Rev: 1-27-97 Signature: Ow r or Authorized Agent EXHIBIT 2007-2136 --�- INTRODUCTION DCP Midstream("DCP",formerly known as"Duke Energy Field Services") is submitting its application for an amended USR Permit to operate oil and gas processing facilities. The original USR was obtained by Associated Natural Gas, also known as ANGC Corp. DCP acquired Associated Natural Gas' processing facilities in Weld County in the 1990's. DCP does not plan to change the nature of the use of the site;however,various aspects of the site will be modernized over time. In addition, since the site was first permitted, the equipment and technology has been significantly and substantially upgraded. It is DCP's intent to update this site for land use permitting purposes, and DCP looks forward to working with the County on this project. RESPONSES TO USE BY SPECIAL REVIEW QUESTIONNAIRE (AMUSR-987) 1. Explain, in detail,the proposed use of the property: DCP currently operates an oil and gas processing facility on the property. The equipment includes compressors associated with gas processing and other equipment to allow gas produced in Weld County to be transported to market and sold. 2. Explain how this proposal is Consistent with the intent of the Weld County Code, Chapter 22 (Comprehensive Plan): The proposed use is consistent with the Comprehensive Plan because it seeks to use the land to foster the development of the vast natural resources in Weld County. Moreover, given the property's size together with the absence of any water rights attached to the property,it is impractical to use this property for farming. 3. Explain how this proposal is consistent with the intent of the Weld County Code, Chapter 23 (Zoning) and the zone district in which it is located: The proposed use is consistent with the intent of the Agricultural Zone District, as it will foster the development of oil and natural gas resources,and Section 23-3-40.A.2 of the Weld County Code provides that Oil and Gas Production Facilities are allowed as a matter of right in the Agricultural Zone District. Further, it will not interfere with any agricultural operations. 4. What type of uses surround the site? Explain how the proposed use is consistent and compatible with surrounding land uses: The site is surrounded by agriculture uses. 5. Describe, in detail, the following: a. How many people will use the site? 4 man-hours per day. b. How many employees will be on site? The site is currently staffed by one DCP employee. c. What are the hours of operation? The facility operates 24 hours per day. d. What type and how many structures will be erected (built) on this site? Please see the plot plan and equipment list. e. What type and how many animals, if any, will be on this site?No animals. f. What kind(type, size, weight) of vehicles will access this site and how often? Pick up trucks/passenger vehicles (1 per day), semi-trucks (1 per day) g. Who will provide fire protection to this site? Southeast Weld Fire Protection District. h. What is the water source on the property? (Both domestic and irrigation). Deep Rock Water. i. What is the sewage disposal system on the property? (Existing and proposed). Waste Management Portable Toilet service. j. If storage or warehousing is proposed, what type of items will be stored? There is a garage area for storage for mechanical items. This is not a"shop" for the changing of oil, washing vehicles, etc. 6. Explain the Proposed Landscaping for the site. The landscaping shall be separately submitted as a landscape plan map as part of the application submittal: There is no proposed landscaping. 7. Explain any proposed reclamation procedures when termination of the Use by Special Review activity occurs: No reclamation procedures will be necessary. 8. Explain how the storm water drainage will be handled on the site. The current natural drainage will not be disturbed. In general, the equipment is located on concrete pads. 9. Explain how long it will take to construct this site and when construction and landscaping is scheduled to begin: All construction is complete. 10. Explain where storage and/or stockpile of wastes will occur on this site: All wastes will be removed by truck or other appropriate method. Duke acquired ANGC Corporation and Associated Natural Gas in the early 1990's,which is how DCP acquired its interests in the processing plants in Weld County. All items purchased for the Enterprise Compressor Station by DCP Midstream are delivered to the Roggen Gas Plant. Because the Enterprise operator is on-site only 4 hours per day,DCP has the items delivered to Roggen so that an employee may sign the delivery ticket. On the second page of the Waste Management invoice,the location of service is identified as the Guttersen Ranch, which is the Enterprise location.
