Site Specific Development Plan and Use by Special Review (USR) Questionnaire

1. Explain,in detail,the proposed use of the property.
Said property is proposed to be used as a commercial installation of an auto body
collision repair shop. The intent of this business to is provide collision repair to late
model vehicles where the extent of the work on said vehicles to be limited to those
repairs requiring temporary residence on named property. No storage of vehicles,vehicle
parts,or extended housing of vehicles is expected nor desired. The building in which this
business operates consists of one unit(7,200 SF), fully enclosed,with adequate
infrastructure to support operations. Proper life safety measures have been put in place
and are functional.
2. Explain how this proposal is consistent with the intent of Weld County Code,
Chapter 22 (Comprehensive Plan).
Weld County Code, Chapter 22, Section 2-60 states provisions for conversion of
agricultural land into non-urban commercial use. The addition of this Business onto the
named property has not disrupted the use of the land for the Owner as it was not used for
agricultural purposes originally. Nor does it disrupt the uses of the surrounding property
owners. The development is therefore compatible with the region and is in an area that is
able to support it. Additionally, Section 1-120 allows for the property owner to use his
property as is his right. The individual owner's use of this property does not infringe
upon the health, safety or welfare of the community.
3. Explain how this proposal is consistent with Weld County Code,Chapter 23
(Zoning) and the zone district in which it is located.
Though this property is zoned as agricultural use land,the use as such is not currently in
effect. There have not been measurable agricultural uses for this property since the
owner purchased the property, nor are surrounding parcels being used for agricultural
purposes. The intent of Chapter 23 is to maintain acceptable uses of the land within the
County and to ensure that the health, safety and welfare of the current and future
inhabitants of the County are not adversely affected by such uses. The parcel referred to
herein will not be of detriment to the current inhabitants of the property,the surrounding
land owners, nor of future land holders with the issuance of the Use by Special Review.
The property value will be increased for future land owners due to additional functioning
space for the owner, no decrease in useable land space, and no infringement upon animal
life upon the property. No additional streets or thoroughfares are required, and
congestion in the area will remain at a minimal level. The use of the land as proposed
herein will not present a danger or hazard to surrounding parcel owners,nor will any
economic decline be realized.
4. What type of uses surround the site? Explain how the proposed use is
consistent and compatible with surrounding land uses.
The surrounding parcels are all similarly zoned, five of which, within this subdivision are
currently under use by special review by Weld County for varying operations. No
properties are currently being used for agricultural production.
5. Describe, in detail,the following:
a. How many people will use this site?
Only the owner of the property and his employees will be authorized to operate on
site. At any given time, there may be additional,temporary visitors to the site of
the business.
b. How many employees are proposed to be employed at this site?
There will up to 3 additional employees in addition to the Owner,to include the
Owner's wife and other employees as necessary for efficient operation of the
business. If the business operations grow in such a manner to require more
employees,or more space,the owner will look elsewhere for property on which to
operate his business.
c. What are the hours of operation?
8:00 am to 5:00 pm Monday through Friday
d. What type and how many structures will be built on this site?
No additional structures will be built on site. The building from which
commercial operations will function is a single, enclosed 7,200 SF building,
already on site.
e. What type and how many animals,if any,will be onsite?
No additional animals.
f. What kind (type,size,weight)of vehicles will access this site and how
often?
Passenger vehicles of approximately 5,000 lbs GVW will be on site. On average,
there will be no more than 5 vehicles on site at a time. Customer visits average 2
or 3 per week. All vehicles will be housed indoors, with the exception of the
company pick up,temporarily visiting vehicles, for deliveries (2-3 per week),tow
trucks once or twice per month(on average)etc. The trash removal truck will be
onsite to remove trash once per week.
g. Who will provide fire protection to the site?
The property is protected by the Frederick-Firestone Fire Protection District. The
nearest fire station is located on Hwy 119 and Road 15, approximately 1.5 miles
away. The fire hydrant serving this property is located approximately 800 feet
northwest of this property.
h. What is the water source on this property? (Both domestic and
irrigation)
The water to this property is supplied by Central Weld County Water District. No
additional irrigation supply is required.
i. What is the sewage disposal system on the property?
