RE: APPROVAL OF USE BY SPECIAL REVIEW FOR A NATURAL GAS
PROCESSING PLANT - ASSOCIATED NATURAL GAS, INC.
WHEREAS, the Board of County Commissioners of Weld County,
Colorado, pursuant to Colorado statute and the Weld County Home
Rule Charter, is vested with the authority of administering the
affairs of Weld County, Colorado, and
WHEREAS , the Board of County Commissioners held a public
hearing on the 23rd day of March, 1983 , at the hour of 2 : 00 o'clock
p.m. in the Chambers of the Board for the purpose of hearing the
application of Associated Natural Gas, Inc. , P. O. Box 5493 ,
Denver, Colorado, 80217 , for a Use by Special Review for a natural
gas processing plant, on the following described real estate, to-wit:
Part of the Southeast a , Section 35 , Township 4 North,
Range 66 West of the 6th P. M. , Weld County, Colorado.
WHEREAS, Section 24 . 4 . 2 of the Weld County Zoning Ordinance
provides standards for review of said Use by Special Review, and
WHEREAS, the Board of County Commissioners heard all of the
testimony and statements of those present, has studied the request
of the applicant and the recommendations of the Weld County Planning
Commission and all of the exhibits and evidence presented in this
matter, and having been fully informed, finds that:
1. The submitted materials are in compliance with the
application requirements of Section 24 . 7 of the Weld
County Zoning Ordinance;
2 . It is the opinion of the Board of County Commissioners
that the applicant has shown compliance with Section
24 . 4 . 2 of the Weld County Zoning Ordinance as follows :
a. The proposal is consistent with the Comprehensive
Plan policies in that the use does not infringe
on continued agricultural use in the vicinity or
County. The proposal does not appear to have any
adverse impacts on the agricultural interests of
the County or the environment.
b. The proposal is consistent with the intent of the
Agricultural Zone District; and is provided for
as a Use by Special Review.
c. No overlay districts effect the subject site.
d. The town of Gilcrest has submitted a favorable
recommendation for this request.
NOW, THEREFORE, BE IT RESOLVED by the Board of County Com-
missioners of Weld County, Colorado that the application for a Use
by Special Review for a natural gas processing plant on the herein-

above described parcel of land be, and hereby is, granted subject
to the following conditions :
1. The attached standards for the use by special review
be adopted;
2 . The plat for the use permit be placed of record by the
Department of Planning Services staff prior to any
building permits being issued on the site.
The above and foregoing resolution was, on motion duly made
and seconded, adopted by the following vote on the 23rd day of
March, A. D. , 1983 .

Development Standards
1. The permitted use on the hereon described parcel of land shall be
the processing of gas gathered from nearby production to remove
salable liquids and deliver the processed gas to a local purchaser.
2. The major facilities shall be one (1) office, one (1) compressor
and pumping building, and two (2) product storage tanks and one (1)
two-hundred and ten (210) barrel oil tank, as described in the
submitted application materials.
3. All accesses shall have the approval of the Weld County Engineering
Department and all accesses shall be constructed in accordance with
the recommendations and/or requirements of the Weld County Engineer-
ing Department. All truck traffic shall be routed south on Weld
County Road 35.
4. The applicant shall have an adequate water supply.
5. All construction, electrical work and fabrication will be done in
accordance with the Weld County Building Code.
6. The appearance of the facility shall be maintained in a neat and
orderly condition through periodic painting and maintenance.
7. The Special Use Permit area shall be maintained in such a manner so
as to prevent soil erosion, fugitive dust, and the growth of noxious
weeds.
8. All phases of the operation shall comply with all County and State
Health Standards and Regulations pertaining to air quality, water
quality, noise emission, and sanitary disposal systems.
9. Safety and fire protection will be as prescribed by the La Salle
Fire Protection District, Industry Standards, and/or other applic-
able rules and regulations of governmental bodies having jurisdic-
tion on the premises.
10. The Special Use Permit shall be limited to the plans shown hereon
and governed by the Development Standards stated above and all
applicable Weld County Regulations. Any material deviations from
the plans and/or Development Standards, as shown or stated above,
shall require the approval of an amendment of the Special Use
Permit by the Planning Commission and the Board of County Commis-
sioners before such changes from the plans and/or Development
Standards shall be permitted. Any other changes from the plans
and/or Development Standards shall be filed in the office of the
Department of Planning Services.
11. The property owner and/or operator of this operation shall be
responsible for complying with all of the above stated Development
Standards. Noncompliance with any of the above stated Development
Standards may be reason for revocation of the Special Use Permit by
the Board of County Commissioners.

