O. BOX 446, GREELEY, COLORADO 80632 WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to Colorado statute and the Weld County Home Rule Charter, is vested with the authority of administering the affairs of Weld County, Colorado, and WHEREAS, the Board of County Commissioners of Weld County, Colorado held a public hearing on the 24th day of September, 1980 at the hour of 2 : 00 o 'clock p.m. in the Chambers of the Board of County Commissioners for the purpose of hearing the application of Duane Zabka, P. O. Box 446, Greeley, Colorado 80632, for a Special Use Permit for agribusiness , farm equipment, repair, sales and installation facility on the following described real estate, to-wit: A tract of land located in the East Half of the Northwest Quarter of Section 2, Township 5 North, Range 65 West of the 6th P.M. , Weld County, Colorado being more particularly described as follows : Beginning at the Northwest Corner of said Section 2 and considering the North line of said Section 2 as bearing South 90°00 ' 00" East, with all other bearings contained herein relative thereto; Thence South 90°00' 00" East, 1322. 96 feet to the North 16th Corner of the Northwest Quar- ter of said Section 2; Thence continuing along said North line, South 90°00 ' 00" East, 80 . 00 feet to the True Point of Beginning; Thence continuing South 90°00 ' 00" East, 213 . 25 feet; Thence South 01°02 ' 09" West, 537 . 80 feet; Thence North 90°00 ' 00" West, 213. 25 feet; Thence North 01°02 ' 09" East, 537 .80 feet to the True Point of Beginning. Said described parcel of land contains 2. 632 acres, more or less, including a strip of ground 30 feet in width along the North line reserved for county road right-of-way purposes containing 0 .147 acres, more or less, and is subject to any rights-of-way or other easements as granted or reserved by instruments of record or as now existing on said described parcel of land. WHEREAS, evidence was presented in support of the granting of the Special Use Permit for agribusiness , farm equipment, repair, sales and installation facility on the above described real estate, and PL/%g7 WHEREAS, Section 3 . 3 (E) (2) of the Weld County Zoning Resolu- tion authorizes such a use in an Agricultural District upon appro- val by the Board of County Commissioners, and WHEREAS, the Board of County Commissioners of Weld County, Colorado heard all of the testimony and statements of those pre- sent, has studied the request of the petitioner and the recom- mendations of the Weld County Planning Commission and all of the exhibits and evidence presented in this matter, and having been fully informed, is satisfied that the request for a Special Use Permit for agribusiness, farm equipment, repair, sales and instal- lation facility on the above described real estate, conforms to the purposes of Section 3. 3 (E) (2) of the Weld County Zoning Resolution. NOW, THEREFORE, BE IT RESOLVED by the Board of County Com- missioners of Weld County, Colorado that the application of Duane Zabka for a Special Use Permit for agribusiness, farm equipment, repair, sales and installation facility on the above described tract of land, be, and hereby is, granted subject to the following: 1. The Special Use Permit plat shall be amended to show a reservation of an additional 20 feet of right-of-way along the South side of Weld County Road 62. 2. The Development Standards contained in the Special Use Permit. 3 . No building or electrical permits shall be issued on the Special Use Permit area until the Development Standards for the Special Use Permit and the property owner' s signature have been placed on the Special Use Permit plat and the plat has been delivered to the office of the Department of Planning Services . BE IT FURTHER RESOLVED by the Board of County Commissioners of Weld County, Colorado that the reasons for approval contained in the Weld County Planning Commission recommendations dated August 5, 1980 be, and hereby are, adopted as the findings of fact of the Board of County Commissioners in this matter. Mr . Zabka explained that they do both personal and outside repair work in this building and do not sell equipment. Mr. Honn explained that the "sale of equipment" as applied in development standard #1, is as listed for this category in the regulations and further- more, would not restrict him later if he did se' equipment. MOTION: It was moved by Bob Ehrlich and seconded by Bette Kountz that the Planning Staff's recommendation and development standards be accepted by reference and forwarded to the Board of County Commissioners with recom- mendation for approval . Motion carried unanimously with Halleran, Otis , Ehrlich, Kountz, White, Billings and Carlson voting for and none against. SE4 Section 16, T5N, R66W LOCATION: Southeast corner of 65th Avenue and 26th Street APPEARANCE: Bob Norton, consulting engineer representing Gordon Adler, explained that Mr. Adler would like to subdivid Lot 6, which is a three acres lot into two 12 acre lots. There were several surrounding property owers present, along with their attorney Bryan Shaha, that stated their concerns with the granting of this request. The concerns dealt with the covenants and the affect this would have on the surrounding property owners. Mr. Lowenbach answered questions about the applicability of the covenants. Mr. Honn read the Department of Planning Services Staff recommendation for approval . Mr. Otis stated that he thought this would change the character of the neighborhood because there is temptation for future land owners to come in and also request a subdivision. MOTION: It was moved by Don Billings and seconded by Irma White that the Planning Staff's recommendation be accepted with the elimination of the requirement for curb, gutter and sidewalks and by the advise of our legal council this is to be judged on the basis of the character of the Ken-Wil Subdivision only, and forwarded to the Board of County Commissioners with recommendation for approval . Motion carried with Halleran, Kountz, White, Billings and Carlson voting for and Otis and Ehrlich abstaining. Dear Mr. Conliffe, The building in question was built to be used as an onion storage facility. Our crop yield in 1979 was less than expected. The additional storage this building was to provide was not needed. To justify the expense of this building we are using it for repair work on our machinery. With the farm economy in such bau condition we have been forced to keep our costs , i.e. machinery repair costs, to a minimum. There- fore with the hourly rate commercial repair shops charge, and the availability of our own building we are trying to do all of our own repair and maintence work. Almost all work preformed in the building is for Zabka Farms. On occasion a neighbor or someone else will need the services that we can provide, and when we are not busy on our own equipment we can use the additional work to help justify the cost of our tools and equipment in the building. The hours of operation for the building are 7 A.M. until 6 P.M. Six days per week. We would estimate a maximum of 6 full time employees. The sanitary facilities in the building consist of a stool and sink supplied by North Weld Water District. The sewage for the stool and sink is taken care of by a 1000 gallon vault type tank. Box 446 Greeley, CO. 80632 • This is in answer to your request for soil information on E1/2 NWT Sec. 2-5-65 for maintenance shop for agricultural equipment. As shown by the attached soil map the area is made up of two soil types: Altvan loam, 0 to 1% slopes (23A) and Nunn clay loam 0 to 1 percent slopes (17A) . Both soils exhibit a moderate to high shrink-swell potential as the soils wets and dries. Shrink-swell factor could cause problems to buildings or dwellings if proper design characteristics are not used. Both soils do exhibit characteristics which allow proper functioning of septic tank absorption fields. I understand that present buildings will be utilized for the requested activity, however, if future construction is planned, tests should be made by a competent soil engineer to determine proper construction design.
