RE: ACCEPT PETITION AND AUTHORIZE VACATION OF A PORTION OF RIGHT-OF-WAY
ON COUNTY ROAD 27 BETWEEN CRS 30 AND 32 - BELLA HOLSTEINS/GARY
HENRICKSON
WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to
Colorado statute and the Weld County Home Rule Charter, is vested with the authority of
administering the affairs of Weld County, Colorado, and
WHEREAS,the Board has been presented with a Road Petition from Bella Holsteins/Gary
Henrickson, 4350 Highway 66, Longmont, Colorado 80504, a copy of said petition being attached
hereto and included by reference, requesting vacation of a portion of right-of-way for County
Road 27 between CRs 30 and 32, being more fully described as follows:
The public road right-of-way lying 30 feet on either
side of the section line between Sections 19 and 20,
Township 3 North, Range 66 West of the 6th P.M.,
Weld County, Colorado.
WHEREAS, the County Attorney's Office and Departments of Public Works have
recommended approval of said request since that portion of right-of-way is not needed for the
safety and welfare of the traveling public, and
WHEREAS, the petitioners, being the adjacent property owners on both sides of the road
right-of-way, have waived written notice of this hearing, and
WHEREAS, any persons owning dedicated and recorded easements and rights-of-way for
the use of the right-of-way to be vacated, if any, may continue such use after formal vacation by
Weld County, and
WHEREAS, the Board of County Commissioners heard testimony and reviewed all other
evidence presented therein by staff and the public, and
WHEREAS, the evidence showed that the vacation of that portion of right-of-way which is
described above will not leave any land adjoining the roadway without an established public road
or private access easement connecting the land with another established public road, and
WHEREAS,the Board of County Commissioners deems it advisable to vacate said portion
of road right-of-way, with said vacation to become effective upon recording as required below.
NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Weld
County, Colorado,that the Road Petition from Bella Holsteins/Gary Henrickson be, and hereby is,
accepted.
BE IT FURTHER RESOLVED by the Board that the portion of right-of-way which is
described above be, and hereby is, vacated, and any persons owning dedicated and recorded
easements located within such vacated right-of-way, if any, may continue such use.

As support for this petition, Petitioners state that the right-of-way has not been
constructed nor maintained by Weld County;that no part is within a City or Town or a County other
than the County of Weld, that no portion of the right-of-way is shown as part of an approved or
recorded subdivision plat, map, or unincorporated community legally filed prior to any regulations
controlling subdivisions;that the right-of-way is not used by the public;that vacation of the right-of-
way will not leave any land adjoining said roadway land adjoining said roadway without an
established public road or private-access easement connecting said land with another established
public road.
Petitioners agree that they will permit any persons owning dedicated and recorded
easements and rights-of-way for the use of the right-of-way to continue such use after formal
vacation by Weld County. Further,. Petitioners agree to pay costs of providing notice including
publication, and recording of the resolution.
'This information shall be provided in the form of a certified list of the names,addresses and the corresponding Parcel
Identification Number assigned by the Weld County Assessor of the owners of property(the surface estate)who owns one acre or
more of land adjacent to the roadway. The source of such list shall be the records of the Weld County Assessor, or an ownership
update from a title or abstract company or attorney,derived from such records or from the records of the Weld County Clerk and
Recorder. If the list was assembled from the records of the Weld County Assessor,the applicant shall certify that such list was
assembled within thirty(30)days of to petition submission date.

COLORADO SUBJECT: Vacation of Road Right-of-Way
In reviewing the proposal to vacate or abandon WCR 27 section between WCRs 30 and
32, the applicant is missing some additional landowners adjacent to this section line. In
the south half of Sections 19 and 20, it appears that the Town of Platteville has annexed
to the section line. The owner is identified as Todd Harris in Section 19 and BarClay
Farms in Section 20. Neither one of these names appear on the road petition.
In the file is a proposed extension of the Columbine Parkway with alternates 1 through
3, which are parallel, the south property line of the Bella Honstein facility. Verification
from the project design team if this is still an active project to it and if the
vacation/abandonment of the section line would cause any additional problems to this
project.
I will circulate this within the Department for comments prior sending it back to CTB.

Subject: Bella Holsteins Petition to Vacate Weld County Road 27 Between Weld County
Road 30 and Weld County Road 32.
Dear Mr. Barker,
Pursuant to the Abandonment petition for WCR 27 between WCR 30 and 32, which was
filed February 19, 1999, this letter is to request that the county moves forward with this
petition. In a letter dated May 4, 1999 from Lee Morrison, it was stated that the county
would support this petition, provided the Highway 85 access arrangements would not
require the use of this right-of-way. At that time, however, there was no formal
arrangement between Weld County, Platteville and the Colorado Department of
Transportation.
There has been no action taken by the county since that date and we would like to
complete this project for our client. The abandonment would be between the NW % of
Section 20 and the NE 'A of Section 19, Township 3 North, Range 66 West of the 6th
P.M. For your reference the case is under USR-1195 Bell Holsteins. I have enclosed a
new road abandonment petition along with the projected paths of the HWY 66 project.

Subject: Bella Holsteins Petition to Vacate Weld County Road 27 between Weld County Road,

Dear Lee:
Pursuant to your letter of May 4, 1999, additional information is enclosed concerning the matter
indicated above. Evidence of property ownership adjoining the right right-of-way is attached and
includes a certificate of conveyance pertaining to the property from Weld County Title Company.
The Certificate was signed July 9, 1998. Ownership of the property has not changed since that
time. A Warranty Deed indicating ownership of the parcels is also attached.
The Utility Notification Center of Colorado was contacted on May 6, 1999, regarding the
existence of any underground utilities along the right-of-way. Two companies, HS Resources,
Inc., and Duke Energy Field Services, Inc., indicated their lines cross the right-of-way at the
centerline of the two sections. Maps submitted by the two companies showing the location of
their lines are attached. The other companies that responded indicated they did not have lines
crossing or running within the tight-of-way.
If any additional information is needed to facilitate the abandonment of the right-of-way at Bella
Holsteins, please let me know.

Dear Philip:
The Petition, as submitted,does need some additional information. Footnote 1 of the form notes that
property owners adjoining the right-of-way should be documented by means of the Weld County
Assessor's records or a title or abstract company or attorney is title opinion. While I understand that the
two Petitioners are the owners of the property,the record needs to contain some documentation of that
fact. The issue of whether existing utilities also could use some documentation such as a locate or title
examination to assure there is not use of the section line right-of-way by utilities.
The greater issue is identified in footnote 3 regarding special provisions. As we previously discussed,
the staff would support the vacation as proposed in the Petition but only will do so when steps are taken
to confirm the Highway 85 access arrangements on the east side of Platteville will not require the use of
that road right-of-way and that road right-of-way be substituted, consistent with that plan, for the vacated
road right-of-way. It is my understanding that the Highway 85 access plan is not completed formally
between Weld County, Platteville and the Colorado Department of Transportation but is close to that
point. I would ask that you contact Frank Hempen,Director of the Weld County Public Works
Department,at 356-4000,extension 3750 regarding the location of the right-of-way that the County
request be dedicated to replace WCR 27. I have enclosed a form for Deed of Dedication used in similar
circumstances for your review.