A permitted septic system has been installed for the building and is functioning
properly.
j. If storage or warehousing is proposed,what types of items will be
stored?
Temporary storage only as necessary for the completion of collision repair will be
expected. Replacement auto parts will be the majority of the items stored. All
shop equipment necessary for the operation of the business will be housed within
the building at all times. An exterior storage yard has been provided to
accommodate the temporary storage of larger items for ease of access. No long
term storage of any kind is either intended or desired. No derelict vehicles will be
visible on the property. There will be brief periods(hours not days)when
"aesthetically challenged"vehicles are visible, i.e. shop cleaning, shuffling
between bays, etc.
6. Explain the proposed landscaping for the site.
No additional landscaping is proposed for the site.
7. Explain any proposed reclamation procedures when termination of the Use
by Special Review activity occurs.
When the termination of the USR occurs,the building will be used solely by the owner as
personal use and storage area. No generation of revenue will exist from use of the
building at that time.
8. Explain how storm water drainage will be handled on the site.
The following measures have been taken to ensure adequate storm water drainage from
the site with the addition of the aforementioned building: All roof surfaces drain to
localized points on the building's gutter system,which is then routed through downspouts
to areas above ground to join the natural flow of water from the site. The building pad is
at a higher level than the surrounding land to ensure adequate runoff.
9. Explain how long it will take to construct this site and when construction and
landscaping is scheduled to begin.
No additional structures or landscaping are scheduled for this site.
10. Explain where storage and/or stockpile of wastes will occur on site.
There shall be no stockpiles of wastes or debris. The disposal dumpster will
accommodate necessary wastes and will be emptied weekly by the appropriate trash
company. Hazardous wastes will be minimal (less than 3 gallons per year) and are
handled in accordance with Federal regulations.

To Whom It May Concern:
In mid January of 2007, I had a pre-application conference with Bethany
Salzman, Hannah Hippely, Wade Melies and Char Davis to discus my need for a
USR permit and the requirements of the application. As well as a dead line for the
application to be turned in, April 2* 2007
I was informed that the first thing I needed to accomplish was the "Notice of
Inquiry" with the city of Firestone, due to my location within the Firestone IGA. I
went to the Firestone town hall The following Monday, where I was told the town
planner would look it over, sign it off and send it to the county. I tried to tell her (I
don't know her name)that I needed it for my USR application; she told me that
they mail them in. Approximately two weeks later I called Bethany and Hannah to
ask if the Notice of Inquiry had been received and was told, it had not. I then went
back to the Firestone town hall and asked again about it, showing my Photostat
copy, and was told the same thing, which Bruce would look it over and send it in. I
reiterated that I needed to know which way it would go so that I could proceed
with the USR permit. She just said that she would tell Bruce.
Since my property is located in middle of the subdivision and my little business
will never generate a lot of tax revenue, I could see no plausible reason for the city
to annex my property and decided to press on with the USR application. Assuming
Bruce would eventually, "mail it in". This was approximately the first week of
February.
I completed the application package and went to the southwest Weld County
office were my application was refused because of the lack of the "Notice of
Inquiry" from Firestone., I went to Firestone, and asked to see Bruce, I was told
Bruce's office was in Aurora and he was unavailable for the rest of the week. I left
multiple messages anyway, stating that my "time sensitive" documents were about
to expire and I really needed to get the "Notice of Inquiry" done. He did return my
calls on April 10th I suggested that I meet him at the town hall to pick it up, he
informed me that he would mail it in. I was trying not to be argumentative, but I
told him that I needed it as part of my USR application and would need it before
my USR application would be accepted. He snapped back that he would be
"mailing it in because that is the way I have been doing it for 12 years!" With no
application to associate it with, how is anyone supposed to know what to do with
it? By the time it got figured out all of the "time sensitive documents" would be
expired. Assuming that he actually does it! (it has been nearly 3 months now) I
called Bethany Salzman to explain my "catch 22", and ask her recommendation on
how to handle it. I then received a call from Michelle Martin advising me to write
this letter and turn it in. Z--