The following business was transacted:
I hereby certify that pursuant to a notice dated February 14 , 1983, duly
published February 17 , 1983 , in the La Salle Leader, a public
hearing was held on the request of Associated Natural Gas, Inc. ,
for a Use by Special Review for a natural gas processing plant.
The Planning Commissioh recommended that the request be approved
with conditions and development standards. Tom Norton, an Engineer,
and Mike Quigley, representing Associated Natural Gas, Inc . , were
present to answer questions . Mr. Norton stated that they have
no problems with the conditions or the development standards .
Mr. Norton stated that they have not determined whether they will
have one wide access to two regular size accesses. In either
case they will work this matter out with the County Engineer.
The compressor will be driven by natural gas and electricity,
stated Mr. Quigley. Mr. Norton stated that the noise level
should not bother the neighbors. After review, Commissioner
Martin moved to approve this request with conditions and development
standards Commissioner Brantner seconded the motion. Roman G.
Weninger; an adjacent landowner, questioned why the Board is
conducting a hearing now when the plant has nearly been completed.
He stated that he will get have an injunction filed against the
Board of County Commissioners regarding their procedures. He
stated that his property will be devaluated if this Use by Special
Review is granted. Mr. Weninger stated that he wants the County,
State, and Federal governments to act in a proper manner. Greg
Oxenfeld commented on the Use by Special Review procedure. When
construction has started the owner is asked to apply for the Use
by Special Review permit and should the request be denied every-
thing must be removed from the site. Mr. Norton stated that they
understood the regulations , they have started construction, agreed
to pursue the Use by Special Review application, and if disapproved
they would remove everything from the site. Mr. Weiniger demanded
that the Board stop this process until this matter has been decided
by the Courts. Mr. Oxenfeld stated that there was no opposition
when the hearing was held before the Weld County Planning Commission.
Mr. Norton stated that construction on the site did not begin until
after the Planning Commission made their favorable recommendation.
The Chairman stated that this request follows along with the
Planning Ordinances and across the road there is no development.The
land is zoned agricultural. The motion carried unanimously.
RE #591 - Oliver J. Lorenz: This request is to divide the property
into parcels of 157 . 04 acres and 2 . 96 acres, more or less . Mr. Lorenz would
like to separate the smaller parcel for the gas plant and continue to farm
the larger parmi The Planning staff recommended approval with conditions.
Commissioner N. Carlson moved to approve this request with conditions
as recommended by the Planning Staff. Commission Brantner seconded the
motion and it carried unanimously.

Be it Resolved by the Weld County Planning Commission that the application for
a Natural Gas Processing Plant located on the following described
property in Weld County, Colorado, to-wit:
Part of the SEA, Section 35, T4N, R66W of the 6th P.M. , Weld County, Colorado
be recommended (favorably) (ggiRR ) to the Board of County
Commissioners for the following reasons:
1. The submitted materials are in compliance with application requirements
of Section 24.7 of the Weld County Zoning Ordinance.
2. It is the opinion of the Weld County Planning Commission that the

request, and the responses of the referral entities which have reviewed
this request.
The Planning Commission recommendation is conditional and based upon the
following:

