeted sport. The activities at the Club generate a lot of noise and safety concerns. Growth has put residential neighborhoods right next door to the club, and more is surely on the way. But unlike the sport of off-road motorcycling, the members of the Berthoud Gun Club do not seek to lobby their cause with help of the National Rifle Association, the most likely lobbying group to help them. In fact, the Berthoud Gun Club does not even comply with the NRA guidelines for shooting facilities. And rather than work with the community that is questioning their practices, the Berthoud Gun Club now seeks to increase their hours of operation and ^ demands a 10 year exemption from public scrutiny. I urge you to make the Berthoud Gun club be accountable for compliance with County land use standards now. I believe you should not reward such arrogance of attitude displayed by the Berthoud Gun Club with permission to operate at all until they wake up, realize just what the reality of the community is, and decide to work with the surrounding, affected neighbors to resolve the problems they initiate. I have expressed my concern about the gun club safety in this expanding neighborhood. I understand that the club's delay in meeting the Planning Commission's request for proof of conformity has not been met. Our home was built in 1867. When we purchased the old home in 1993, the gun club met a few times a month, never shot past dark with a few guns at a time and was acceptable to us. Believing this was the expectation of the club, we have greatly improved the property, investing money, time and energy to create a safe and tranquil shelter for us, our children and hopes of grandchildren. Unlike the gun club, we have done all of these improvements following the law and with permits. Their illegal expansion, non confirming safety standards and extended hours and days of operation has and continues to increase and is a significant disruption to my peace and safety. It is now my understanding that the gun club has been allowed to operate the last 18 months despite the fact the county has formally declared them to be out-of- compliance with the land use code. Again, while most landowners are required to comply with the land use code, this has not been required of the gun club. We request that the county enforce compliance with the land use code in this case. It seems to me that the use established back in the 70's for the BGC would be a much more reasonable use once and if they can meet the national safety standards. We recognize there is some value of the gun club to the community at large. However, the club's use has expanded several times over since it was grandfathered as a non-conforming use. During the last 12 years the Berthoud Gun Club has gradually increased their hours, allowed for a greater variety of gun usage and has had a significant increase in patrons. Although we are not as close as some of our neighbors the elevating noise level has been increasingly noticeable and at times disrupting to the surroundings of families and outdoor activities. With the Gun club being so close to residents we are very concerned about the safety especially since they do not meet the industry standards for gun clubs. As part owner of Green Acres next to the gun club, I want to protest the illegal continuous use of the shooting range, called the Berthoud Gun Club. The town of Berthoud annexed and approved home sites that are within 100 feet of the facility. No lending facility is willing to give construction money for the project with the gun club next to it. I feel our 210 home development on 115 acres is more important to Weld Country than the illegal use of the 9 acres that the gun club is misusing. The gun club is also contributing to the prevention of the development of 400 homes on the Bebo property across the county line road 1 form the gun club. The gun club has made many changes to the facilities without the any of the required building permits which in its self is enough reason to shut down. But why should it? The county does not seem to want to bother to enforce anything cver there. I am very interested in the development of the adjacent property, Green Acres yet I am mystified that such an "organization" such as the gun club is able to maintain their unregulated status quo. Berthoud is trying to maintain a small town, warm atmosphere. Family homes is what Berthoud is looking for but what family is going to feel comfortable with a gun club in their back yard? Particularly one that keeps getting bigger, busier, open longer and louder. Why isn't the county overseeing the growth and running of this club? Is the land zoned for such a thing as a gun club? If others are required tc abide by how land is zoned, why specifically is the gun club allowed to skirt these requirements? Is the county and the surrounding community secure in the club's ability to meet safety standards? I don't believe so because there is no county oversight. The gun club needs to abide by the zoning regulations of the area and safety regulations, but I do not believe that they are. ---This gun club could be a potential danger and is a nuisance, and I can only hope Berthoud Jill not allow it to grow and become even worse. I would think Berthoud would feel it to be essential that this organization be managed appropriately and I hope the right decision regarding this matter is made. My parents were the previous owners of this property and at time the Club was small and there were days, usually weekends that we could hear some shots, but it was never terribly annoying. Recently however, they have installed large lights and seem to be operating late into the night. The lights are out of place and the noise is not conducive to any sort of restful atmosphere one would expect in this setting. It has also come to our attention that they are building without permits! This is illegal. When