RE: APPROVAL OF SUBDIVISION EXEMPTION NO. 186 - GOTTLIEB BOHLENDER

WHEREAS, the Board of County Commissioners of Weld County,
Colorado, pursuant to Colorado statute and the Weld County Home

Rule Charter, is vested with the authority of administering the
affairs of Weld County, Colorado, and
WHEREAS, the Board of County Commissioners has reviewed the — `
request of Gottlieb Bohlender for an exemption from the definitions
of "subdivision" and "subdivided land" in Section 30-28-101 (10) (d) ,
CRS 1973 , as amended, and Section 2-1 A. (3) of the Weld County
Subdivision Regulations, and

WHEREAS, the Board of County Commissioners finds that Gottlieb
Bohlender is the owner of a certain parcel of land located in part
of the NE4, Section 1 , T3N, R65W of the 6th P.M. , Weld County,
Colorado, and
WHEREAS, Gottlieb Bohlender was granted Subdivision Exemp-
tion No. 42 in 1977, and
WHEREAS, Gottlieb Bohlender wishes to adjust the boundary
lines on the 9 . 789 acre parcel to its status of 30 acres as it
was before 1977 , and
WHEREAS, the parcels as they now exist and as they are pro-
posed with this Subdivison Exemption request are more particularly
described as follows:

The owners of the property described above have requested an exemption from
Section 2-1 of the Weld County Subdivision Regulations adopted August 30, 1972.
The Department of Planning Services staff has reviewed this request and
recommends that the request be approved for the followings reasons:

Agree with the Weld County Comprehensive Plan
Create new parcels elgible for building permits
Agree with surrounding land uses
O1IMENTS:
Mr. Bohlender would like to adjust the boundary lines on his 9.789 acre
parcel to its pre-1977 status of 30 acres. This current subdivision exemption
would amend a previous subdivision exemption (e.g. , SE 42) for this parcel.
The Department of Planning Services has not received any objections regarding
this case.

COMMENTS:
Subject site has a southwestern slope. Access to site is gained off of Weld County
Road 38, a dirt road. The existing 9.789 acre parcel has a residence and a dog
kennel (kennel, brood houses and pup runs) . The kennel portion has been abandoned
for a period of time. Construction is taking place to the southwest of the kennel.
This subdivision exemption would revert the property lines back to their pre-1977
status. (30 acres) .