THE DEPARTMENT OF PLANNING SERVICE'S STAFF RECOMMENDS THAT THIS REQUEST BE
approved FOR THE FOLLOWING REASONS:
1. The submitted materials are in compliance with application requirements
of Section 24.7 of the Weld County Zoning Ordinance.
2. It is the opinion of the Department of Planning Services staff that
the applicant has shown compliance with Section 24.3.1 et seq. of
the Weld County Zoning Ordinance as follows:
- The proposal is consistent with the Comprehensive Plan policies
in that the use does not infringe on continued agricultural
use in the vicinity or County. The proposal does not appear
to have any adverse impacts on the agricultural interests of
the County or the environment.
- The proposal is consistent with the intent of the Agricultural
Zone District; and is provided for as a Use by Special Review.
- No overlay districts effect the subject site.
- The town of Gilcrest has submitted a favorable recommendation
for this request.
- It is the opinion of the Department of Planning Services staff that
the attached Development Standards will minimize impacts on
surrounding uses and the area to the greatest extent possible
and provide adequate protection of the health, safety, and
welfare of the inhabitants of the area and the County.
These determinations are based, in part, upon a review of the information
submitted by the applicant, other relevant information regarding the
request, and the responses of the referral entities which have reviewed
this request.
The Department of Planning Services staff recommendation is conditional
and based upon the following:
1. The attached Standards for Use by special Review be adopted;
2. The plat for the use permit be placed of record by the Department
of Planning Services staff prior to any building permits being
issued on the site.

Development Standards
1. The permitted use on the hereon described parcel of land shall be
the processing of gas gathered from nearby production to remove
salable liquids and deliver the processed gas to a local purchaser.
2. The major facilities shall be one (1) office, one (1) compressor
and pumping building, and two (2) product storage tanks and one (1)
two-hundred and ten (210) barrel oil tank, as described in the
submitted application materials.
3. All accesses shall have the approval of the Weld County Engineering
Department and all accesses shall be constructed in accordance with
the recommendations and/or requirements of the Weld County Engineer-
ing Department. There shall be one (1) entrance to the site with a
minimum seventy (70) foot cul de sac to accomodate turning of
trucks. All truck traffic shall be routed south on Weld County Road
35.
4. The applicant shall obtain a water tap from the Central Weld Water
District for an adequate water supply.
5. All construction, electrical work and fabrication will be done in
accordance with the Weld County Building Code.
6. The appearance of the facility shall be maintained in a neat and
orderly condition through periodic painting and maintenance.
7. The Special Use Permit area shall be maintained in such a manner so
as to prevent soil erosion, fugitive dust, and the growth of noxious
weeds.
8. All phases of the operation shall comply with all County and State
Health Standards and Regulations pertaining to air quality, water
quality, noise emission, and sanitary disposal systems.
9. Safety and fire protection will be as prescribed by the La Salle
Fire Protection District, Industry Standards, and/or other applic-
able rules and regulations of governmental bodies having jurisdic-
tion on the premises.
10. The Special Use Permit shall be limited to the plans shown hereon
and governed by the Development Standards stated above and all
applicable Weld County Regulations. Any material deviations from
the plans and/or Development Standards, as shown or stated above,
shall require the approval of an amendment of the Special Use
Permit by the Planning Commission and the Board of County Commis-
sioners before such changes from the plans and/or Development
Standards shall be permitted. Any other changes from the plans
and/or Development Standards shall be filed in the office of the
Department of Planning Services.
11. The property owner and/or operator of this operation shall be
responsible for complying with all of the above stated Development
Standards. Noncompliance with any of the above stated Development
Standards may be reason for revocation of the Special Use Permit by
the Board of County Commissioners.