the rest of us are expected to follow the rules it seems that the Gun Club should be held accountable as well. My memories of the Berthoud Gun Club or the Rod and Gun Club as it was sometimes called are from the time that I can remember to 1975 when I joined the Air Force. Also since I have been back from the Air Force, my in-laws had property within a mile of the club and that has been passed on to my wife. My uncle and cousin continue to farm the family farm next to the Little Thompson. As a young man, I remember shooting with Otto Rogge several times. When I was there, there were two buildings for the clay pigeons and a small club house. As late as 1975, the facility never had lights for shooting after dark and the area was gravel where the shooters would stand. I remember that the area was near the old Berthoud dump and the Rockwell ditch that runs below the club was always accessible. Now there have been improvements near the ditch that interfere with the ditch operations. In 1973, my dad was told that he had to move the family business from the farm shop on county road 3. It was a machine shop that he had in the yard at the house and he needed to enlarge the shop to provide more room for additional machines. He had to move it to Berthoud because of the recent zoning of the time in Weld County. My point is that there is precedent for non conforming land uses being enforced to either maintain current operational levels or move. I recall that there would be occasional turkey shoots that would last most of an afternoon on Labor Day or the 4th of July, but now there is shooting until 10 PM and sometimes later. Also, there were only shotguns allowed but now I understand from the Berthoud Gun Club web site that there are 22's and black powder weapons also allowed. 10-4-1999 Picture of Berthoud Gun Club Left and Current Configuration of Club Right • , y r,lt • t..t �. I am really concerned with gun safety. Being retired military and a qualified marksman, safety was always stressed. With shotguns the range isn't all that far, but with .22s and black powder, safety concerns now are very realistic and the fact that inexperienced shooters from the 4-H use the ranges concerns me. With property within one mile of the range, a 22 bullet can travel 1565 yards or 4695 feet (http://www.loadammo.com/Topics/May01.htm , Table II) well within the range of the western part of the property. Lights That Were Installed Shortly Before This Dated March 13, 2004 Picture � E d fir � � tea _ _ ..;There is now an archery range that was improved by a Eagle scout project (Berthoud Recorder Online Green Completes Eagle Project 02-04-2005). The range included leveling the range area and "moved dirt and brought in loads so that the area could be leveled". There also was the moving of gravel and forming the lanes to each of the targets as reported in the same article. The range has interfered with the maintenance of the Rockwell ditch and the club has been asked to remove some of the ranges away from the ditch right of way. Upgrades to the Range Dated March 13, 2004 ^. r. • The Town of Berthoud has expressed concerns about the gun club. During the December 13, 2005 regular meeting of the Town of Berthoud Board of Trustees the following is the minutes, Mayor Pro-Tem Ashcraft the Town has a definite rural feel,which is difficult to maintain with higher density. He pointed out that the Berthoud Gun Club has been in its current location since 1952. It may be time for the Town to be involved in discussions regarding the future of this venture in this location. There are options that can be considered for sound mitigation to allow the Gun Club to continue to operate in conjunction with residential areas. In the same minutes there was a discussion of schools, homes, and retail businesses in the area. It is my understanding that the gun club cannot comply with neither the National Trap or Skeet Safety Standards nor the National Rifle Association Safety Standards. The area is losing its rural look and feel and not in the far off future there could be development next to a property that already cannot meet the standards. The following is a paragraph from the same meeting as above. Mr. Karn thanked the Board for allowing them to take advantage of the sketch plan process to solicit input regarding their proposal. He explained that O'Malley Glen is proposed to be a vibrant mixed-use community that celebrates the character and qualities of traditional Berthoud neighborhoods. The property is located south of Colorado Highway 56,and west of County Line Road(Weld County Road 1). Proposed land uses include neighborhood retail,highway commercial, single family attached,single family detached and other multi-family housing styles. In conclusion, I want the club to scale back to its original functionality of trap and skeet and stop all rifle and black powder shooting. Before I left Berthoud in 1975 for the military there was not any rifle, archery, or black powder shooting at the range. I also would like to see the lights dismantled and the shooting scaled back to the 1972-1975 schedules of about 3 or 4 hours on Sunday afternoons and all day turkey shoots on holiday occasions. The club operations were from when the weather warmed in the spring to when it was uncomfortable or when duck hunting started in the fall. I never heard gun shots from the club anytime after October till the following March or April. However, due to a heavy case load on the Commissioners Docket and three weeks that are not available for scheduling due to Commissioner absences and the 4th of July holiday, I am requesting your permission to waive the 45-day deadline and consider a hearing date on either July 18.or 25, 2007. If you decline this request, a hearing on July 11, 2007, is still an option, although the day is already scheduled with two rather large cases to be heard prior to yours.
