I appreciate your candor and I hope you appreciate DEFS's candor as • well. I understand that you were not pleased with the actions of DEFS's predecessor,and trust that you have found DEFS to be both upfront and honest in its dealings with you. Since discussing the project with you late yesterday, I contacted the DEFS's asset manager for Weld County to gather more information. TClancy@WOBJLAW.com March 3, 2006 VIA HAND DELIVERY AND U.S. MAIL Florence and Larry Kammerzell 4410 83rd Avenue Greeley, CO 80634 Re: Duke Energy Field Services Dear Mr. Kammerzell: Yesterday I spoke with DEFS's asset manager for Weld County for more specific information about the facility on your property. As you know, DEFS's USR permit will require DEFS to meet a number of operational standards. A summary of the proposed standards is enclosed for your review. In addition to meeting the standards to be imposed by the County,DEFS agrees to voluntarily ask the County to add other conditions to its USR permit in light of our discussions. DEFS will ask that the approval of the USR permit be conditioned upon the installation of a so-called "hospital muffler"prior to operation,as well as the submittal and approval of a plan to reduce off-site light glare. In addition, DEFS will ask the County to add a requirement to the permit's development standards limiting the site to one engine only.