Associated Natural Gas is requesting approval to construct
a natural gas processing plant on the subject property which is
presently zoned Agricultural , under the County regulations for
Use by Special Review.
This use is consistent with the Weld County Comprehensive Plan
and similar plants have been constructed in Agricultural zones
throughout the County.
The use requested is compatible with surrounding land in that
Panhandle Eastern ' s gas plant is located within one-half
mile , which is exactly the same as that proposed.
It is also compatible in that numerous wells have been drilled
throughout the area and production cannot commence on these wells
without the processing plant.
Future development in the area is anticipated to be additional
Agricultural uses with continued development of the oil and
gas availably in rural Weld County. This future development
is compatible with the use intended and in fact is necessary
in the case of oil and gas development.
This application complies with the Weld County Zoning Ordinance,
Section 50, Overlay District Regulations , in that no overlay
districts exist at the proposed gas processing plant site.
The applicant has negotiated with numerous property owners in
the area to establish the best possible location for minimum
interference with the agricultural land and has located the site
in accordance with these property owners desires .
The applicant is designing and constructing the plant following
all codes and oil insurance guidelines to ensure the protection
of the health and safety of the inhabitants of the neighborhood
and of Weld County.
OIL AND GAS PROCESSING PLANT DESCRIPTION OF PROPOSED
OPERATIONS .
The proposed oil and gas processing plant will be operated as
a business with no residential units at the plant site. It
will basically be operated eight (8) hours per day with one
to two people at the plant during normal working hours . It
will be maintained by a crew working out of the office at
the plant site to operate and maintain the gas collection
transmission system which sends raw natural gas to the plant .
The proposed structures will be constructed of steel frame
with siding. All tanks will be constructed of steel and
liquid tanks will be bermed around the exterior high enough
to contain the total volume of liquid that might be spilled
should the tank rupture.
All roads within the plant site will be graveled and natural
drainage will be controlled so that it does not exceed the
normal runoff from the site prior to construction of the
facilities.
The domestic sewage system at the site will be a septic system
sized to accommodate the equivalent of a single-family
residence. A permit for this installation will be obtained
from the Weld County Health Department in accordance with the
standard requirements .
A letter is n_ rovided showing that the present property owner
will Provide domestic water service to the Plant . This water
will be from the Property or•m er' s existing well which is pre-
sently registered at the State Engineers office and can be used
for this purpose.
The vehicular traffic to the site will consist of pipeline
service vehicles which will be one or two pickups in and out
of the site three to four times per day. At the beginning
of processing there will be four to six semi trucks per
day hauling product from the site and in two to three years
when the plant is operating at maximum capacity, there will
be six to seven semi trucks hauling product from the site.
It is not the intent of Associated Natural Gas to store or
stockpile any quantity of materials or waste at the site.
There is no waste associated with the processing plant and
the only materials that would be stored would be a few valves ;
a small amount of pipe material for maintenance and repair of
the pipeline system.
The operator intends to construct the plant in sixty (60) days
and have it in operation in late April of 1983 . No specific
landscaping plan is proposed with this site. The reclamation
procedure that would be completed when the plant is no longer
needed for use would be to sell all major equipment and move
it from the site . Only a minor amount of piping and unsalvagable
material would remain.
The fire protection measures necessary for a processing plant
of this type consist primarily of continual attention to safety
procedures by the employees . Fire extinguishers will be
available at the facilities and in all vehicles , however,
if a major fire occurred even the local fire departments would
not be able to control such a fire. It would be necessary to
shut down the gas pipeline system and let the fire burn itself
out. All facilities subject to burining have been set back
at least sixty-five (65) feet from the County Road to provide
extra protection to the roadway.
We have included a cony of the Air 'Pollution Study_ for the plant
and the Soils and Geological Study for the plant , for your
information. We have also included a cony of the Purchase

Processing Plant On A Parcel Of Land Described As The SE-1/4,
Section 35, Township 4 North, Range 66 West of the 6th P.M. ,
Weld County, Colorado
Dear Mr. deGraffenried:
Your application and related materials for the request described above
are complete and in order at the present time. I have scheduled a
meeting with the Weld County Planning Commission on March 1, 1983 at
1:30 p.m. This meeting will take place in the County Commissioners'
Hearing Room, First Floor, Weld County Centennial Center, 915 10th
Street, Greeley, Colorado. It is recommended that you and/or a repre-
sentative be in attendance to answer any questions the Planning Commission
members might have with respect to your application.
It is the policy of Weld County to refer an application of this nature
to any town or municipality lying within three miles of the property in
question or if the property under consideration is located within the
comprehensive planning area of a town or municipality. Therefore, our
office has forwarded a copy of the submitted materials to the Gilcrest
Planning Commission for their review and comments. Please contact Ellen
Bennett, Town Clerk at 737-2426 for further details regarding the date,
time and place of this meeting. It is recommended that you and/or a
representative be in attendance at the Gilcrest Planning Commission meeting
to answer any questions the Commission members may have with respect to
your application.
It is the responsibility of an applicant to see that a sign is posted on
the property under consideration at least ten (10) days preceeding the
hearing date. Sometime prior to February 18, 1983, you or a representative
